On this #InternationalPronounDay we're sharing some of the information from response by New York City to our records request seeking data about complaints filed under NYC's (unconstitutional) pronoun law.
There's money in being "misgendered."
(Note: redactions are by KPSS.) 1/
CASE 1 OF RESPONSE:
Respondent: New York City Department of Correction (also named: 4 individual Corrections Officers, 2 Captains, 2 Asst Deputy Wardens)
Settlement: $21,500.00 emotional distress damages; modification of computer system; & more
CCHR Case: M-P-S-19-69925
2/
Note: “RMSC” is the women’s unit on Riker’s Island, NYC’s main jail. Complainant alleged the following also occurred on two subsequent dates in March 2019. (There was also an issue about Complainant wearing a tank top instead of a bra as visitor rules require undergarments.) 3/ Image
As part of settlement for being “misgendered,” this person received $21,500 of NYC taxpayer money intended for maintaining NYC’s jail: 4/ Image
Also in settlement: Riker’s Island, NYC’s main jail, must manage and cater to the self-declared "gender ID" of visitors, instead of being focused on ensuring accurate identification, safety, preventing distribution of contraband (drug use inside Riker’s is notorious), etc. 5/ Image
DOC employees must also (again, already tasked with managing the correct ID of visitors, safety and preventing contraband) – as government employees – use fake names or nicknames and incorrect pronouns/honorifics under threat of penalization: 6/ Image
CASE 2 OF RESPONSE:
Respondent: a charter school
Settlement: $23,000 for backpay and $23,000 for emotional distress damages
CCHR Case Number: M-E-S-19-70907
Teacher resigned because was “regularly misgendered” by 8th grade students, alleges complaints to admin unaddressed. 7/
Email from teacher to administration noting lack of respect from students, worrying it's b/c "I am transgender" and "the problem is that the students do not respect who I am." "Bright spot": "not been a class eruption of laughter when a student misgenders me for some time." 8/ Image
Another email followed from teacher to administration: 9/ Image
On the day after "dress up" day, 10/ Image
Complainant was then moved to a co-teaching role. This did not go well either. 11/ Image
New York City eighth graders were not playing ball with this teacher's pronouns and women-face, so this teacher quit, then filed complaint which was settled by this charter school (funded by taxpayers) for $46,000. Again, this is under NYC's (unconstitutional) pronoun law. 12/

🚨 Despite the disastrous results of the since-modified 2021 policy (multiple pregnancies, reports of assaults, absolutely petrifying men being housed with women), the NJ legislature is considering a law mandating prison housing according to self-declared "gender identity." 1/

The law would explicitly REMOVE Dept of Corrections' ability to take into account factors such as criminal history (rapists welcome) and likelihood of perpetrating abuse (all violent offenders welcome) and security threat levels. DOC could NOT review on a case-by-case basis: 2/ Image
The 2021 policy operated on a "presumption" of housing in accordance with an inmate's "gender identity".

In response to a FOIA request, KPSS has received a current (Aug 19, 2023) Transgender Inmate Report from 🇺🇸 Bureau of Prisons.
Let's break down some of the info on these pages.

Population numbers of inmates id'ing as "trans" in 🇺🇸 *federal* prison: According to BOP:

Oct. 2022: 1610 (1143 "M2F" // 467 "F2M")
Aug. 2023: 1980 (1295 "M2F" // 685 "F2M")

An almost 23% increase in less than one year.

The disproportionate increase in "F2M" is notable.

An update to the below 🧵 and a HEAD'S UP:
In 2024 there will be a voter referendum to enshrine "sex" and "gender identity" in the New York State Constitution. All single sex spaces, incl'g prisons, in New York could be deemed discriminatory and in violation of Constitution. 1/
The second step in the Constitutional Amendment process occurred January 2023. The NYS legislature passed the Amendment for the second time (in a separate session from the first time), which means it is on its way to a referendum by the voters in 2024. 2/ nyassembly.gov/Press/?sec=sto…
Millions of dollars are being poured into a vote-yes campaign with a focus on the portion of the amendment enshrining access to abortion in the New York State Constitution. 3/

Yet again a murderously violent man who targeted women is being housed in a women's prison. Why is this particular placement so maddening and what can we do? 1/ Image
First, the story, which many of you know, but some do not: In Nov 2016, widely-platformed "trans" activist Dana Rivers (formerly known as David Warfield) was arrested, covered in blood and gasoline, leaving the East Oakland, California home of Patricia Wright & Charlotte Reed. 2/
(Over a decade earlier, Warfield became a public activist after being terminated from his teaching position after discussing with students that he had been sodomized and his plans to "transition.") 3/

Incarcerated women in Minnesota will now be forced to share showers, toilets and sleeping quarters with this man. He won't be the last. Minnesota agreed to change its policies as part of this settlement. BUT that's not all... 1/ Image
Minnesota taxpayers could be on the hook for surgery to create a hole where there is now a penis and breast implants should such surgeries not occur before his release date (which is in less than 1 year). 2/ Image
He and his attorneys get almost 1/2 a million dollars, Minnesota taxpayer dollars. 3/ Image

A companion Bill has been introduced in the New York State Senate. This version is, yes, even worse than the one in the Assembly. 1/
NY Senate Bill 2860 expands coverage beyond correctional facilities. In this version, incarcerated males can opt into any type of facility. This, presumably, includes forensic mental health facilities. So now we are housing mentally ill incarcerated men w/ mentally ill women. 2/ Image
NY Senate Bill 2860 also adds this new challenge for prison officials: They have 2 days to make a decision. One would hope this process would involve, at a minimum, reviewing criminal history, prior incarceration records, psych evals; conducting interviews. There is no way. 3/ Image
