JUST IN: QC police arrest ex-VP candidate Walden Bello in his house in Quezon City at around 4 this afternoon, according to his staff Leomar Doctolero. This is in connection with the cyber libel case filed by former Davao City info officer Jefry Tupas.
Tupas filed the cyber libel case against Bello in March this year after the then-VP candidate accused Tupas of being a drug dealer and of being involved in a drug raid in a TV interview.
Tupas denied both allegations.

Leomar Doctolero, Walden's staff:
We have been anticipating the arrest warrant because of the indictment of the Davao Prosecutor. It's a bailable offense and counsel is on the way to assist him.
Doctolero on Walden Bello's arrest:
The resolution for his indictment was released last June 9. We filed for a Motion for Reconsideration with the Prosecutors' Office which was subsequently denied.

There were claims by some of those arrested that Tupas was allowed to leave during drug raid.

He asked the Davao City Prosecutor's Office to junk the cyber libel case against him but it decided to file the case in court instead.

UPDATE: Walden Bello's staff says he will be "transferred to Camp Karingal per the instruction of the District Director of QCPD, where he will be booked. They're currently waiting for his transfer papers."

Bello is waiting to be transferred to Camp Karingal.

UPDATE: Bello wasn’t able to post bail tonight, accdg to his and Ka Leody’s team. He will instead stay at Camp Karingal.

Justice Dept issues new rule on appeals in cases decided by prosecutors under the National Prosecution Service, which “streamlines” appeal process and creates the Prosecution Integrity Board to assess conduct of probe and appeals by prosecutors and Prosecutor General.
Under new DOJ rule, appeal for cases cognizable by metropolitan/municipal trial courts stops at reg’l state prosecs for regions) and Prosec General (for NCR). No appeals to SOJ but SOJ may step in in interest of justice, afford fair play and prevent miscarriage of justice.
DOJ’s Mico Clavano: The issuance of the Rules is the first step…to put sense and order to the appeals process and give life to the 60 day period provided in the current rules. This, in turn, will give meaning to the 60 day suspension of arraignment.

DOJ: An independent director is not an officer based on the nature, duties, functions and responsibilities vis-a-vis the corporation he serves. It is sui generis in character.

JUST IN: A Quezon City court has denied Bulatlat’s plea for TRO against the NTC order blocking websites after the court was able to access the website on its computer, according to lawyers of Bulatlat and ex-NSA Hermogenes Esperon, Jr.
Bulatlat’s managing editor Ronalyn Olea shows Bulatlat.com is still inaccessible on her phone.

JUST IN: Prosecutor General Benedicto Malcontento says Mandaluyong prosecutors have filed yesterday a request to issue an Immigration Lookout Bulletin Order vs owner of the SUV that ran over a security guard in Mandaluyong. Justice Secretary Menardo Guevarra to decide.
It is the DOJ that issues an immigration lookout bulletin order (ILBO) which requires immigration officials to inform the Justice Secretary if the subject of an ILBO intends to leave the country through international airports and seaports.
Only courts can stop a person from leaving the country. A hold departure order (HDO) may be issued if a case is already pending in court while a precautionary hold departure order (PHDO) may be requested if a complaint is undergoing preliminary investigation with prosecutors.

A Davao court has junked, due to lack of evidence, 2 counts of child abuse charges vs 6 administrators of the United Church of Christ in PH Haran Center in Davao City over the death of 2 Lumad children.

Davao City RTC Br. 12 granted accused’s demurrer to evidence.
The UCCP Haran Center has been providing shelter to Lumads.

Court says prosecution failed to show center admins were responsible for the conditions that led to the deaths as there were even attempts to provide medical attention and there’s no evidence of ill motive.
To sustain a charge for child abuse, court says there must be “specific intent to debase, degrade or demean the intrinsic worth and dignity of a child as a human being.” Says this was “absent on the part of all the accused.”
