Gujarat High Court is hearing a PIL seeking implementation of the nod given by the Governor for making Gujarati, an additional language of the Court Proceedings.

Bench of Chief Justice Aravind Kumar and Justice Ashutosh J Shastri is hearing the matter.

Senior Adv Asim Pandya for the petitioner points out that the State Assembly had passed a resolution to this effect, which was forwarded to the Governor through thr Council of Ministers.

Pandya: It is basically the will of Indians through their chosen representatives. Ours is a democratic country and in this matter, when the Governor has passed orders, there is no role to be played by the Supreme Court or thr High Court even on administrative side.

Pandya: I rely on observations of great persons like Swami Vivekananda, who have advocated use of mother language and against the thrusting of English. They have spoken about the importance of mother language in overall development of a child.

Pandya: There are also similar observations by Mahatma Gandhi, Mahatma Jyotiba Phule, Gopal Krishna Gokhale etc.

CJ Kumar: But that is pre-independence era.

Pandya: When the President, Governor, Prime Minister, Law Ministers, ex CJI Ramanna etc have said this is the time to introduce regional languages in HCs then I think your lordships must consider it.

CJ Kumar: Mr Pandya, what you seek is going to have large scale effect and we will have to look into all the aspects.
We will examine it.
Pandya: Please issue notice to State.
CJ: Not at this stage.
