Good morning from the queue for Day 11 of #DeppvHeard - it’s a beautiful sunny morning. But cold. Still - a decent turnout!
We have completed the video deposition of Officer Tyler Hadden, who accompanied Officer Melissa Saenz on the call out to the ECB in May 2016.
There are five more witnesses who may appear today. They are:
Officer William Gatlin (responding officer to ‘The Loft Incident’) - by video deposition
Alejandro Romero (front desk attendant at the Eastern Columbia Building) – by video deposition
Laura Wasser, Johnny Depp’s divorce attorney - by video deposition
and...
…
Christian Carino, CAA (former agent to both Mr. Depp and Ms. Heard) – by live video link
Terence Dougherty, ACLU – by video deposition
Whether we’ll get through them all is unclear.
Officer Hadden’s evidence was much the same as Officer Saaenz’s yesterday.
The were send out on a “domestic radio call” on the evening of 21 May 2016 to
Johnny and Amber’s apartment. They arrived at 2057 and left at 2122. They closed the call deciding that on the verbal evidence they had received and what they assessed about the situation it was a “verbal dispute”.
OH described the “victim” and witnesses as “uncooperative”. OH says the man identified as Josh Drew “wouldn’t even give me the name of the husband”
Confirms that he saw no injuries on Amber Heard. Says she did not want an incident report.
Or medical attention. OH says he and his partner gave AH one final chance of receiving medical attention or making a report before leaving her with a business card in case she changed her mind.
Adamant that he saw no injuries on her face (or anywhere). Said it just seemed puffy from crying. He was hown photos of AH and said she didn't look like she had any injuries. During cross examination he was read various rules about attending various...
… potential DV call-outs and that one of the rules is that photos of injuries or lack of injuries should be taken.
He counters that there was no evidence a crime had taken place and the “victim" did not want a report made. Had AH wanted a report made...
… then photos of her and the scene would have been taken as part of the report. As she did not want a report and the officers were satisfied there had been no crime it was filed as a verbal dispute.
There has been a break, during which I came out to tell you this. No we are back with today’s witness No 2. Officer William Gatlin - LAPD
He is taken to the “incident recall” - which takes down dispatch calls.
He and his partner arrive at the ECB on 21 May 2016 after Officers Saenz and Hadden had left at 2224
… Gatlin (OG) says the LAPD went back to the ECB. They met Josh Drew at the door who told them the police had already attended. OG knew this, but said he needed to check again to see if the alleged perpetrator had returned and created a new incident.
EB asks if OG attends DV incidents and doesn;t file a report if the victim is uncooperative. OG agrees but not just if they are unco but on the totality of the circumstance.
OG wrote it was a verbal argument on the record
EB for AH asks how he knew that
OG says he may have got it from hte record of the first attending officers
OG is asked if he was told there was a verbal argument only on his visit. He says no.
OG is asked when he became aware apartment was JD’s
OG couple of day
Are you a fan of JD
- seen a couple of his movies
Did he know AH
- was aware she was an actress, but had not see her work
OG did not file a report - says husband was no longer at scene, verbal argument, visual sweep of apartment showed nothing unusual. None of the witnesses ID’d JD, did not tell OG what happened, no one wanted to talk
EB brings up a Daily Mail online article suggesting AH and her friends was perpertrating a hoax that night
OG agrees he saw nothing suggesting this on the night.
[this goes to the counter-suit of AH’s which says defamatory statements were leaked to the media at JD’s behest]
[we are shown bodycam footage from OG showing him approaching PH3 at the ECB. it has audio. we see the officers going into PH3. Pistol and Boo can be seen running around. Officers ask for reassurance and are told all is good. They are in the building a v short amount of time]
OG is asked if he recalls looking for any injuries on the faces of the three women present in the apartment. He says no.
He says he did not observe any visible or verifiable injuries on AH. Did not take formal statements. Was satisfied there had been no change in the situation...
… from the previous officers visits.
EB asks if OG is in a position to say that an incident of domestic violence committed by DV had not occurred.
OG says he was not in a position to say whether or not it had happened as he wasn’t there.
[OG finishes. We now have the front desk manager of the Eastern Colombia Building Alejandro Romero]
Tells us there are 147 units in the ECB. Thousands of people go past his desk. Asked if he has met JD “a couple of times” he replies.
AR says he doesn’t rmeember what clothes, jewelry, make up or headgear, he never saw JD hit kick or throw punches at AH. Never seen him slam things around or be angry.
AR remember seeing AH once in a while when collecting packages. Knew Rocky and Whitney a bit.
Said AH was v friendly, she always smiled. Never had an interaction that was a close relationship.
Cannot remember her clothing or hairstyle.
Or what type of bag she carried, or what type of makeup. Or whether she was wearing concealer or blush, eyeliner or mascara or lip pencil.
Asked about when he remembers being told about the LAPD being called to a potential DV incident involving JD.
AR says it happened on a Saturday and he found out on the Monday. Someone told him she had been working out and heard a load of noise, so AR checked the video and saw JD
… on the lift CCTV pacing up and down and he did not watch any further.
[AR is shown lift CCTV and confirming JD is walking back and forth in the lift looking “agitated”]
AR says after this incident he was approached by AH for the keys to her apartment. He says in his statement he did not see any bruises or marks. EB says he was not looking...
… for marks or bruises. He was focused on doing his job. He does remember chatting with Rocky about her dog escaping her apartment. AH was about 3 feet away from him and he saw her face. He agrees he was not looking for bruises or marks, but is adamant he would have noticed them
…. if she did.
AR does not know if she was using make up to conceal a bruise, but is sure he would notice swelling
EB but you were not looking for swelling
AR is asked more questions, he gives a long answer about another resident worried about scratches on their door and ends up saying that he is fed up with answering questions about the JD/AH incident - he just wants it to be over. “I’m really sorry… I’m just so stressed out...
… because of this. I just don’t want to deal with this any more. I’m just tired. I just don’t want to deal with this court case. Everybody’s got problems. And I don’t want to deal with this no more."
[he is taken to the transcript of a previous deposition two months after the incident. in it he says much as the same as he is saying now - he did not see anything on AH’s face, but he was not looking for anything on her face]
AR agrees he was not there he didn’t see anything or hear anything was not there “probably hundreds of miles away” and therefore cannot testify that JD did not commit DV against AH.
[AR is now examined by JD’s witnesses]
[sorry - ATTORNEY, not witnesses - I’m tired too]
AR is testifying he didn’t see any bruises, swelling marks of any kind on AH’s face. He agrees the light was good. Says he was 3 or 4 feet away from her and was looking at her square in the face.
Agrees he was could not tell if she was wearing make up.
AR agrees incident was 21 May and he first saw her 25 May and that he has testified truthfully.
[right. lunch.]
Incidentally I am delighted to see @gemmapeplow and @Bethanyminelle from @skynews are also live tweeting this trial. I sat next to them in Court 38 during the 2020 Depp v NGN in London...
@gemmapeplow@Bethanyminelle@SkyNews … and of course, don’t forget the live feed of proceedings here in the US are being youtubed around the world:
I am producing a daily (whilst court is sitting) newsletter for a one-time-only donation
The more subscribers to the newsletter I get, the more transcripts I’ll be able to afford to get done.
If you are a wealthy individual, ace transcriber with cheap rates or documentary maker who wants to get the transcripts done as soon as possible after the end of the day’s...
… proceedings, DM me and we can collaborate on generating these useful documents.
Right I’m going to see if I can find my tripod. Eric from the Law and Crime network gazebo was keeping his eye on it and derigged before we came out of court yesterday.
His colleague told me he kindly took it home for safe-keeping. I am glad he didn’t abandon it.
Tripod recovered. Spent the first hour after lunch listening to Christian Carino - who has represented both Depp and Heard at the talent agency CAA.
Actually - watching Carino’s video deposition was interesting too. He was wearing a straw pork pie beach hat, had long-ish hair, greying at the temples, stubbly beard, casual black shirt and the air of the seasoned, if a little exasperated, media pro.
He explained he cut deals between talent and brands, or talent and concert venues or talent and movies studios. Remembers a conversation with Adam Waldman (one of depp’s lawyers at the time of the 2020 UK trial, who ...
… will continue to haunt this trial until his actions are properly brought into play by AH’s team).
CC remembers having a conversation with AW about the effect litigation was having on JD’s career and that AW had said something to the effect of “we’re going to get this...
… over as fast as we can.”
CC testifies that time spent in litigation is at a minimum a distraction to that person’s career, that people don’t want to know about it and (perhaps more importantly) studio execs don’t like it because “the more oxygen it takes up in the...
… overall news coverage of the individual... the less interest studios and brands take”
Says he cannot KNOW the impact individual news articles, or filing of legal actions had on JD’s career, but said in his opinion, AH’s allegations did have an impact. That before...
… the various litigations in the latter part of the last decade, JD’s personal life was a “shroud of mystery” - now it was very different.
CC confirmed that Disney was "having difficulty" using JD due to the drags on his reputation, but when questioned on the specifics as to...
… whether those difficulties were mentioned in his conversations with Jerry Bruckheimer at Disney, CC demurred. He just said they were “understood” between them and the wider industry.
He said JD was “one of the finest actors of his generation” and remained so, but his...
personal reputation had suffered, saying “My opinion is that Amber’s accusations would have the most dramatic impact on his off-screen reputation.”
Said his loss of the next Pirates movie “was related to the accusations that Amber has made”.
With regard to JD’s lateness on the set of Pirates 5, CC said “I’m aware of him being tardy but he’s been tardy for everything his entire life”. CC said it does cause “problems for everyone” but they’ve “learned how to deal with it”. He also acknowledged there was a difference..
… of opinion between Johnny and Disney execs on how Pirates 5 should have been edited.
After the afternoon break CC came back (hatless) via video deposition to be spoken to by JD’s execs.
CC confirming he met AH before JD. He took her on with a view to setting up commercial...
… deals with brands. Then describes getting to know JD, through AH and becoming friends.
CC explains that JD asked him to represent him. No longer works for JD. Stopped in the past two years. JD left CAA to follow Jack Wiggum who left CAA to start a new agency. Stopped being friends with JD when he left. Stopped being friends with AH during the legal actions.
CC says he ears no animosity towards either.
CC is asked if JD interfered with his represenation of AH. He says no and confirms he has no recollection of JD asking him to do anything to do with AH’s career.
Go to a text exchange dated 14 July 2016 between AH and JD. AH tells CC that she saw Laurel the therapist (Dr Laurel Anderson the therapist who was previously a witness in this case).
CC introduced LA to JD and AH and said he thought they needed it to try to work things...
… out. Confirms they both confided in him.
CC again says JD was not offered the Pirates 6 franchise because of the accusations by AH.
CC is reading the WaPo article by AH during his deposition at the request of JD’s attorney. Confirms he has seen it before. Does not recall reading it at the time it was published on 18 Dec 2018.
CC taken to an article published two days after the WaPo article which states that JD has been dropped from the Pirates franchise. He confirms that he thinks this is because of AH’s allegations of DV.
CC confirms he has never seen JD be abusive towards AH.
CC confirms that he brokered the meeting between JD and AH after she had got the TRO with a view to seeing if there could be any rapproachment. The concern was that JD could be accused of breaking the TRO...
… AH confirmed that she would not make any accusation of that nature.
CC is asked whether AH had a relationship with Elon Musk.
CC yes
CC says he understands they got together after AH broke up with JD and then AH and EM broke up in 2017
In one exchange of messages...
AH says she’s sad because of the break up and complains about her private life is in the media at this time.
CC says why are you sad if you didn’t love him and clarifies he means EM by this
later in the text exchange
CC tells her to stop dating famous people, clarifying in the depo to say he meant “if you don’t like being in the press about your personal life, don’t date people that are famous"
CC says he does not know if AH was dating EM at the time of the San Francisco attempted (and disastrous) reconciliation but they were definitely spending time together.
CC says he believed that AH wanted to reconcile JD and considered him a confidant “I think”
CC taken to a message to him from AH in which AH says “I have written so many notes. Can you give him one. I don’t know how or where to start. There’s no way to begin and all I have to say but I have so many. Finally I am single. Clear my heart and mind. I just want him to...
… know I loved him and that I am sorry."
CC says this is AH referring to Johhny Depp. Says AH was asking him to deliver a letter that she was writing to him.
This exchange was on 24 Aug 2017 and it is CCs understanding that AH was trying to reconcile with JD. And agrees that he was a friend of hers still at that point.
23 Sep 2017 - text from AH saying “God I miss him”
CC says this is about JD.
9 June 2018 - AH says:
“I text him happy birthday”
the move on to a document showing communications between CC and JD about the meeting in SF.
CC is asked if JD’s involvement in Hollywood Vampires was lucrative.
CC No
Attorney: Did he enjoy it?
CC Yes
[CC evidence ends. Laura Wasser starts her..
… pre-recorded evidence which ends out the day. You can watch it here:
We have two more hours of it tomorrow. I’m going to watch it and then get on the newsletter]
Good morning from the queue to get into Fairfax County Courtroom 5J. More pre-recorded deposition evidence expected today.
It is one of the coldest mornings of this three week old trial so far.
Fortified by the Fairfax County court cafeteria coffee I am diving into 5J for the start of proceedings. We have more Laura Wasser, apparently followed by another pre-recorded deposition this time from the ACLU who had the idea for and drafted AH’s 2018 WaPo piece.
Which is at the centre of this defamation case, if anyone’s losing track…
Good morning from Fairfax County Court, Virginia where Day 10 of the Depp v Heard trial is well underway. You can watch the live feed on youtube here
Or follow these tweets for an overview of what’s going on. Everything I write is a summary...
… or paraphrase of what is happening in court. Nothing is a direct quote unless it is in “direct quotes”.
Yesterday saw the conclusion of Ben King’s testimony. Today we start with our first remote live testimony from Tara Roberts [TR], estate manager on Johnny Depp’s island.
She’s managed his island for 15 years - her job is to look after the staff and day to day operations on the island, houses, fuel, food etc. She describes it as like an estate in the middle of nowhere.
Welcome to the longest queue so far outside Fairfax County Court, Virginia for the beginning of Week 3 of DeppvHeard. Johnny Depp’s cross-examination is expected to conclude today.
I am told the witness schedule for today is likely to be as follows (subject to change):
Johnny Depp
Ben King - house manager in Australia (who found the tip of JD’s finger) - in person.
Tara Roberts - island estate manager
Managed to spend the first part of today in court before diving out to do an as live for @5_News (on air now in the UK).
There was a 24 minute delay this morning before the jury filed in.
Then JD’s xe resumed - short audio clips were played in. Some were indistinct, but in...
Tomorrow will be the final day of Johnny Depp’s evidence in #DeppvHeard at Fairfax County Court, Virginia. I’ll be in court. If you want to sign up to my newsletter for the rest of the trial (for a one-off donation), this is the link:
Tomorrow is also quite a special day for another reason…
2/
… at 8pm BST tomorrow on BBC1 there will be a one-hour Panorama special on the Post Office. It’s actually quite an emotional watch. If you miss it go out in the TV schedule it will be up shortly after on the BBC iplayer here:
Good morning from Fairfax county Court. This was the queue for wristbands to Depp v Heard this morning as we approach Day 3 of Johnny Depp on the stand.
Jury has come into the court room. I’m going to sit outside for the morning session and do a bit of live tweeting. You can watch proceedings live here:
JD is being questioned by AH’s attorned Ben Rottenborn.
BR asking JD about his abusive mum and that he saw his dad punch walls when he was abused by his mum.
Biggest queue of the trial so far for Day 2 of Johnny Depp giving evidence for #DeppvHeard. #JohnnyDepptrial
As you may know my presence here is both crowdfunded AND funded by fees from a UK broadcaster who sponsored my visa. I only spent a small amount of time in court this morning before having to go out and file for 5 News and then all hell of tech problems commenced...
... we did make it to air. Which I want to show you.
Hmm.
[wonders how to add an existing tweet to a thread]
