Mr Morrison is lying.

His Ministers can grant permanent visas for any reason they want.

But they won't even give QLD-born 4 year old Tharni the same temporary visa they gave her mum, dad & sister.

That's how they're stopping her family coming safely #HometoBilo

The Prime Minister repeated misinformation that “that matter is still undetermined in the courts.”

There is nothing before the courts. Mr Morrison is incorrect.

Further, the request for Tharnicaa to have her refugee claims assessed is before the Minister.
Tharnicaa's need for protection has never been assessed, because Mr Morrison’s Ministers have repeatedly refused to allow this.

Last year, the Federal Court determined that Tharnicaa was denied procedural fairness.

The PM’s claim that visas can't be granted to the family without a finding of protection is also completely false.

Under the Migration Act, the Minister has a god-like power to grant visas for almost any reason they choose. As a fmr Min. for Immigration, he should know this.
Minister Hawke has the power to intervene at any time to return the family. He simply chooses not to use it, despite the majority of Australians wanting to see this family allowed #HometToBilo.
Minister Hawke has even refused to grant four-year-old Tharni the same temporary bridging visa he granted to her mum, dad and sister.

This is the only reason that Tharni remains in community detention, preventing her family from coming safely home to Biloela.

During the 2019 election campaign, on QLD-born Kopi & Tharni's 429th day in a Melbourne detention centre, @ScottMorrisonMP told Australians: "ultimately, we've got every child out of detention."

Our Biloela girls were detained for another 669 days on his watch.

During the 3 years Kopi & Tharni were detained, MPs & Senators told Parliament & the public there were no kids in detention at least 25 times.

Today @AlexHawkeMP used Migration Act powers to grant 12-month bridging visas to 3 members of the Biloela family. However Tharni has not been provided a visa. The family remains in “community detention". 1/ Thursday 23 September 2021  BREAKING: Biloela family unable
By continuing to withhold a bridging visa from Tharni, Mr Hawke is preventing the family from coming home to the QLD town of Biloela.
Last week, the Minister made an undertaking to the Federal Circuit Court to issue 3 month bridging visas to Priya and Nades and Kopika.

We are “surprised” by the Minister’s decision to now grant 12-month visas to three of the four family members, while continuing to withhold a bridging visa for Tharni, which would allow the family to return to Biloela. 3/

STATEMENT: Biloela family Federal Court decision.
Today, the full Federal Court handed down its decision involving the Tamil family from Biloela.

In an emailed decision sent to all parties on Tuesday morning, the Federal Court has upheld Justice Moshinsky’s April 2020 decision.
Lawyers for the family will now determine whether to appeal and call upon the Australian Government to immediately release this family from detention while legal matters are ongoing.
Lawyers for the family are currently assessing whether an injunction or stay of orders will be required to protect the family from further deportation efforts.
