Michael Avenatti's lawyers are asking for a three-year prison sentence for defrauding @StormyDaniels. A 20-page sentencing memo filed tonight describes Avenatti's "early successes as Ms. Clifford’s lawyer" but acknowledges "poor judgment at multiple stages of his representation."
They do make it clear they remember the trial and haven't forgotten Judge Furman.
"Mr. Avenatti understands that some may view his remorse as too little too late, and that the Court may look skeptically on his contrition given the way in which Mr. Avenatti’s trial transpired."
The memo reveals that probation is recommending Judge Furman do a downward departure to four years, from the standard guidelines range of 65 to 75 months. Avneatti is asking Furman to depart even further.
Filed in Judge Carter's #J6 case: Eastman's opening brief regarding his privilege claims re: @January6thCmte Chapman email subpoena was due at 5 p.m., but he's asking for a few more hours because "of an unforeseen family situation that arose during final drafting and editing."
John Eastman's opening brief is in regarding his privilege claims for the remaining @ChapmanU emails in dispute under the @January6thCmte subpoenas. It's 50 pages. "One might even say that the assertion of a “big lie” is itself the actual big lie."
A bit of self reflection -> "Perhaps Dr. Eastman was wrong about that." Then he basically blames the Deep State for Trump not believing news reports that he'd lost. "...one should hardly be surprised that President Trump did not take such claims at face value..."
No one I've talked to has seen anything like this before. A federal judge in Los Angeles has recused himself from a sex trafficking case, declaring: "I lost the ability to trust the honesty of defense counsel. I cannot take anything defense counsel states at face value."
The judge is Otis D. Wright II, a 2007 Bush appointee. He’s had this case for two years, and his recusal yesterday follows his granting of a mistrial at the defense’s request. The same defense he now says he can’t trust.

There's a new federal judge in Oakland. Thompson has been an Alameda County Superior Court judge since 2003 and was the first Black woman on the bench. @lawdotcom photojournalist Diego Radzinschi was at her Senate Judiciary Committee hearing in February.
And now there's a new federal judge in the Central District. Sunshine Suzanne Sykes, currently a Riverside County Superior Court judge, is the first Native American federal judge in California. (Diego was at her committee hearing, too.)
Judge Sykes' chambers will in Riverside, and Judge Holcomb will move from Riverside to Santa Ana. Sykes' and Judge Thompson's confirmations make it 10 Biden trial court nominees confirmed in California since December as my article from last month explains. bit.ly/37PFeQF
Regarding Avenatti's trip to NYC to be sentenced for defrauding @StormyDaniels. "Mr. Avenatti started his travel from FCI Terminal Island to New York. ... the Bureau of Prison inmate locator reveals that Mr. Avenatti is located at FCI Victorville Medium II." So much for that jet?
Avenatti's standby counsel is asking for a new briefing schedule and trial date based on this, saying "this transportation to and from New York will likely last at least six weeks if he is being transported by bus each way."
Request is June 13 hearing be converted to status and new briefing, trial date be set then. "Mr. Avenatti also seeks leave to file an updated status report and request should it become apparent that defendant will not be back in California by that date." bit.ly/3PrxYLL
John Eastman #J6 update: His lawyers today asked for more time to file the revised privilege log for the remaining @ChapmanU@January6thCmte emails, saying he "believes the disputes can be further narrowed."
Most interesting part of the filing --> Eastman says @January6thCmte is suggesting the crime-fraud exception Judge Carter applied to a single email back in March could now apply to 135 of the 721 documents that remain in in dispute.
Eastman is renewing his request to take discovery from @ChapmanU regarding the attorney-client privilege issues, and he wants discovery from @January6thCmte regarding the crime-fraud issue, saying the committee is
"cherry-picking the evidence that it presents to this
Court."
