After 16 hours long negotiations, the #DSA is done! While the final text of the Act is not available yet, this is what we learned thus far 🧵
❌Safeguards that would prevent legally mandated upload filters and strengthen the protection of E2EE communication - both under Article 7 - are not included in the final text.
✅It seems that search engines will not be obliged to de-list illegal content/websites. The last minute proposal of @EP_Legal that would force search engines to de-list whole entire websites and indiscriminately scan the content is out.
❔Crisis Response Mechanism (new Art 27a) still allows the Commission to declare state of emergency across the EU. But now, it will have to act upon a recommendation of the Board.
❔The ban on the use of sensitive data in online targeting was watered down, very much repeating what is already in the #GDPR
✅No obligation of mandatory cellphone registration under #DSA! Image-based sexual abuse and non-consensual nudity are serious crimes that can hardly be remedied by reducing people's pseudonimity online.
❔Measure against dark patterns remains in the text. However, the open-ended list of platforms’ deceptive practices originally proposed by the @Europarl_EN was significantly shortened.
These are very first impressions that will be confirmed once the final text is available. Overall, the #DSA may cause change for the better. However, a number of progressive measures did not survive negotiations. Only the future will tell how far reaching that change will be.

🧵First results of #DSA plenary vote in the @Europarl_EN on individual amendments were published and indeed, there are many reasons to celebrate. Here are few initial takes, while we are awaiting the final vote ⬇️ #DSAForFreeSpeech
✅AM 207 notified content remains accessible while the assessment of its legality is pending. During the assessment process, platforms cannot be held liable for failing to remove the notified content. This is an important safeguard against over-removals/over-compliance
✅AM 513, the 'media exemption' that however, does not contain must carry obligation for media content but grants privileged appeal mechanism to dominant media against platforms' content moderation was rejected. This is a big win!
