🔔Alarm bells over the unequal and slow enforcement of the GDPR have been ringing
⌚️People filing complaints with their data protection authorities are waiting to see their rights materialise
🇪🇺 National procedures block DPAs' cooperation
Even filing a complaint can be difficult:
A study by The Data Protection Law Scholars Network shows that people across the EU do not have an equal right to lodge a complaint: accessnow.org/gdpr-complaint…
This is a serious impediment to the GDPR’s efficacy for vindicating our rights.
So, do we need a recast of the GDPR?
NO.
The #GDPR is still fit for purpose. We call for a complementary law.
This entails political risks of re-opening past lobbying battles, but doing nothing also means risking giving up on the GDPR ever being fully and equally applied.
.@accessnow looks forward to working with DPAs, NGOs, and the EU institutions to protect and advance the GDPR’s rights and principles and work to improve the application and enforcement of the law.

Access to data protection remedies through DPAs is a core element of the enforcement of the GDPR, but how is it working in practice?
This study looks into practices of several DPAs to assess:
- how easy is it for people to file a complaint
- how DPAs are dealing with complaints
The study finds:
- fragmentation in the way complaints are handled
- national practices conflict with GDPR requirements
- lack of information for people to understand what happens with their complaints, how NGOs could help them, etc
