#DelhiHighCourt issues notice in plea challenging illegal religious structures in the middle of the road in Delhi.

“How will the civilised society survive if you have such structures in the middle of the road?” Bench of Acting Chief Justice and Justice Navin Chawla observed.

ACJ: you must send out a message to the society and the encroachers. You must cut down with an iron hand.

The petition challenges the erection of structures in the middle of the road in Bhajanpura area of Delhi.

Bench has sought response from the respondent authorities on the plea.

Order: Photographs on record reveal a shocking state of affairs. We are at loss to understand, how the state can be a mute spectator and allow such structures.

Order: State should play a firm stand and come down with an iron hand to send a clear message to all encroachers that such encroachments will not be tolerated and will be removed as soon as they are sought to be placed.

Order: And penal action should also be initiated against persons behind raising such structures.
Advocate for Respondent 1 states same issue is pending before the #SupremeCourt. Let him place the same on record.

ACJ: What is the need of the MLAs (as party respondents)? We don’t need MLAs.

Order: The MLAs added as respondent nos. 6 and 7 are neither necessary nor proper parties, We direct those to be deleted.
