The Dutch government π³π± has released its assessment regarding the modernization of the Energy Charter Treaty and why and how it wants to #ExitECT
The result achieved is insufficiently ambitious and not in line with π³π±πͺπΊ #climate targets. π§΅π
Key points decisive for π³π± to #ExitECT:
1β£ Despite flexibility mechanism and carve-outs for πͺπΊ, ECT remains an organization where #FossilFuel protection outside πͺπΊ remains possible.
2β£ No reference to future Multilateral Investment Court
3β£ No strong sustainability obligations
Subsequently, π³π± will:
β‘οΈabstain from voting during the Energy Charter Conference on 22 Nov so not to block modernization for others.
β‘οΈ not initiate ratification procedure and not submit ECT amendments to parliament for approval
β‘οΈ object provisional application
π³π± will take steps to withdraw from #ECT, after parliamentary approval, by written notification to the depository. Withdrawal will take effect at earliest one year later. This will trigger sunset clause for existing investment. π³π± will not be subject to modernized ECT.
π³π± has not determined its position on πͺπΊ decisions yet. Should πͺπΊ remain party to the #ECT, all provisions dealing with matters of exclusive EU competence would still be binding on π³π±, even if π³π± itself is no longer party to ECT.
