1stly: #COAS is appointed under the law whereas the #CJP & the institute thereof is a subject of the #Constitution. #SupremeCourt (including Chief justice) is one of the three organs of the government i.e. trichotomy of powers. 2/9
Whereas the military is a subordinate department of the ministry of defense which is a part of the executive branch of the government. Appointment of #COAS is an administrative process carried out by the executive. 3/9
Such absurd rants by the puppets of deep state actually intend to equalize military with judiciary and other organs of the government. 4/9
2ndly: The #seniority principle as a default rule for appointments is folk wisdom having no relevance in modern democracies and also against the meritocracy. It is the representatives of people who have to decide ultimately & not some public servants or departments thereof. 5/9
3rdly: Seniority is a subjective notion, every department defines its own seniority definition under the rule made by itself i.e. #military would themselves decide who has to be their chief under the #seniority principle. 6/9
This way Seniority principle is against the check and balances available to the civilian government against #praetorianism. The seniority principle is like complete autonomy and separation of military from executive i.e. a state within a state and that too legalized. 7/9
4thly: Appointment of #CJP should also be subject to the parliamentary and executive approval instead of seniority principle so there could be a check and balance on the powers held by CJP. Even in India, their National Judicial Appointments Commission appoints their CJ. 8/9
