Enforcement Directorate moves Bombay High Court challenging the bail granted to Shiv Sena MP Sanjay Raut and his brother Pravin Raut. The Sessions Court had rejected the stay on execution of the bail order earlier today.

ASG mentions the case before Justice Bharathi Dangre

ASG: We are seeking stay on execution of bail

Court : Under what provision ?

ASG : Under section 482 CrPc and Article 226 of Constitution

Court: I have not looked into the order on and what grounds the bail was granted. I do not know the ground you are seeking bail.

Court : do you think the word of court will reach the jail authorities after 5:30?

ASG: There is a huge amount involved in the offense

Court : The Sessions court took one month to pass the order and you want me to stay it? I need some time to go through the material

Court : The matter which you argued for 4 weeks, you want me to stay it

ASG: We applied for stay in sessions court but it was rejected. I am only asking today and tomorrow. Till tomorrow 10:30.

Advocate for Pravin Raut : We have argued seperately for hours. We are not going to run away and go out of the country

Court : In any case ASG should not expect that arguments will be concluded tomorrow

ASG is citing cases where bail has been cancelled by the bombay high court

Court: This is for cancellation. Whether I can exercise S.482? Because there is a seperate bench for hearing this

High Court refuses to stay the execution on bail granted to @rautsanjay61 today. Justice Dangre informs that she will hear the application tomorrow.
Court said you have come under 439(2). Inherent powers are under 482 .

ASG : Keep it tomorrow first on board

Court: i will keep it tomorrow but not first on board. There are other important matters. I don't want others to keep waiting for 2-3 days

Order: Application under 439 crpc is against the order of November 9 was mentioned at 4:40. Copy of application is served to respondents
ASG request for stay of order would mean keeping the order in abeyance

Order: He has placed reliance on two decisions. On perusal of order it can be seen that high court has power to suspend the bail granted under 439 with section 482.
Application before me is for 439.

Order: ASG prays for listing it tomorrow l. Application is without numbering. Registry is directed to grant the number to the application

Order: The application will be listed tomorrow
