Just arrived at the Chambers for the Assembly meeting of 7/12. Sorry I missed the Mayor's and Chair's reports, those are always interesting. I am here for audience participation though! Looks like we're migrating from #ANCgov to #anchgov to prevent confusion with other government
Ah, my mistake, not Audience participation. We are approving the special election, which Daniel Volland won, placing him as the 12th member of the assembly. #ANCHgov
Constant says that through the work of the Fairview community, they were able to fight for equal representation with the rest of the municipality. He describes the process and time it took. He urges support. #ANCHgov
Dunbar thanks the elections staff as well as volunteers and urges support. We move to voting. Passes unanimously, the election is certified and approved. #ANCHgov
Now onto the swearing in on Daniel Volland. A man from the audience yells "transplant" as he approaches the lectern. He is given a warning by Constant. #ANCgov
Volland reads the oath of office, swearing loyalty to the US constitution, the State constitution, and the municipal charter. Some of the audience applauds, others scoff. #ANCgov
Volland takes his seat. Eric Lambertson is given a warning for shouting. Tries to debate LaFrance and is given another warning and told he needs to stop. #ANCgov
Onto the laid on the table items, which LaFrance describes quickly! First item for introduction will add funding for outreach programs for the houseless, second allots money for the purchase of the guest house. #ANCgov
Third item for introduction would submit to voters an item to the ballot pertaining to tax rates, from what I heard. Final item for introduction will require a vote, but first LaFrance notes that with a 12th member a quorum is 7 members and a majority vote is also 7. #ANCgov
Final item for introduction would recommend various properties to the risk management department? Not sure exactly what that means, but Demboski will explain. #ANCgov
Excuse me, awarding special insurance coverage for certain providers. Demboski says that this is a usual item for this year, but they missed a deadline for getting it in front of the assembly and says it's time sensitive. #ANCgov
Perez-Verdia asks what the deadline they are trying to hit? Demboski says she isn't sure, but she will check. He says it says July 30 from the item, and withdraws his question. #ANCgov
Voting on introducing this item passes unanimously. Constant moves to incorporate the addendum and laid on the table items. Seconded by Zalatel. Unanimous consent. #ANCgov
Onto appearance requests. Nial Williams approaches. He speaks to police accountability and transparency. Says it's been over a year since we voted for body cams. Says someone is dragging their feet, the chief, the union leader, or the mayor. He demands accountability. #ANCgov
He says there isn't a single officer in Anchorage making less than 90k before benefits, among the highest in the nation. Says these police would act just like the Uvalde PD, holding you back from saving your children in an emergency. He names specific officers. #ANCgov
He demands that police officers are trained in basic human rights. We need an independent civilian review board. He says body worn cameras are just the start, because the union will block attaining the video. He hits his time. #ANCgov
Bronson says that he isn't entitled to his own facts, our police are some of the greatest in the country. Zalatel issues a point of order, he isn't asking a question, he's debating. He says he can ask a question, LaFrance says no we need to move on. The audience boos. #ANCgov
We move on to public participation. LaFrance reviews the rules of the chamber, including creating a climate of respect. Noria Clark tells "nope" and is warned. #ANCgov
A first time testifier approaches the lectern. She says she has been passively watching what happens in the Chambers for years and finds it disturbing. Says people come here to disrupt and prevent work from getting done. #ANCgov
She says from this room we can see we have allowed the degradation of this chamber, our city, and our nation. Says we do not stand for harassment, threats, antisemitism, etc. We have historically found common ground to move forward with maturity, and she knows we still can.
But she says now what we see is disheartening. She says her own sister is schizophrenic and could not live in a tent in the woods. Says she received snark mail from the mayor, says she would never send a letter like that. #ANCgov
Allard has a question. Asks her if she finds it okay for elected officials to berate the community? She says she doesn't feel it is relevant. She refrains from the question because she feels like it's a set up question. Audience yells at her. #ANCgov
Dustin Sherman testifies. He is here to discuss what's goin on in the world. Are we not seeing what's happening? People are tearing down government's worldwide. Abe assassinated. Says that people are pissed around the world. We aren't there yet, but we're close. #ANCgov
He says we just had the biggest political event (trump rally) in Alaskan history. Says Biden's poll numbers are lowest he's ever seen. People are over this. He says history repeats itself and that's what we're seeing here. #ANCgov
Phone testimony from Ms. Winston. Her family have lived here for over 20 years. She's concerned with the Mayoral removal bill. Says she doesn't feel that they are getting full public participation. Says she didn't vote for him, doesn't often agree with him. But not the homeless..
.. she doesn't care about that issue. She says this AO doesn't represent the will of the people or proper separation of powers. Encourages a no vote. #ANCgov
Zalatel asks if she believes that only a recall should remove a member of the assembly? Yes. #ANCgov
Next testifier is here to discuss the reduction lifeguards and public lakes. We don't have lifeguards. The buildings are closed. Kids are undressing in the woods, that's not safe. She says she has video of a car that either has drugs or sex occurring inside. #ANCgov
She says she has seen stories of kids drowning in our lakes, specifically Goose Lake. Says these lakes are a failure of Bronson, and the things that occur there are on his hands. She emphasizes, nothing that is happening at these lakes is safe. #ANCgov
Allard asks when these incidents at the lakes happened? During the Fink administration. Bronson requests to speak. LaFrance asks if he has a question. Yes. He passes to Demboski. She asks if the testifier has emailed Demboski directly? No. #ANCgov
Demboski says that the reason there are less lifeguards is they got less applicants. Testifier asks her if she wants to see the pictures. Demboski says she doesn't want to see pictures of children undressing. Audience starts yelling. #ANCgov
Onto the consent agenda. Items are pulled from the agenda by the body. Constant motions to pass the rest of the agenda. Petersen seconds. No opposition, so the consent agenda has passed. #ANCgov
Onto the pulled items. We start with a resolution recognizing Edward B Rasmuson. Motion to approve by Zalatel, second by Constant. Sulte asks to be added to it. Bronson is asked if he wants to be added, he says he'll pass to Demboski. She says yes.

Rasmuson's family approaches the lectern to accept. He was the Chairman of the Rasmuson foundation, initiated efforts to develop parks and trails, expand the museum, and end homelessness. The foundation invested in the early ANSEP program... #ANCgov
...as well as helping to create Pick.Click.Give. he participated in community service through an incredible list of groups and orgs. His family is here to accept. His wife(?) speaks. Speaks to the great respect he had for people who sought elected positions. #ANCgov

Next item, a memorandum that creates an amendment to a Spernak & Son contract for project management and engineering projects for $1mil. Constant says there may be an S version? Demboski says they can just do it as a floor amendment. Bronson reads the amendment. #ANCgov
Zalatel seconds the amendment. Perez-Verdia asks for a rationale. Demboski passes to Michelle Algiers. She says original AM for this contract was put in incorrectly in 2019, with this amendment it corrects that error. Discussion ends. Bronson's amendment passes 12-0. #ANCgov

Onto an AM contracting Guess & Rudd P.C. Professional Legal Services in relation to litigation for the Mayor's Office. Mario Bird speaks to it, says that litigation has run longer than they expected, and they need an extension to finish up. #ANCgov
Zalatel says that she pulled this because she's curious if this is the appropriate way to do this. Would a reappropriation to a department of law be more appropriate? Demboski says that was her intention, but the department of law is over budget. #ANCgov
Zalatel says she understands, why doesn't this just reappropriate money to the department of law for it? Demboski says that the Treasury says they could just fund it, but it could be done. Zalatel asks if this could be delayed by a week to rework it? No, it's time sensitive.
Constant says he's fine paying this firm, however he feels there's been a shortsight in the procurement process. In code any amount of money above $30k being awarded must be approved by assembly. Originally they asked for $50k but handnotes it down to $30k. Now it's more. #ANCgov
Demboski says that the $30k was the original amount, it was never intended to get into a legal contract for more than $30k. Constant says look we gotta pay em, but the original quote was $50k and $30k was from a handwritten note. He says an amendment could conclude this. #ANCgov
We drop this AM for now, as it will need to be worked out. Will be addressed again later. Now, an information memorandum on the Sole Source Procurement Report for the month of May 2022. Zalatel moves to approve, Petersen seconds. #ANCgov

Okay we are back! Unfinished action on public hearing items. First up is the contentious alcohol permit for LED Ultra Lounge at their 3rd Ave location. We open discussion. Constant moves to postpone indefinitely, Volland seconds. #ANCgov
Constant explains, they had previously protested this license because of proximity to a school, debt issues, and other reasons. He asks a subject expert up to speak to it. #ANCgov
Said expert says that of the two issues that were within Muni view, the first was to get Community Council objections addressed, and the applicant has done nothing to address their concerns. The second issue is the proximity to a school in the Sunshine Mall. #ANCgov
Dunbar asks, in regards to the distance, why was the weight of the state's law placed onto the assembly? Shouldn't the state law be applied regardless? The state apparently turned down the license due to the school districts objection, through the assembly. #ANCgov
Dunbar asks why they would have to determine if it's okay, when regardless the 200ft state law would violate it? Basically, if they lift the protest, the state can reconsider to see if the buildings entrance is now further than 200ft. #ANCgov
Sulte asks if the 200ft rule is a walking distance, a radius, a property line? It is from the property line to the entrance of the liquor licensee. Would it need to be walking distance? It is walking distance. All of the doors facing that parking lot are within 200ft. #ANCgov
He says there is no lawful way for a liquor license to be given with the doors to the business where they are at. There's also an argument that could be made that the parking lot constitutes school grounds, as the school utilizes dumpsters on it. Which would increase the radius.
Zalatel asks the expert, Halloran, about this note that says the administration encourages the approval. Was he involved in that suggestion? He was not. She asks, is the alcohol permit a condition precedent for the special land use permit? He says either guideline prevents use.
Zalatel asks project manager McGloughlin the same question. He says they need both the license and special land use permit or it would be illegal for them to operate. Zalatel says that if they approve this, they still couldn't operate until the permit was issued? Yes. #ANCgov
Cross says that he believes the Beans Cafe was discussing this address as well, potentially for a prep kitchen. Are there multiple negotiations being made for this site? Could potentially a food bank be next to a bar? Constant says he's thinking of an issue already resolved.
Rivera asks Constant, with the admin encouraging passing this, why should we indefinitely postpone it? Constant says that there are two things: the school, it can't be avoided; and second, this issue has been granted lots of lenience, and negotiations have been very tough.#ANCgov
He says this operation is within earshot of sixty homes downtown. It's a residential use area. Protections exist for residential areas. He asks the body to imagine their bedroom window, would it be acceptable to have a nightclub open up within 150ft of that window? #ANCgov
Dunbar asks if that 200ft radius only applies to nightclubs, or does it apply to bars/liquor stores/etc? Halloran says it applies to any dispensary/package store/etc that opens after the school licensed for the property. Dunbar says, so the other businesses are grandfathered in.
Dunbar asks Mr. Alexander, the applicant, what is your proposed solution to the state concerning the 200ft radius with the school? He says they can close off the violating door and open another door 7 ft further away, potentially addressing the issue. #ANCgov
Zalatel asks if they postpone this indefinitely, should the conditions be met, could a member bring this item back? Clerk Jones says that she believes there is a provision that would allow it to be brought back as long as it hasn't been more than a year. #ANCgov
Zalatel says that she will support postponement, since there's a mechanism to bring it back. Constant brings up that in Alexander's document, he says this location has been a nightclub since the nineties... Hasn't this been a non-profit for the last 8 years? #ANCgov
Alexander says that the space has been used to hold parties in there that have used license, due to a certificate. Constant says it hasn't been operating as a nightclub. Alexander says the certificate hasn't expired. Constant says that's not relevant, it hasn't operated as such.

Next, we have an ordinance that would amend Muni code relating to the CFO's certification of funds, which would allow the assembly to make informed decisions when deciding a budget. There is an S-version. Zalatel moves to approve the S-version, Constant seconds. #ANCgov
Zalatel says she's worked with the cosponsors as well as Falsey on this. Says that this addresses issues that came up in the first quarter budget revisions. This clarifies the meaning of certification and codifies the process in a way that allows for informed action. #ANCgov
No further discussion, voting commences. It passes 10-2, with Allard and Sulte dissenting. #ANCgov
Next we have the very contentious AO-60, that would establish a set of procedures for removal of an elected official for breach of public trust. Constant moves to approve the S-version, seconded by Zalatel. He then moves amendment #1, seconded by Zalatel. #ANCgov
LaFrance explains Amndmnt 1, saying that it addresses an issue brought up by the public. Explains a recall does not fulfill the obligation laid out in charter for there to be established a process for removal of public officials. This amendment inserts language reference charter.
Basically, it adds some "whereas" statements to the AO that explain the sections of charter that justify this, and explaining that removal and recall are considered separate processes in the Charter. #ANCgov
Allard takes moment to complain about not being allowed to talk before Constant, then motions to reopen public testimony. Bronson seconds. The audience yells "Yes!" Constant calls the question, but then removes his motion. LaFrance says two main motions can't be on the floor...
...so reopening testimony isn't a valid motion at this time. We move onto voting on amendment 1. Passes 9-3, Allard, Sulte, and Cross dissent. We're back to the main motion. Allard snipes at LaFrance in a petty fashion. Motions to reopen public testimony, Bronson seconds. #ANCgov
Constant issues a point of order, noting that an audience member is shouting. He is warned. Allard explains that with a new member of the body, they should reopen public testimony so Volland can hear the public speak. #ANCgov
Cross supports reopening public testimony due to the gravity of the ordinance, but also due to Volland's presence and the new amendments. Bronson says Dick Traini is here and wants to speak. The audience applauds. A man is warned about shouting. #ANCgov
LaFrance says it is not time for public testimony. Asks Dustin Darden to step away from the aisle as it is not public testimony. Sulte says he supports reopening public testimony. Audience applauds. Zalatel doesn't support it, there has been plenty of time for participation.
We move to voting on reopening public testimony, which fails 3-9, Allard, Sulte, and Cross support. The audience begins booing, shouting, clapping, laughing, etc. LaFrance issues mass warnings, says this is disrespectful to the democratic process. This spurs more shouting.#ANCgov
LaFrance gavels and says the next person to shout is getting removed. Constant moves amendment #2. LaFrance explains this amendment addresses another public testimony question. Adds a "whereas" that explains precedence in other bodies of government. #ANCgov
It includes Congress impeaching a president, AK state leg impeaching a governor, a similar legislature in Nebraska, and more. #ANCgov
Sulte opposes this, saying that in those places the process is difficult and there's a separation of powers. In this case, it is easier and allows the assembly to put their own person into office. He says it sets a dangerous precedent. #ANCgov
Allard asks the Muni Attorney, Mario Bird, to speak on it. He says he sees it as providing context, but not being of legal consequence, so it doesn't have importance. References the closest case of governor impeachment and how difficult it was. #ANCgov
Cross reiterates Sulte's point, and says further it gives the assembly power to remove more offices? Constant issues a point of order, says he believes Cross is testifying to the wrong amendment. Cross says it's possible, he has multiple tabs open and holds his comments. #ANCgov
Volland speaks to the amendment. Says that it gives historical precedent. Says much has been made of separation of powers. He says that checks and balances are necessary components of separation of powers. Gives us a history lesson on the history of impeachments. #ANCgov
He quotes founding fathers on their view of impeachment and says that it's clear they believed this is an important part of government. Says that the municipal charter expressly directs the assembly to codify such a process. #ANCgov
Cross issues a point of order, says Volland isn't speaking to the amendment. Volland says the amendment speaks to historical context and he's expanding on that. He finishes by saying this AO brings to the local level the precedented system of checks and balances. #ANCgov
Discussion ends, voting on amendment 2 begins. Passes 9-3, Allard, Sulte, and Cross dissent. Constant moves Amendment 3, which he says addresses a concern by Girdwood residents that the language is too broad. It changes "municipality" to "service area". #ANCgov
Allard asks Bird to explain this language to her in laymen's terms. He says it's new to him, but it seems to make it so that you can't be prosecuted for accepting cash gifts except from your own service area. #ANCgov
Allard asks Constant to explain. He says the original would make it so that members of a supervisory board couldn't do business with the municipality, which isn't fair. This apples appropriate levels of restriction based on responsibility of the elected position. #ANCgov
Gates further explains, for members of a smaller supervisory board, who have limited responsibilities, that don't include usage of municipal funds, this allows them to continue to participate in business with the rest of the Muni. Allard says that solidifies her no vote. #ANCgov
Quinn-Davidson asks how this differs from receiving gifts in general, which is already covered by the rest of the AO. Constant asks Gates to explain. He gives the example of small service boards only considered with snow removal, it would restrict them from receiving... #ANCgov
Cash gifts from someone that they might employ for snow removal, but not restrict them from receiving a cash gift from a friend on the other side of the municipality. Constant reiterates that the original text was just overbroad. #ANCgov
Quinn-Davidson says she now understands that it doesn't change anything for assembly members or the mayor, but just for service board members. Constant says that's correct. Gates says that this fits better in line with our ethics code, limiting cash gifts only in relevant areas.
Sulte says he likes the broader term. He likens it to college athletes, who can't receive cash gifts from coaches, etc. Says if your an elected official, you do not accept cash gifts, hands down. Audience applauds. #ANCgov
Discussion ends, voting commences. Passes 9-3, Volland, Allard, and Sulte dissent. Zalatel moves amendment 4, which changes language from "proof by a preponderance of the" to "clear and convincing" before the word "evidence". #ANCgov
Allard asks Bird to explain why this is better. Bird says that the weight of willful and knowing action is now being front loaded, still present and not removed. Allard asks what the legal difference is between proof by a preponderance of and clear and convincing? #ANCgov
Bird says this actually increases the necessary level of evidence, making a higher bar to clear to remove an official. It's a "higher evidenciaey burden."

She says this brings this in line with other processes involving a hearing officer and really makes clear why they might choose to reject a hearing officer's recommendation. No further discussion, voting commences. Passes 9-3, Allard, Sulte, and Cross dissent. #ANCgov
Dunbar says he had an amendment, but wasn't able to get it printed in time to be part of the packet. Says it's a simple one, but asks Gates if it got printed? It did not. Dunbar moves an amendment to strike "official oppression" from specific offenses. Constant seconds... #ANCgov
But says with the caveat that it says "and renumber". Dunbar agrees. He then explains, the rest of the offenses are clear and understood. Official oppression on the other hand, is not defined in code, and even he isn't sure what it means. Says to use this AO would... #ANCgov
Need concrete evidence should they invoke it, and "official oppression" is not well understood. Sulte says that he isn't necessarily opposed to this amendment, but he's opposed to defining "breach of public trust" which he things goes against legal standard. #ANCgov
Constant says that the Charter says to establish a process, and historically they have had to define it for the other positions. Volland says what he has heard from the public is that they want specific definitions. #ANCgov
Dunbar says it limits the ways in which this AO can be invoked. He recounts a legal situation he had once that included the term "dueling" which has an antiquated legal definition. #ANCgov
Sulte says that he moves that we wait until we have a hard copy. Dunbar asks Gates if we have one. LaFrance says that it is written on the screen. Discussion ends, voting commences. Passes unanimously. #ANCgov
Zalatel says that she believes this isn't directed at one particular individual. Audience busts into raucous laughter. A pause. Zalatel continues that laws should not be made to target a specific person. There's more outbursts. Zalatel says the level is discourse is disappointing

We're back! Next up, the AO that would amend AMC to include a new offense. This is the criminal offense for open burning during a fire ban. Zalatel moves to postpone indefinitely. She explains that it has issues in the language that make it problematic beyond fixing now. #ANCgov
She says that the emergency ordinance did something this doesn't: declare an emergency. It makes it very serious and timely, which codifying it doesn't. She says we should stick with the current model. #ANCgov
Constant speaks against postponing indefinitely, says he thinks we can fix the issues. We need to give the AFD and Parks Dept the tools they need to squash fires where necessary. #ANCgov
Rivera says he supports indefinitely postponing. He doesn't think there's a way to stop this from being utilized in a discriminatory manner. He also doesn't like the justification of climate change, saying "we can't criminalize climate." #ANCgov
Dunbar brings up Sarah Stanley, Municipal prosecutor. He asks her who is being charged and are they being charged under the first or second provision (first, starting the fire; second, not reporting a fire). #ANCgov
Stanley says that since May 26, 16 people have been charged in a combo between the new rules and old. Of those 16, 11 of them have been in a homeless camp. Dunbar asks how many have taken a public vs private defender? We don't have that data yet. #ANCgov
He asks her if we can anticipate any equal protections issues? She can't speak to what a lawyer might bring. In terms of enforcement, she says police respond to calls about fire, and that's, from her standpoint, equally applied. Says we all have interest in fair usage. #ANCgov
Dunbar asks if we have any other of these mandatory reporting laws, beyond the state level ones? Do we have any laws that could prosecute someone for not reporting to emergency services? She says not that we know of, but she'll go check. #ANCgov
Cross says he had the same concerns during the worksession. He says that the intention, however, is not to prosecute people who are just passing by, but rather to be able to prosecute if people are enjoying a fire but won't take direct responsibility. #ANCgov
He says police aren't looking to just write up anyone. He says he trusts that our law enforcement will only enforce it in circumstances that are reasonable and fair. #ANCgov
Allard says we have other crimes that we do report. Asks Sarah can we be prosecuted for not reporting a murder or sexual assault? She can't think of any. Voting on indefinite postponement commences, passes 7-5. Allard, Sulte, Cross, LaFrance, and Constant dissent. #ANCgov

A Mr. Russell from downtown testifies. He says he's watched as the guest house and the lofts we're appropriated as shelters, and their livelihoods were taken from them. He is upset about seeing and dealing with the homeless. He laments that deliberation doesn't have public input.
He says the downtown community council is never considered during these plans. Says people are mad. Says the assembly filibusters the public by... Amending and discussing the legislation? Says they aren't given time to speak... During his time to speak? Hm #ANCgov
Yarrow Silvers testifies. She says as we're addressing the appropriation of funds for sheltering, let's consider how the admin has treated the issue so far. She speaks to the Centennial Campground. Says we don't trust the admin. #ANCgov
Bronson point of orders, says she isn't speaking to the issue. LaFrance asks her to speak to the issue. Silvers points out that the shelter is tied to the rest of the Homelessness response. Allard point of orders, same issue. Silvers continues.Allard point of orders again.#ANCgov
Allard argues with LaFrance's ruling. She's deemed out of order. She starts yelling at LaFrance. LaFrance warns her she's going to cut her mic, and then does. Allard yells at Silvers "you're a leftist!". #ANCgov
Yarrow continues. Mayor Bronson point of orders and starts saying she's just straight up wrong, LaFrance says she won't recognize it. So much yelling. Silvers says that they sure don't want her to speak for people who believe in Free Speech. The Chambers goes nuts. #ANCgov
At this point LaFrance does tell Silvers that she's no longer speaking to the issue.

I have basically missed the next guy's testimony, but he tells the assembly that they "act like a bunch of women".

Dunbar asks him, this item to spend $2.8mil was put forward by the mayor for approval, does he suggest they vote against the mayor? He seems befuddled before saying "no." #ANCgov
Okay testimony is over, Constant proposes an amendment that deletes the involvement of the chief fiscal officer. Cross says something seemingly unrelated and says he'll come back to it later. #ANCgov
Voting on the amendment commences and passes unanimously. Next is the main motion, Cross returns to ask why moving the S version. Cross says that still there is a still an emergency declaration of Covid, meaning FEMA will pay back 90% of the funds and the State will 10% match
So essentially there is 100% funding from outside. He explains more the relationship between these funds and FEMA reimbursement. Cross seems satisfied. Allard wants Gerace to explain, says she's never heard of 100% reimbursement and doesn't think we're still in emergency #ANCgov
Gerace says that the declaration provides sheltering for covid. The question is are they being sheltered for covid? He says it muddies the waters, but it may be possible. He says we wouldn't try to get reimbursed, we'd just swallow it. #ANCgov
Constant says that he thought we'd upped our reimbursement game, and he wants to know what the status is? Gerace says we haven't been well reimbursed for many congregate shelters. He believes we're $80mil not reimbursed. #ANCgov
Demboski says we are aggressively going for FEMA reimbursement, says now that the Sullivan is closed down this is no longer for covid. She says there's a risk that if we try to get FEMA reimbursement, it may not work out. #ANCgov
Constant says he wouldn't characterize his argument as attempting to get reimbursement for unrelated issues, but says it's fair to disagree. Dunbar says that this was part of our covid response because other shelters had to drop the beds available and those policies stand.#ANCgov
He asks, what's the harm in trying when we know the number of beds are reduced elsewhere? Gerace says he doesn't think the dollars will be there, but second FEMA is auditing based on length of stays. Says brother Francis is decompressed not due to CDC but due to staffing. #ANCgov
He says, if audited, he is worried we wouldn't be able to get that reimbursement. Dunbar says that 85 beds at Brother Francis is drastic reduction from pre-Covid. Also, many kinds of beds at the sockeye are a different nature than the ones we're discussing her, right? #ANCgov
Yes, Gerace says, those are for medically fragile people. Dunbar also says that reduced staffing is a covid impact. Audience seems to audibly roll their eyes? That's the best way to describe that noise. #ANCgov
Bronson says that this money will come down to taxes eventually, and will be burdening property owners. "I just wanted to say that to the public". Applause and... An air horn? #ANCgov
Constant says that the alcohol tax money is also the people's money and we have to be just as careful with that as other funding streams. #ANCgov
Perez-Verdia asks why, if this is intended to be used for the Aviator, is this more vague? It just says "sheltering costs." Why not be specific? Gerace says we historically try not to name them, for concern of there being a negative impact. #ANCgov
Constant says that when this was brought in June it was clear the contractor would shoulder the burden. He thanks the public for stepping up when the timelines fail. We move to voting. Passes 9-2, Sulte and Cross oppose. #ANCgov
Onto the quasi-judicial items. Starting with a alcohol special land use permit for Hive Mind Meadery. Public testimony opens. Darden approaches. Reminds us he's running for office. Says that he finds it important that when you have a job, you show up and perform. #ANCgov

He doesn't feel like people are considering what downtown wants. He thinks there's back scratching going on. Says hotels get special treatment. Says that various projects downtown actually take away from locals, such as Visit Anchorage. #ANCgov
Susan Brenner testifies. She also doesn't get why we're giving them money for the homeless and now we are considering giving them a liquor license? She tells them not to approve until they are done with homeless. "Make them finish their apples before giving them their oranges."
Dustin Darden loosely rambles around the issue by talking about how not everywhere else approves liquor licenses. Take the bull and make it not such a bull, bulls are male. It's like Palin was talking about. Take it right down the center. #ANCgov
Terry Drake testifies against it. Says until they finish their building, are done with their tax breaks, and have spent their grants. Don't give them this until they finish what they've started. Says it looks bad. The timing is all off. Wait til he's done, approve it then.#ANCgov

Allard says she gets why the public is opposed to it, but she's going to vote yes because it is legal. Peggy says "...ok". LaFrance asks if she has a question? No. Okay this time is for clarifying questions. Public testimony ends. #ANCgov
Constant says that he has asked Mr. Fisher to be on the phone for this, gives him a call. Asks him if his goal with this license is to serve alcohol to the homeless? Fisher says they are serving the homeless now, but are working towards a renovation that includea it. #ANCgov
It being the brewpub, to clarify. He says they have no plan at all to serve alcohol to the homeless, and would be willing to put that in any writing necessary. Volland asks if they serve any alcohol now? No, just soda and other small nonalcoholic drinks. #ANCgov
Volland then says he doesn't love the optics of approving the license while they are still serving the homeless. Says he wants it in writing. #ANCgov
Gates says that he believes the packet addresses Volland's concern. Reads a section that he believes would elucidate. #ANCgov
Rivera asks Fisher to describe the timeline for development and usage. Fisher says they are getting close to the end of using the building for the homeless. It was supposed to end in June, they agreed to continue until September. But by September/October they plan to be done.
Then they work on the development. They want to be functional by Summer 2023, and they need to be quick about development to achieve that. Sees there being a sizeable gap between the time that homeless would be there and they would be functional. #ANCgov
He says that in order to even do the renovations, they can't be housing anyone, so they couldn't do it if they tried. Rivera says that satisfies his concerns and hopefully the public. #ANCgov
Allard asks Gerace how they'd handle there being alcohol on site? Gerace says that there will be no alcohol onsite. He says Fisher is excellent as a contractor and very responsive. He says the contract they've signed allows them to manage such an issue. #ANCgov
Volland asks if this is something we could delay to September? LaFrance says he can make that motion. He motions to delay until first meeting in September. Dunbar seconds for purpose of discussion. Volland says he appreciates Gerace's comments... #ANCgov
...but wants the concerns of the public addressed. Constant says he won't support postponing, says downtown community council has been engaged and did not have an issue. Says timelines can be rough, let's get beaurocracy out of the way. #ANCgov

Volland says he feels there is a better vehicle perhaps, so he withdraws his motion. Constant moves to amend a section that says that operation shall not commence while still operating as a shelter. Rivera seconds. #ANCgov
Volland says he'll support it and believes that it should address such concerns as expressed. Rivera asks Fisher if he's cool with it? Yep. #ANCgov
Voting on amendment commences. Passes. Voting on main motion commences, passes unanimously. Next, a resolution approving a special land use permit for Brown Jug in the Huffman Commons. But Zalatel moves to take up 15E immediately. Seconded by Constant. No opposition. #ANCgov
So we move to a resolution approving a retail sale and brewery license for Cynosure Brewing at 144 East Potter Drive, Unit E. Public testimony opens. Dustin Darden starts talking about Covid for some reason. Dunbar point of orders, says irrelevant. LaFrance agrees. #ANCgov
Dustin tries to talk more about Covid. LaFrance says he has been warned multiple times and ends his testimony. He mutters about his rights, but actually leaves the lectern and returns to his seat. He seems less energetic these days. #ANCgov
Testimony closes. Constant says that we're working with the state about expansion of businesses, but in the meanwhile he thanks AMCO for helping make this one possible. Discussion ends. Voting commences. Passes unanimously. #ANCgov
Next, an item approving a Brown Jug permit at 1160 Huffman Park Dr, Unit B. Public testimony opens. We start with the phone list. Ms Fisk testifies, she's the VP of Brown Jug. She says she has met with the appropriate community councils to address their concerns. #ANCgov
She says, as far as increased traffic goes, this is off a minor arterial road, which can accommodate 10-20k daily trips. They expect this to account for around $8k. Says Brown Jug accounts for less traffic than other businesses. #ANCgov
Further, another liquor license has removed from the area, keeping the amount of licenses the same. Also, wine house saying they would be put out of business is not a reasonable complaint to deny a business. #ANCgov
LaFrance notes the time. Volland moves to extend the meeting to 11:30, Petersen seconds. Not everyone is okay with it. Zalatel asks if we passed all must pass items? Demboski says yes, but LaFrance says we still have some conditional protests. Voting commences. Passes 9-3.#ANCgov
President of the Ocean View community council testifies. She says the community council opposes this development. She says this location is within one block radius of four established liquor stores. #ANCgov
In addition, it is within 1 mile of 3 more liquor stores. It will be located next to a dispensary, a Starbucks, and the Sonic. Brings lots of traffic. Community Council voted against this 15-1 with 2 abstentions. #ANCgov
The council has concerns about this small business oriented area and the effect of high traffic businesses. She cites a study about alcohol in Alaska, that stated 1 package store per 3k people. The surrounding area has around 5k people. #ANCgov
Constant thanks her for waiting all night long and for her decorum. Sulte asks her about the previous testifier's statements about lack of increased traffic. She says that Sonic blocked both lanes of westward traffic. Adding more, where will they drive? Park? #ANCgov
Nicole T testifies over the phone. She does not believe this is necessary, considering the proximity to other liquor licenses. She would prefer a bookstore, a cafe, or somewhere with a stage for people to gather. Perhaps apartments. #ANCgov
She notes that the Anchorage development plan cites Huffman as a town center, and she doesn't think a Brown Jug contributes to that. She suggest reenvisioning this as a mixed residential and business zone. Notes the lack of affordable housing. Brings up centennial. #ANCgov
Dustin Darden testifies. He has been to Huffman many times. He sees the denigration of the area due to alcohol and drugs. It will make people more fearful to live there. Accuses them of taking kickbacks from the alcohol industry. #ANCgov
He says that Carr's Huffman will smell like urine if they allow this. He proposes a few insane amendments. #ANCgov
Talmud Chang, owner of Anchorage Winehouse, testifies. He says he asks them before to not approve Brown Jug's license on west dimond, and later it forced his business's closure. Now he's afraid it will happen again. #ANCgov
He says approving this sets a new standard. Next testifier is Diane Holmes, on behalf of the Rabbit Creek Community Council. They also oppose this proposal. She has a map that is key to her statement. Huffman is their closest shopping center and... #ANCgov
...their bylaws allow them to speak on alcohol permits. She says they asked assembly to consider the density of package stores and the relationship between density and consumption. A member of their council found a study that showed with more permissive licensing... #ANCgov
...there's an increase in consumption. Which means injury, crime, traffic accidents, etc. She says Brown Jug did not come to Rabbit Creek Community Council. Mr. Chang did, by the way. Must consider the relationship between density and risk. #ANCgov
Zalatel asks what kind of density they would support? She says they have plenty. Zalatel asks if they discussed it? No, but what's there is there and they're living with it. Sulte asks if they have recommendations on the proximity of liquor stores? #ANCgov
She says they can answer that, because they all see the same issues in their districts. Perez-Verdia lets her know that they do have her letter. #ANCgov
Oh wait THIS is the president of Ocean View community council. The other speaker was VP. She speaks to the question of density. 1:3000. She thinks there should be 2 in their area as a result, but they have 7. Would like the see the number brought down. #ANCgov
Russ Reno (I think I was calling him something different before) testifies. He says this is an example of them not knowing the laws, much like they just did with the Aviator. (Is the density thing a law? It a suggested guideline?) #ANCgov
Joan Wilson, AMCO director. She says she doesn't know where this idea of 1:3000 comes from. It's not related to a community council. She has her own opinion as a south Anchorage resident, but doesn't want to state it. #ANCgov

Constant moves to take up the must pass items. No opposition. First, a resolution stating conditional protest of license transfer of Brown Jug at Huffman. Darden testifies. Says their problem isn't his emergency. He says we need a thorough review. #ANCgov
