Joe Nathan James, due to be executed by the state of Alabama on Thursday, has asked #SCOTUS for a stay of execution in a brief, pro se filing at the court after lower courts had denied his requests. The SCOTUS docket # is 22A74.
Breaking: #SCOTUS will not stop Alabama's planned execution of Joe Nathan James tonight. There were no noted dissents.
To put this back in the thread, there is an unexplained delay in (at least) the media witnesses returning from tonight’s scheduled execution of Joe Nathan James in Alabama. This is a non-witness reporter on site:
The repeated inability of states to properly carry out executions is completely ignored by #SCOTUS in its allowing of state-sanctioned killings to continue.
It’s now past 10p ET/9p CT, and no word out of Alabama regarding the scheduled execution of Joe Nathan James. The media witnesses have been gone for more than 2.5 hours.
Well, I look forward to the post-execution review of Alabama DOC’s protocol.
The likely path: We’ll get nothing from the DOC tonight, something that only tells us part of the story from the media witnesses (through no fault of their own), and then information will trickle out in the days (or weeks) that follow until a the governor calls for a review.
Yeah, I had to go check out the district court opinion, and my god it's bad. Judge Michael Truncale, a Trump appointee, found there was no seizure under the 4th Am and that the actions didn't "shocks the conscience" under the 14th Am. scribd.com/document/58459…
Truncale was confirmed 49-46, and Romney voted against him b/c Truncale called Obama an "un-American imposter" in 2011. politico.com/story/2019/05/…
Maybe each night I'll highlight a ridiculous fundraising email I get? WTF is this?
So, what is Democratic Strategy Institute? Well, per OpenSecrets, in 2019-20, more than 99% of their expenditures were for fundraising, including $4.2M on "fundraising consulting." opensecrets.org/political-acti…
The 11th Circuit really is going back to its roots (the 5th Circuit), isn't it?
Days later, I cannot get over that this is from a federal appellate decision — the court's opinion, not even a concurrence or dissent! — and not a bad blog post.
This is from Ed Carnes — a senior judge on the 11th Circuit who was born in 1950 an appointed to the appeals court by George H. W. Bush. media.ca11.uscourts.gov/opinions/pub/f…

And I write about how that instability is continuing even in rulings this summer: “[T]his was a case where, if Chief Justice John Roberts had also joined the Democratic appointees, it would have made a difference. He did not do so.” chrisgeidner.substack.com/p/this-is-what…
BREAKING: #SCOTUS rejects Biden administration's request to allow it to enforce DHS's immigration priorities guidance during ongoing litigation from Texas on a 5-4 vote. Justices Sotomayor, Kagan, Barrett, and Jackson opposed the decision.
A trial court order vacating the guidance is allowed to stay in effect during the litigation, which SCOTUS will now be hearing in December — meaning the guidance will be on hold at least through the rest of this year.
Keeping myself centered can be difficult at times. It means constantly caring for my sobriety and my mental, spiritual, physical, and social health. It also, almost always, means asking others for help. … When I do those things, though, I’m always so grateful for the results.
I say that tonight because I am feeling really good — and like I have been doing those things to help keep me centered. I looked in the mirror today at the gym, and I liked who I saw. Things are still tough all over at times, but I’m putting in the work — and liking the results.
That’s a remarkable happening, in my book, for a gay, bipolar, addict in recovery at 44! There are so many worse possibilities for where I could be today. It truly is a miracle — in spite of society, in spite of my body, and in spite of my mind — that I am here and happy today.
