Okay we’ve had the first hour in court concluding Dr Kipper’s deposition. Today JD is wearing a dark three-piece suit, light shirt and grey(?) leaf (?) patterned tie , with his hair in a pony tail. AH is wearing a black tailored suit and black shirt buttoned to the top, with...

… her hair down, side-parted. JD came into the courtroom wearing shades if I’m not mistaken. We’re on a break. Dr K’s depo has concluded. I am going to try to summarise before we go back in.

We started with a text from JD to Dr Kipper (DK) saying Dr Cowan (who I think was treating AH) should be "stripped of his licence” and then physically stripped painted red and attached to a lampost or something, calling him "an irresponsible turd of monumental proportions."

DK was asked if he remember this text. He did. He added “I have a great respect for Dr Cowan”

JD complains AH has been filled (by Dr Cowan?) with hippie speak eg. “Your fear is so visible”

DK confirms he was in the employ of JD from 2015 and that he remains in his employ.

Says his diagnostic impression of JD was that he had Primary Dopamine imbalance/ADHD/Depression/Insomnia/Chronic Substance Abuse Disorder/Chronic refflux

DK describes the registered nurse Debbie Lloyd who was assigned to JD to adminster meds. She was with him a lot of the time..

… which JD agreed to. DK met with JD over 22 - 24 June 2014 and met with AH too.

Asked if AH says she was concerend about JD hitting her. No

… and is particularly sensitive to his behaviours and and potential for abuse.”

DK clarifies this means substance abuse no violent abuse. And when referring to the former part of that statement he said AH is:

… inflicts and is not only able to recognise it but also it affects her… she has the ability to understand what that looks like.”

We cover the detox trip to JD’s island in the Bahamas where JD, AH, Debbie Lloyd (DL) and several JD assistants were present in Aug 2014. Johnny stayed in his residence, a small structure with a bedroo, bathroom and kitchen area. DL and DK stayed in yurts 5 mins drive away.

DK checked on JD once a day physically and several times a day electronically. At one point they met JD was “frustrated. he was uncomfortable”. AH was not present during that meeting but he did see her the next day.
He was asked if AH sought treatment for physical injuries...

No.
Would he document it if she had.

Asked throughout the time he had known him to that point if he ever witnessed him being physically abusive to AH?

AH became DK’s patient and was eventually assigned her own nurse under DK’s control

Her name was Erin Burin (EB). She was seeing AH on at least a weekly basis. We are taken to [Kipper 34] a document by EB dated 27 Aug 2014. They make no mention of any abuse or injuries towards AH.
DK is asked.

Would they be in EB’s notes if she was told about any violence?

In March 2015 (the finger incident), DK went to Australia to visit JD. the day after his arrival he was told JD had lost part of his finger. He went to the house JD was renting. JD was outside the house in the car. DK treated JD’s wound whilst instructing those present to search

… the house for the tip of JD’s finger. It was found by the chef on the floor of the kitchen.

DK confirms he went into the house (where he issued the instruction) and witnessed broken glass in the kitchen. He saw blood, but no blood on any glass.

Asked if DK saw JD. Yes.
“She was certainly upset” but she did not seek medical attention for any injuries. He did not witness any injuries. She did not have a swollen face nor scratches on her hands or feet that he could recall.

Asked if he had witnessed any inuries whether he would have documented it.
Yes.

Go to an assessment of AH made by another one of DK’s nurses after she complained of a headache on 17 Dec 2015 - notes say “Bumped her head after standing up two days ago”
Physically examined. No physical injuries noted and no sign of concussion.

We cover a request made on 8 Aug 2016 by AH for any medical records during Dec 2015 which is sure he would have supplied.

DK is re-examined about the cut finger...

… by someone I assume is an AH attorney.

The reference from the emergency room was that JD had cut his finger with a knife. Correct?

DK confirms once more that he neither saw AH being hurt by JD or JD being hurt by AH and got no reports from anyone that either party had been violent towards one another.

We start the Debbie Lloyd depo. Dr Kipper was a bouffant-white-haired gentleman, DL is a blonde-haired lady wearing glasses during this depo. She tells the attorney that during a phone called with a JD attorney (Camille) she was asked if JD had ever thrown anything at her.

She said no. She was also asked if she would go to Virginia to testify.
She said no, she wouldn’t

Asked if she spoke to Adam Waldman - she remembers an Adam trying to contact her but doesn’t remember his last name.

DL is a certified addiction nurse. taking care of patients with chemical dependency issues. Drugs and alcohol.
DL was contracted to DK via an organisation called Turning Point to nurse JD. She had worked for DK before.

DL i was taking care of JD and AH, it was decided AH needed some support so I brought EB in for AH.

DL confirms she was primary nurse for JD and EB was primary nurse for AH but sometimes EB covered for her. She did not cover for AH.

Who decided AH needed nursing care?

[Lloyd exhibit 1] starts on date 12 June 2014 - they are DL’s nursing notes that she created. 123 pages long.

We have taken 5 minutes to establish they are her notes, she normally takes these notes, she types them on a laptop, she was not instructed to create the notes and the notes were sent to DK for review. RN is her and MD is DK.

She sends the notes to him by email.

13 June 14 she meets JD at his apartment “according to my notes. I don’t recall”

Notes: he stated he started taking opiates after some dental work and became addicted. Fearful of coming off opiates, but knows it is what he has to do.

Notes: patient expressed emotional trauma which causes him anxiety.

She makes a home visit at 3.30am and finds JD sitting with scrape and bloody knuckles on right hand having punched whiteboard in kitchedn after a fight with fiance who felt he was not giving her support.

Court is actually very busy today - new groups of mainly female spectators in court. Some have brought packed lunches, which they are eating in the corridor outside court. It’s raining.

Have heard from three credible sources that Johnny Depp is scheduled to be taking the stand at Fairfax County Court TOMORROW. Do not change your plans yet, but I am happy my sources should know what they are talking about.

Court is back in session but one of the jurors is in pain due to a medical condition. The judge is explaining if he has to be excused, he is excused from the jury. The trial can’t stop. Currently the attorneys are confering at the bench.

The juror is excused from duty. Now there are only 10.

7 jurors will make the final decision.

The remaining 3 (chosen at random before the trial began) will be excused at the end of the trial.

We now have 7 men and 3 women.

There is some discussion about exhibits.

Conversations - I don’t remember specifics. Just that he was emotional and the relationship was causing him stress.

After JD injured his finger in Australia do you recall him coming back to LA.
I know he did return to LA at some point.

It was at the ECB - I was staying nxt door at a hotel and security came to get me and JB wanted to go back to 86 [the Sweetzer property]

So I went to the lofts (ECB) and I remember that night AH was already leaving - she was in the lobby and when she saw me she came back to the apartment. I remember JD was sitting outside and we went to leave and somehow we didn’t end up leaving.
