Good morning this is Jenny Smith @GoodyActually tweeting the case of Allison Bailey vs Stonewall & Garden Court Chambers at the Employment Tribunal.

We expect proceedings to begin at 10.00 am.

Today Wednesday 27th April 2022 is the first full day of the hearing; there was a short administrative session on Monday 25th (tweeted at threadreaderapp.com/thread/1518506…)

Abbreviations:

AB: Allison Bailey, claimant
BC: Ben Cooper QC, barrister for AB

SW = Stonewall Equality Limited (respondent 1)

IO = Ijeoma Omambala QC, barrister for SW
RW = Robin White assisting IO

GC = Garden Court Chambers Limited (respondent 2)
RM = Rajiv Menon QC & SH = Stephanie Harrison QC (jointly respondent 3 along with all members of GCC except AB)

Respondents 2 & 3 are in practice indistinguishable; Garden Court Chambers are respondents both corporately and as the set of individuals making up the Chambers

AH = Andrew Hochhauser QC, barrister for GC (respondents 2 & 3)
JR = Jane Russell assisting AH

EJ = Employment Judge Goodman hearing the case
Panel = any one of the three panel members (EJ and two lay members)

After any final administration needed witness evidence will begin. The claimant Allison Bailey will be the first witness.

We expect the hearing to begin at 10:00 am.

EJ: introduces the case. Makes sure all the barristers are present. This is the first day of live evidence and Allison Bailey will -

BC [interrupts] Judge may have missed email last night?

BC: Claimant was taken to hospital last night and is still there - will not be able to attend today.

BC: We can't right now say any further than that re court planning

BC: We all parties agree we must try to keep to court schedule - but we would invite court to adjourn until 10 tomorrow morning, meanwhile all parties will explore what options might be when we have more information

EJ: invites other barristers to comment

IO: sorry to hear about claimant's apparent ill health; agree we need more information when it is known.

EJ: Mr Cooper pls email court clerk directly as well as the court, if needed, might be quicker

AH: I have suggested to BC that claimant's other witness could be taken before the claimant's own evidence if necessary

AH: yesterday new statement submitted by claimant, asking you to admit, we agree this but would like to submit some emails as evidence alongside; and would like to add questions re this when it comes up

EJ: I think Q of order of witnesses should be made tomorrow when we have we hope diagnosis and prognosis; adjourn to 10:00 tomorrow; BC please keep informed.

AH: court was going to rule on a document admission?
EJ: can do that now -
BC: would prefer it wait until claimant present?
EJ: Agreed. Adjourn till 10:00 tormorrow.
