Bench goes through the charge memo.

#SupremeCourt
Justice Joseph: As of today we've accepted that there's been a fait accompli. We can keep the matter in November and ask the Court to take a call as soon as possible.

Adv: I have put in 36 years of service, i may only be honourably allowed to go. That's a suggestion.
Adv: Lords may extend the stay, HC may hear me on merits.

Justice Joseph: We have to balance. If you're entitled to succeed and justice, you'll have your day in Court. If truth is on your side it'll come to you after tribulations. But we can't direct that now.
Justice Joseph: We'll modify the order to say case be heard by 2 months, that's the maximum we can do.

Adv: With all due respect, let me retire in peace.
Justice Joseph invokes day of reckoning: If you're proved right in Court, you'll have your day. Not getting immediate relief should not stall you from seeking hope in the system.
SG: May advance. But lordships have heard only 1 side of the story, there is a darker side. You spoke about truth etc.

Order: Having heard ld counsel...

SG: may fix a reasonable time limit, there are pensioners waiting with unblemished records.
Order: we are not inclined to interfere with the HC order refusing to extend the stay order on disciplinary action against the petitioner. We note that it was an interim order.
At the same time, having heard ld counsel we modify the interim order to facilitate an earlier...
Order: disposal. Accordingly, we direct that the WP shall stand listed before the HC ...

Justice Joseph: do you have hearing dates in Delhi HC?
Justice Roy: Particular days?

Order: on 22nd of November. Pleadings to be complete by then and HC to dispose of matter within ...
Order: 3 months. We have not expressed any opinion on merits.
