The debating chamber in the Scottish Parliament is starting to fill up with MSPs. We are due to start the final debate on amendments any moment now.

This debate is likely to last 6 or more hours and you can watch it live on:

scottishparliament.tv
I can't take pictures of the public gallery but it's entirely empty except from 20 gender critical activists sitting on the chambers left hand side and then a small group of trans people and allies.

The overwhelming majority of the public gallery is empty.
Why is most of the gallery empty? It's because the Scottish Feminist Network found a flaw in The Scottish Parliament's ticketing system allowing them to book most of the seats on the public gallery and leave them empty.

We are now onto a motion submitted by the Scottish Conservatives to block the Scottish Parliament from voting on the Gender Recognition Act reforms.

They suggest the most consulted upon bill in the history of the Scottish Parliament is being rushed.
The presiding officer stops the Tory MSP to remind him to treat his parliamentary colleagues with respect.

They've had 6 years to study this legislation. But apparently the Tories need more time.
Another point of order from a Tory MSP.

He says parliamentarians with disabilities need more time to consider the bill. He also wants to see a disability impact statement for the bill.

The presiding officer notes these comments and says there will be adequate breaks.
The move to halt the bill process apparently hasn't been circulated to all MSPs.
Short suspension of parliament while people try and figure out what's going on.

The Scottish Feminist Network is starting to spread out across the public gallery. Wonder what they're planning.

(lol jk we know exactly what they're planning to do)
Tory MSP are chatting to the Scottish Feminist Network about something important it seems. (A conversation from the gallery to the floor is against parliamentary protocol)
The whole Scottish Feminist block has reassembled and are now sitting at the front section of the gallery on the west wing of the chamber directly behind the Conservatives.

Poetic.
Tory MSP Tess White Is having a proper chin wag with them again.

Wish I could hear what's going on.
Tess is talking with obsolescence at the moment. A wee reminder that Obs has a leadership role in the Scottish Feminist Network who collects data on pro trans activists to give to For Women Scotland
Okay MSPs now have all the details they need now, so we should starting again soon.
A point of order from an MSP on the impact of MSPs with childcare not being able to have enough time to consider the bill.

A proposal is to extend this debate to 2023.

This isn't a point of order that the presiding officer can decide on alone.
Another the conservative point of order saying she has a list of people who would like to come in to see the debate.
She says we should delay this debate in light of this.
Another point of order for a statement tomorrow about travel. I'll let you know when the Tories stop putting in points of order so we can get on with this debate.
Douglas Ross is falling asleep already. Poor soul. πŸ’”
The Tory MSP is saying we need to focus on actual priorities that impact everyone and not issues like the GRA reforms.

Another Tory has brought up another issue this time bio-diversity and how it should take president over this debate.
The idea that Tories care about climate change is entirely laughable.
Stephen Kerr Tory MSP says new stats on the education system should be the focus of this parliament right now.

And that the order of business should be updated to reflect this.
So far the Tories can't agree what should be discussed instead of the bill.

Tories are demanding minister statements on travel, climate change and education.

They want to hijack the order of business to leave no time at all for the GRA reforms.

This is the real #nodebate
George Adam MSP, Paisley legend, comes in to defend the current order of business.

He says stands by the order of business and wants to see Parliament get on with its job.
Neil Bibby MSP joins in to say that the Tories are wasting time that we could use to discuss this bill.
Tory MSP says that George Adam is misleading the house??
Okay now to vote on the amendment to change the order of business. A short suspension will now take place to allow this.
Voting result of the first amendment to the order of business falls - no 96, yes 31
Voting result of the second amendment to the order of business falls - no 96, yes 31
Voting result of the third amendment to the order of business falls - no 96, yes 31
Voting result of the fourth amendment to the order of business falls - no 96, yes 31
Point of order from a Tory MSP to suspend the rules of Parliament in relation to the GRA reform to have no timetable limits.
The point of order is not agreed so it's time for another vote.
Vote on the motion is closed.

The result is: no 74 yes 51.

Another point of order from the Tories.
The point of order is around allowing offenders to get a GRC with the claim that the Scottish Government have silenced MSPs after they were encouraged to withdraw the amendment but apparently they will be discussed.
Another point of order from the conservatives to ask for advice to be published around who can and cannot be called for the debate.
Another point of order from the Tories, asking for further advice on how speakers will be called to this debate.
Okay vote on the order of business itself. George Adam moves the motion. Stephen Kerr MSP speaks against saying this timetable does not do justice for such a "complex" bill.

The rest of the parliament is laughing at the Tories attempt to filibuster.
Now we go to a vote on the final order of business
Sorry I was a bit distracted, a member of the Scottish Feminist Network was hissing at me and now has been escorted out of the chamber.
Vote is closed. The result is yes 95 no 31.
Point of order from Pauline McNeill about the groupings of the amendments.
A point of order now about amendments being ruled out of order because they aren't within the bills scope.
Now we move on to the stage 3 amendments of the bill itself!

We made it πŸŽŠπŸŽ‰πŸŽŠπŸŽ‰
First grouping of amendments is surrounding the ability of 16 and 17 year olds to apply for a GRC.

Tory MSP Rachel Hamilton argues that we should keep the age limit at 18.
She argues that brains still develop until the age of 25 so if there should be an age limit cut off it should be at that age.

Alex Cole Hamilton says that most rights come available at the age of 16 in addition to this people younger than 16 have the ability to consent to this
Rachel Hamilton argues that this parliament should be supporting children instead of placing further responsibility on them.

According to Rachel Hamilton 16 and 17 year olds are children.
We also just had our first buzz word, the Cass Review, no wait a second mention. I hope no one has made a drinking game out of this.
Claire Baker MSP Labour is using the Cass Review to speak out against lowering the age of a GRC.

Jamie Greene MSP Tory, says that there was compromise at stage 2 on lowering the age of a GRC. He wants 16 and 17 year olds to have an even stricter process.
He says that his amendment is likely to fall because for the rest of the chamber this is too strict while his own party it's not strict enough.
A labour MSP Martin Whittfield says it's a pleasure to follow Tory Jamie Greene. He agrees that trans 16 and 17 year olds should have a stricter process without self ID.

This is to "protect them".

Protect them from who Martin?
Tess White MSP Tory asks if 16 and 17 years are still children, Martin Whittfield agrees.

He says that his amendment is seeks young people to speak to another individual about a GRC and the GRCs can be denied by the registrar general aren't satisfied with the evidence presented.
Now Kenneth Gibson MSP SNP believes 16 and 17 year olds should seek counselling before getting a GRC. Treatment options should be presented to deal with this "disorder".

Emm Roddick comes in to say this bill is about demedicalisation. And this will allow more freedom.
Kenneth Gibson disagrees and says they should seek to see a clinician. Especially if your autistic or have ADHD. He worries that more trans people are coming out because of the sexualisation of the female form.
He says because the brain hasn't fully developed until 25. He says because 16 year olds can vote and marry but can't drink or smoke and therefore in his mind aren't adults on the basis of this.

He goes on to say this will encourage people to do irreversible damage to their body.
Oh gosh he's still going
"It's a one way ticket, you can't grow your genitals back"

- Kenneth Gibson MSP
Jamie Greene thanks Kenneth Gibson for his "unorthodox" comments. Jamie Greene say he moves the amendment.
Jamie Greene just called him Kenny Gibsy lol.

He says this bill is steeped in inconsistencies but his own party challenges him on the amendment on issues of language.

Jamie is trying to strike a middle ground and even his own party wont have it.
Rachel Hamilton Tory MSP says a large amount of people who apply for a GRC get turned down.

She says that there is a loop hole in Jamie Greene's amendment because it'll allow people to get a GRC when a medical panel would have turned them down.
Jackie Ballie says she supports Martin Whittfield's amendments as well as a selection of others to allow for safeguards. Some aged 15 and a half can prepare to get a GRC for when they turn 16, she wants to delay that so you can only start the process once you've turned 16.
Maggie Chapman thanks all who have helped get the bill get to this point and especially trans people.

16 year olds have a selection of adult rights and can socially transition before this. She says these amendments for a stricter process goes against international best practice.
Alex Cole Hamilton says there has been too much heat & hate in this debate. He suggests it isn't surprising that those who are against the bill are already against 16 & 17 year olds being included. None of the fears have been validated by any other country that has similar laws.
Medical transition is an important debate but it isn't part of this debate. If 16 years have the mental capacity to be responsible for a range of issues then they have the mental capacity to understand themselves.
An MSP that I can't name (they may be either labour or a lib dem MSP) who calls for us to pause this section of the bill
Ash Regan says she won't support the bill overall but back amendments that will safeguard children.

She says a mother wrote to her who removes all agency from her autistic trans child. She says social transition is a coercive practice that has led this family down a dark path.
Pauline McNeill says the model of self ID says GRC are now more powerful than they were in 2004.

She cites the UN rights of the child and the Cass Review and says we need clarity on this before a vote.
SNP Shona Robinson says that a lot of these amendments have been already discussed at stage 2 and there have been compromises and improvements that are consistent with the intentions of the bill. Fergus Ewing asks why there isn't more consultation on this issue of age.
Shona says there is a difference of opinion and has listened to young people themselves who overwhelming say want to be able to get a GRC.

Shona says that there should be guidance to young people so they can have the same right while also being supported.
Emma Roddick intervenes to ask why are young trans peoples details are being revealed in this debate.

Shona isn't familiar with this but states that the chamber should never be used for this.
On the issue of the Cass review Shona Robinson says she'll consider the findings of the Cass review in improving trans healthcare in Scotland and hopefully this will give some reassurance. She also comes out in say that raising the limit to 16 and a half would be confusing.
Jackie Ballie responds on the point of her amendment and claims the government's plans will allow for trans people to to claim a GRC at 15 and a half.

This is obviously pure nonsense and very surprising from Jackie Ballie.
Maggie Chapman asks Rachel Hamilton if it is wrong to weaponise neurodiversity in this debate and is shouted down by the Tory benches.

Green Minister Lorna Slater asks Rachel Hamilton to give way to herself as an autistic women and Rachel Hamilton declines.
Now there will be a suspension of business as the chamber votes on the rights of 16 and 17 year olds.
9 for, 115 against. 16 and 17 year olds right to get a GRC is upheld.
Sorry I was late, a lot of trans women needed to pee so we went together for strength in numbers. Fearing for your safety in Scottish Parliament toilets has became common place through this debate.
A Tory MSP is trying to suggest the "handpicked" experts from the UN are wrong including the UN high commissioner. He says that there is a conspiracy and we haven't found any evidence of bad actors getting GRCs to hurt women because we haven't looked for it.
He wants to put through an amendment to prevent people from getting GRCs who are currently being charged for sexual offences.

He argues the evidence from the UN and other bodies against this is unconvincing.
Omg anyone convicted for fraud will also be banned from getting a GRC under this amendment.

Bad news for Marion Millar.
"Rape can only happen with male genitals" says the Scottish Conservatives.

What an awful message to those who have been raped by someone who doesn't have a penis.
Call me awful but I don't the same party that introduced the rape clause cares about victims of sexual abuse.
George Adam frantically runs down to his chair to table a motion to extend this session by 30 minutes.

What a wee legend.
Now one of the SNP MSPs who rebelled in stage one says she wishes all trans people freedom and liberty her issue is with bad actors.

She says she's not looking for sympathy but trauma affects the vulnerable who don't have a voice.
She says her amendment will be opposed by the Scottish Government because of uncontested legal grounds.

She says these reforms this law will put male rights above women especially for sex crimes.
Gillian Martin SNP MSP claims that number of sexual offenders don't matter and because something is unlikely to happen doesn't mean we shouldn't have safeguards.

Police Scotland should have the powers to prevent trans people in claiming a GRCs according to Gillian Martin.
She says this will only stop men seeking to game the system and won't impact trans people's rights.

We know this won't be true.
Cabinet Secretary Shona Robinson says that there is no evidence from any other countries and the over 3 million people who have legal recognition for a statutory declaration that people claim for the GRC to commit crimes.
Ash Regan intervenes to suggest that the evidence isn't there because no one is collecting it.

Shona Robinson claims this to be false.
Fergus Ewing asks if sex offenders can change their name to escape past life can do the same with a gender recognition certificate.
Shona says the arrangement in Scotland already requires anyone who is on the sex register to notify authorities of a change of name, a change of address and in this case a change in birth certificate.
Michelle Rhonda Thomson MSP asks for the government to go further and suggest a risk assessment for each GRC being issued.
Shona Robinson says that some of these amendments are at risk of not being compliant with the European Court of Human Rights. Tories are demanding that they should pass anyway despite how these amendments can lead the government or parliament to be taken to court.
Daniel Johnson Labour MSP says that this is just the opinion of Shona Robinson and presses her further if these amendments really are against ECHR compliance

Shona Robinson says that she is relying on the legal advice that has been put to her. It's not just a "matter of opinion"
Shona Robinson says that instead we should adopt a risk based approach rather than outright banning people from applying for a GRC.
Maggie Chapman is speaking against all the amendments in this group. She critiques members who have used dog whistles in try to present trans people as sexual predictors.

The right to privacy must be protected.

She finishes by saying men simply do not GRCs to abuse women.
Labour unfortunately seem to be backing some of the more hostile amendments in this section.

This is really disappointing but not surprising considering the European Court of Human rights took labour to court prior to the 2004 GRA.
This happened due to trans people having to be sterilised in order to get a GRC before the law was changed.

The apple doesn't fall far from the tree.
Russell Findlay claims that the guidance of these amendments not being ECHR compliant came at the last moment.

Shona Robinson intervenes to says she has raised concerns about ECHR compliance very early in the legislative process of this bill.
Russell Findlay says this is a technicality and we already monitor offenders of all varieties.

The conservatives say it's about doing the right thing even if that means the law isn't ECHR compliant and it goes to the courts.
Parliament casts their votes on this group of amendments.

The result: yes 59 no 64

It's close but the amendment falls
The Scottish Feminist Network stage their wee stunt as suspected.

They are being asked to move but refusing to do so.

"You'll have to arrest us" says one member.
I had a bit of an altercation there. Members Scottish Feminist Network tried to claim I was filming them and started to make threats.

In addition to this someone tells they just also threatened a cis women for using a women's toilet.
Members of the Scottish Feminist Network have started arguing with each other.

"Where are you going?!?" One member screams to another.

"I'm going fucking home!"
Don't worry, parliament is keeping us fed
Gender critical activists are now outside of parliament holding a vigil for the "death of women's rights"
Some members of the Scottish Feminist Network are either going home or stay in parliament and refuse to attend own group's vigil outside.

It seems like there could be a split in the group.
We are back inside the public gallery on the far west of the chambers. The rest of the public gallery is closed.
Now we are onto a nicer group of amendments to allow refugees in Scotland to be able to apply for a GRC.
Shona Robinson withdraws the amendment due to the limits of powers of the Scottish Parliament. This could risk the legal competency of this bill

Pam Duncan Glancy expresses her anger and believes its to be wrong that asylum seekers to force them to go down a different route.
Pam Duncan Glancy says she'll not support Shona Robinson's amendment to withdraw this right to Scotland's refugee and asylum seekers.
Shona Robinson says she can't disclose the legal advice but due to limits of devolution this could be challenged.

A Paul Sweeney MSP asks Shona to show leadership and withdraw this amendment.
Shona replies saying the UK parliament is looking for any reason possible to rule this legislation to be incompetent.

Members argued whether or not this will impact some or all of this bill.

Shona Robinson moves the amendment.
The vote is closed. Result immenit.
The result is yes 76 no 27, the amendment to withdraw provisions to allow refugees and asylum seekers passes.
The security staff look stressed AF btw. They've had to put up with a lot for the duration of this bill.
I'm hearing from other trans women that they have also been hissed at by gender critical activist.

Normal behaviour clearly.
Now we move on to Labour and their amendment on support and information for those getting GRC.

You may have noticed that we have gotten pass the worst of the amendments.

Despite Labour flirting with gender critical activism it looks like this bill won't be watered down tonight.
Someone was brave enough to send pictures of the vigil outside of the Parliament

There's only about ten of them.
Jeremy Balfour is now speaking on his amendment to re-medicalise the process of getting a gender recognition certificate.

This would undo all the progress made at stages 1 and 2 of this bill.
Pauline McNeill Labour MSP supports these block of amendments to re-medicalise the bill.

This would force trans people to get permission to get a GRC from a medical professional.

This is very similar to the process we have already.
Jamie Greene is continuing to try and play for gender critical activists and as a trans ally.

He raises concerns about trans people getting a GRC in Scotland and could then move elsewhere in the UK.
Maggie Chapman says she will not support any of the amendments in this group.

They revert the process to be a 2 year period. This compelled trans people to speak to medical professionals. The point of self ID is about having no gatekeeping from medical professionals
We have heard no evidence that these time period produce any favour.

Rachel Hamilton asks what evidence shows we should reduce this.

Maggie Chapman lists trans people and groups and international best practice.
Pauline McNeill intervenes saying do you accept evidence presented yesterday that infers women are at risk.

Maggie replies saying this evidence isn't connected to this block of amendments.
Daniel Johnson Labour MSP says it's wrong to see trans people as a mental illness category.

Rachel Hamilton replies we are letting people down who are on a dangerous healthcare pathway.

Johnson says it's wrong to conflate mental health care and trans people.
Shona Robinson goes over the principles that members voted on at stage one. These were principles of self declaration.

She highlights even the UN rapporteur for gender based violence, while she expresses safeguard concerns, she has backed a self declaration in other countries.
She says these amendments would require a diagnosis of gender dysphoria, being trans is not a medical condition and therefore these amendments go against the principles voted at stage one.

Shona Robinson ends in saying she doesn't agree with any of the amendments in this group.
Rachel Hamilton moves the amendment to re-medicalise the process.

We move to a vote.
Amendment result: Yes 35 no 92

The move to re-medicalise the process of getting a GRC falls.
Amendment result yes 51 no 73.

The amendment to expand the reflection period falls.
Genuinely Scottish Labour what the hell are you playing at? The above vote should not have been close.
Nothing much is happening right now other than the Tories losing all of their votes.
Rachel Hamilton moves another amendment to extend the reflection period back to two years again.

She's lost every vote overwhelmingly and this was no different.

Now onto minor technical amendments to tidy up the text.
Lol for some reason (the Tories) we are moving to an actual contested vote on minor amendments on text.

Yes 111 no 1.
Really hope that one Tory feels special.
Personally I feel if a Tory loses an amendment by over 100 votes the presiding officer should call the Tory cringe.
Michael Marra pushing ahead with an amendment to force trans people to ask someone to countersign the declaration from middle class professions. Trans people must know this person for 2 years in order to get a GRC.
He acknowledges that trans people disagrees with him but is the only way this bill can strike the correct balance.

This amendment would make it impossible for most trans people to get a GRC.
Emma Roddick MSP asks cabinet secretary Shona Robinson if these amendments are wrecking amendments and while Shona says she wouldn't go that far it would disrupt the principles of the bill.
Despite how Micheal Marra's amendment would effectively ban trans large groups of trans people the Scottish Tories have said they won't support it because it doesn't go far enough
Maggie Chapman says that these wrecking amendments fly in the face of the bill and the principles that were voted on at stage one

Its not appropriate for an outsider to choose to recognise someone else's identity.

She highlights that many trans people will be blocked from a GRC
Time to vote on amendment 100 on statutory declarations.

The result yes 42 no 72

The current provisions on statutory declarations remain in place.
The vote on amendment one on statutory declarations now.

Result: yes 54 no 70

The current provisions on statutory declarations remain in place again
The vote on amendment 12 on statutory declarations now.

Result: yes 35 no 90

The current provisions on statutory declarations remain in place again.
Next group of amendments is around background checks for those applying for a GRCs.
Russell Findlay says that these background checks aren't to demonise trans people but as a form of safeguarding.

He wants this in place due to the demedicalisation of the current process and a form of safeguarding.
Douglas Ross just randomly came into the public gallery? He's sat down?
Apparently it's against protocol for me to ask Douglas Ross if he shouldn't be down in the chamber instead.

He gone now, strange behaviour.
Maggie Chapman and Shona Robinson go over disclosure Scotland and how PVG are there for employers to get information about their employees.

To ask trans people to get a PVG to be able to get a GRC just isn't workable.
Most of the Labour benches are now empty.
A Tory just brought up short term let's for flats and how the police are under pressure due to it?

Shona Robinson replies in saying she doesn't know what he's talking about.

She goes on to say using disclosure Scotland in this way is wrong and that MSPs should vote against.
The Tory presses on with his amendments for background checks for trans people.

He claims this isn't about harming trans women or to compare them to predators but instead to stop men from using any loophole to abuse women.

We now go to a vote on this amendment.
Labour benches are full again.

Vote is closed.
1st Amendment result: Yes 33 No 89

2nd amendment result: Yes 33 No 89

3rd amendment result: Yes 33 No 89

More amendment votes to come but from this group but I'm pleased to announce trans people will not have to go through background checks to get a GRC.
The rest of the amendments in the section are falling one after another.
We are now suspending the meeting of parliament for 15 minutes to decide what we are doing next

I suspect the result is to move the rest of the amendments to be debated tomorrow from 2pm.
MSPs are starting to come back into the chamber. We should hear about next steps soon.
Holy hell they are continuing onto another group of amendments.

Unfortunately I'm off to get something to eat and get some sleep before doing the same all over again tomorrow.

Remember you can watch the remainder of this session live at scottishparliament.tv
AND WE ARE BACK!

Day number 2

Hopefully this is the last day but it's very likely that this meeting could go on to tomorrow
As always you can watch this live on

scottishparliament.tv
Now we're off to a point of order from Douglas Ross who wishes to discuss the record on how the gallery was cleared yesterday.
On to amendment block 10. This block goes over fraudulently claiming a gender recognition certificate.

Jamie Greene is going over his amendment to strengthen the charges around making a false declaration.

However making a false declaration is already a crime here.
While Jamie Greene goes over his redundant amendment. Let me go over Gillian Martin's amendment that was passed last night.

Many people are getting this amendment mixed up with the Tory/Kerr/Findlay's amendment that would ban anyone who is on the sex register.
Gillains amendment isn't as bad but gives the police powers to intervene on a GRC application if they believe there is risk.

While this amendment is not nearly as bad as Kerr/Findlay's I'd still say the amendment that passed is based on fear rather than evidence
The sex register is a very wide register. You can be put on the register for serious sex crimes, pissing in public and even for brothel keeping.

Brothel keeping in the UK is classed as 2 or more sex workers working together even if that is for safety.
I need to study Gillains amendments with the final bill to understand the full effect but I believe Gillain Martin is trying to suggest this amendment goes further than it actually does.

Even gender critical activists don't see it as a win
Gillain Martin's amendment trying to find middle ground but instead angered both sides.
Jamie Greene is going over "trans widows" while touching on what makes up a fraudulent GRC. He would like to see successful GRC applicants who then go on to commit crime to be also charged with fraud.
Labour's Pauline McNeill says that the Tory amendment on fraud doesn't go far enough.
These were the gender critical politicians who said they support detransioners but here they are arguing whether detransioners should be charged.
A Tory backbencher asks if people don't need to submit an evidence so therefore how can you prove there has been fraud?

Stephen Kerr intervenes to say surely fraud is a trans person getting a GRC who then goes on to do crime.
Another Tory backbencher suggests surely fraud would be a trans women using a women's toilet???

They really haven't bothered to read the bill have they.
Shona Robinson thanks Parliament staff for working so late yesterday.

She says she worked with Jamie Greene on these amendments but will vote an against Rachel Hamilton's amendments.
I seem to have got Jamie Greene and Rachel Hamilton mixed up πŸ™ˆ

Tories seem to be not be in favour of Jamie Greene's amendments, Stephen Kerr asks how do you define fraudulent a GRC

Shona says it would be up to the courts to decide based on the individual circumstance.
To go back to Gillian Martin's amendment about the police powers to intervene to stop trans individuals to get GRC I'm told by policy staff that "it takes the burden of delay on the police but even then it can be waived."
So it seems like the police can slow down a GRC application for an offender but not stop it entirely.
Jeremy Balfour say for someone to be charged with fraud it needs to be beyond any reasonable doubt.

He believes the standard to charge a trans person with fraud is too high even with his tory colleagues amendment.
Quick suspension of 5 minutes while the Parliament for the first vote.

The first amendment will be Jamie Greene followed by Rachel Hamilton's.
Jamie Greene's amendment doesn't change the bill but gives more of an explanation of what currently counts as fraud in making a false declaration.

Rachel Hamilton's one is around expanding on what can be classed as GRC fraud.
Vote result yes 94 no 16 that vote passes.

Point of order from the Tories to the Clark to publish the meeting minutes as soon as possible. I believe this is already a rule?

This seems to be more filibuster.
He claims yesterday's details were leaked to the press before the public knew about them.
MSPs in the chamber heckle that these preceding are public and the presiding officer says minutes need to be checked to be accurate before being published.
Stephen Kerr's amendment: Yes 62 no 64

The amendment to expand what fraudulent GRCs are falls.
Jamie Greene is back to talking about his amendment and facing intervention from his tory colleagues. It's quite something but not surprising to see Tories treat their gay colleagues like Jamie like he has a bad smell.
You can see from the current shot on parliament TV how empty the public gallery is mostly empty and this time trans people and allies greatly outnumber gender critical activist.

However tickets are sold out apparently.
Another Russel Findlay amendment of fraudulent GRCs falls. Didn't quite get the number unfortunately.
Yes 60 no 62

Another Russell Findlay amendment on fraudulent GRCs falls but only just due to Labour's support.
Jamie Greene's amendment: Yes 92 No 13.
Pam Duncan Glancy is now discussing her amendment to the bill around the "person of interest" and how they could block someone else's GRC application maliciously.

This amendment seeks to limit how a "person of interest" can challenge someone else's GRC application.
Stephen Kerr infers this amendment will stop people from blocking people who have "genuine concerns"

Pam Duncan Glancy isn't having it and says this is to protect trans people.
Could you imagine For Women Scotland and the Scottish Feminist Network could claim to be a "person of interest" for each person getting a GRC.

They wouldn't have free time left to do anything else.
Murdo is crying that people can claim a GRC without wearing makeup, dressed and more.

He believes people should be allowed to block trans people from getting a GRC because of this.

Classic misogyny repackaged.
Dresses even*

Please don't claim a GRC naked folks
Tess White raises a point of order to ask why is the gallery empty when so many people want to see this debate.

It takes a lot of courage to ask this in Parliament when you are the reason why most of the seats are empty.
Shona Robinson on Pam Duncan Glancys amendment, says that she can give reassurances that the "person of interest" part of the bill can't be abused as it stands right now.

Pam Duncan Glancy moves the amendment.
Yes 26 no 98 therefore Pam Duncan Glancy's amendment isn't agreed.
Rachel Hamilton is trying to move a motion from the floor.
Rachel Hamilton says her amendment from the floor should be accepted because the For Women Scotland lost their court case against the Scottish Government after the close of the amendments.

Rachel Hamilton says this ruling changes the legal status of women.
Parliament is suspended, so the presiding officers have time to make a ruling on this.
According to a member of parliament staff, security staff are getting abuse from gender critical activists at the enterance. This is because they are being denied entry to parliament because they are trying to enter with banners and protest signs.
Joanna Cherry is also outside the parliament giving press interviews against her own party.
While we're waiting how about some more leaks from the Scottish Feminist Network shall we?

Yesterday night I was mass reported by members of the Scottish Feminist Network. I received a 12 hour suspension which was why I was late starting this.
I know this because the Scottish Feminist Network is still compromised.

Here they have a list of the people they want to silence in the lead up to the end of this debate. It includes trans people but mostly trans allies and even Parliament Staff.
The benefit of sitting in the public gallery with gender critical activists is I can look at their reactions to the above tweet in real time.
Still no updates from the chamber, this standing order is taking up a lot of time that could have been spent debating this bill.
We look like we are almost ready to start again.
This 15 minute suspension has lasted longer than an hour so far.
The manuscript amendment, the amendment from the floor, could have been submitted at any point after the For Women Scotland ruling.

Therefore on that basis the amendment is not accepted.
Jeremy Balfour raises a point of order about this bill taking up too much time, this is not emergency legislation, and we should focus on other legislative areas.
Shona Robinson says the recent court case show quite clearly that this is a devolved matter and this bill doesn't affect the equality act which is a reserved matter.
Rachel Hamilton ask confirm what protections are granted for women from people with GRC.

Shona Robinson says the equality act remains unchanged and this court case does not impact this bill or the 2004 GRA.
Stephen Kerr asks if a trans women with a GRC can access single sex spaces.

Shona Robinson replies that there are provisions to exclude trans people from services if there is a justified reason for doing so.
This block of amendments are around producing guidance on the effects of this bill when it becomes law btw.
A lot of discussion on does this bill modify the equality act.

Ash Regan ask what assesment on the chilling effect on single sex service providers.

Shona replies that she believes there won't have an impact and the guidance is very clear on this already.
Pauline McNeill says the exemptions don't work because they are too strict.

Shona Robinson replies in saying well done crisis centers have used these exemptions while others remain trans inclusive.
Shona Robinson suggests some of the amendments would wreck the bill as it asks for guidance of reserve matters which will be outwith the competence of this bill.
I think we're due another stunt from the Scottish Feminist Network soon πŸ‘€
Jackie Ballie says the guidance proposed doesn't go far enough, her amendments would make it clear in this bill what it'll exactly do if it becomes law and how it doesn't affect the equality act.
Her next amendment makes clear how trans people can be excluded even if they have a GRC.

Shona Robinson says this could lead to legal confusion and could endanger the bill in the courts.
Jackie Ballie says this amendment doesn't interpret the equality act but isn't that literally what it's doing? It asks parliament to declare where the GRA ends and where the equality act begins.
Nicola Sturgeon just bonked George Adam on the head with a rolled up piece of paper.
They both look like they're vibing.
Graham Simpson asks if these amendments don't pass will Labour back the final GRA vote or will they vote down this bill.

Jackie Ballie says that Graham Simpson will have to wait and see.
Ash Regan says this bill does not strike a balance and presents a hierarchy of rights with women at the bottom.

She says self ID creates new rights and theres 4000 people who are not currently eligible to get a GRC.
Maggie Chapman intervenes with would the member agree with me that some people in that group choose not to get a GRC because the current process is traumatising?

The public gallery breaks out into a applause.
Ash Regan push her amendments forward and speaks more nonsense

She says male people are a risk to women and this includes trans women.

She says if this passes women and children will not be safe
A white old man stands up to shout thank you to Ash Regan.

He is now being escorted out of the gallery.
lol after all that filibuster George Adam moves a motion to extend this section for 2 hours.

It looks like we will be here all night again.
Tess White ask Pauline McNeill if she agree with Joanne Lamont if these safeguards are acceptable?

McNeill say because we are removing so much of the 2004 gender recognition act it does in a sense change the equality act.
Pauline McNeill says she is confused if the law relies on legal sex or biological sex.

While she says she understands these reforms are to make the process of getting more simple but perhaps it does give new rights.
Jeremy Balfour asks should the bill process be paused until we can figure out (what the legal complications are from this judgement)'s going on.
We are on group 13 out of 19 of amendments btw.
Should Pauline McNeill join the Scottish Conservatives?
Pain
A Scottish Conservatives back bencher asks Pauline McNeill if her amendments fall will she vote for the bill at the end of stage three.

Like Jackie Ballie, Pauline McNeill avoids the question.
Claire Baker another Labour MSP states that a whole new large cohort is about to have access to a whole range of rights.

Due to this and the right to privacy employers are confused.

Baker suggests these amendments are not outside the competency of this parliament
Rachel Hamilton moves her amendments one of which look to strengthen measure to exclude trans women.

The presiding officer asks an MSP to stop heckling Rachel Hamilton.
She goes over the idea of "self exclusion" a phenomenon were cis women stop using service due to trans inclusion.

The Scottish Conservatives will support Pauline McNeill's and other amendments.

Pam Gosal now, who says we are betraying the rights of one group to appease another.
John Mason intervenes who asks if people will self exclude from ethnic minorities and religious backgrounds.

Pam Gosal agrees and highlights how she has repeatedly raised this and how she tried to do similar amendments at stage 2 but was shot down.
These amendments would look at hot the bills impacts on religious and Bame backgrounds and review funding given to single sex space in comparison to spaces that are inclusive of trans people.
Sue Webber has amendments focusing on exemptions on single sex spaces & being able to out trans people who have GRCs in roles such as a carer.

She asks the cabinet secretary to give examples of exclusion under the current bill as current services believe it to be too strict
Sue's backdrop is a choice.
Onto Jamie Greene for his amendments. His amendment is to address to vindicate their position, if it doesn't affect the 2010 act then let the review show it.

He says he doesn't see this having an effect on single sex spaces but there remains ambiguity and concerns.
Daniel Johnson ask Jamie Greenes does he agree that clarity is important for both sides of this debate.

Clarity is an easy thing to request but a hard thing to give but it's not unreasonable to ask for it from the Scottish Government.
Daniel Johnson states the equality act is clear apart from how exclusions. People lack the confidence and the knowledge to impose this.

This is complex and we are adding to the complexity and we should celebrate this.

We need the guidance and we need these amendments.
Jeremy Balfour again, who quotes a constituent watch on TV at home. The constituent is nurse and is sent as a support worker. When a patent asks for same sex care she's doesn't know whether to protect the patient or the NHS.
Shona Robinson intervenes to quote guidance that states a trans person will not be used to provide care if there's reason to believe it goes against the wishes of the patient.

But Balfour says there is a limited number of staff and we can't guarantee this.
Yeah.
Maggie Chapman now:

In May 2021 'a practical guide to transgender law' came with the exact same conclusion as the recent case.

Don't vote for an amendment that risks it's legislative competence. Trans people should not have to wait longer than they need to because of politics.
I know there are fantastic MSPs who support trans equality within the Scottish Labour Party but it feels like one Labour MSPs one after the other are lining up to sabotage the bill.
Now onto personality vacuum Graham Simpson MSP.
All these letters that Tories are reading out from their constituents are definitely realβ„’
Oh thank god we are now onto a closing remark from Shona Robinson.

Guidance and reporting are a vital part of this bill but we can only do this within devolved matters and with reserved matter the responsibility lies elsewhere.
Graham Simpson suggests we been able to legislate on reserved matters or at least hold reviews on the matters that are reserved.

Shona Robinson replies let me be very clear, the provisions of the 2010 act are not modified by this bill.
Sue Webber intervenes as a virtual point of order to ask how can we discriminate against a holder of a GRC to protect single sex spaces.

Literally mask off.
Point of order from Douglas Roos to ask about the manuscript amendment, the motion from the floor, by Rachel Hamilton.

Douglas Ross says he can't find a rule to say you can't submit the amendment at the very last minute.
He asks the First Minister to meet with him and extend this debate to 2023.

Douglas Ross gets shot down and warns him he is challenging a ruling by the presiding officer.
He gets told to sit down by the deputy presiding officer
Douglas Ross stands back up to submit another point of order.

Douglas says he's just trying to get the facts. And repeats his point of order.

Another Tory tries to raise a point of order but we are now in the middle of a division and vote.
Yes 94 no 31

Shona Robinson amendment pass, the bill stays inside its legal competency.
Couldn't hear the numbers exactly but...

Jackie Ballie's amendment falls, the bill stays inside its legal competency.
On a break now to decide does parliament stay until the early hours of the morning or do we reschedule the rest of the debate for tomorrow afternoon.
The Tory position is quite interesting. They believe that the GRA reform bill debate is taking up too much of parliament's time while also believing the GRA is being rushed through.
I'm being told that the two parties that are against debating the bill into the night are the Tories and Labour.

However the government wants to keep labour on their side.

We should have the decision soon.
Result is in, the rest of the amendments will be voted on tonight. The final bill as amended will be debated and voted on tomorrow afternoon.
Labour MSP Michael Marra reads out a press release by a gender critical group and asks the cabinet secretary of Trans people in Scotland will be still able to access the gender recognition panel after this bill has passed.

No trans person is asking for this.
Also why is Labour reading out press briefings from Murray Blackburn Mackenzie?
Yes 60 no 66 Ash Regan's amendment falls but again is really close due to Labour's support.
Jamie Greene's amendment:

Yes 98 no 14

This amendment expands the detail of what is a fraudulent GRC
Wow this is strange.

Rachel Hamilton chose to not move her amendment but the rest of the Tory benches say yes it isn't creating confusion.

The amendment is moved but then falls.
Pauline McNeill's amendment:

Yes 59 no 67

Her motion falls.
Claire Bakers amendment:

Yes 57 no 70

That falls but Claire Baker still presses on with her next amendment.
Claire Bakers 2nd amendment:

Yes 56 no 70

That falls
Rachel Hamilton's 2nd amendment:

Yes 59 no 67

That falls
Rachel Hamilton moves her 3rd amendment:

Yes 59 no 67

That falls
Just gave George Adam a cheeky wee wink.

What a legend.
Hey are you really confused? Find it hard to keep up or keep track of the amendments?

Well good news @tristangrayedi has made you a cheat sheet so you can pretend to be clever like I do and use it to impress your mates.

docs.google.com/document/d/12c…
Maggie Chapman being able to secure a review on the reflection period and the living the acquire gender is really good. The evidence from this can be later used to argue to get rid of both. This will mean trans people don't need to wait any longer to be legally recognised.
Jackie Ballie's amendment result:

Yes 121 No 0
John Mason says he'd rather be at the Parliament Christmas carol event.

Yeah we'd rather you were there too.
Tories are trying to filibuster again by spamming points of order.

You're only keeping everyone in later by doing this.
Pam Gosal says her family members object to "biological males" giving them care.

She admits that this isn't a problem at the moment but believes if this bill passes it will force them to break their religion.

This isn't remotely true.
You can ask for another healthcare worker for any reason at all. The only way this could be true is if the number of healthcare staff is so low there isn't an alternative member of staff available.

If the Tories weren't so intent in destroying the NHS that wouldn't be an issue.
Brian Whittle Tory MSP is bringing up sport, this bill doesn't control sport, sport governing bodies do.

I don't know who knows more, sport bodies or a random Tory backbencher? It's just so hard to tell.
Brian Whittle rightfully highlights the awful way intersex athletes are treated while encouraging the same treatment for trans people.

He goes on to talk about the Q angle of the hip, we are onto transvestigator stuff here.
He brings up Caitlyn Jenner and is using her opinions to try and ban trans women in sport.
Point of order Gillain Mackay.

There's been an accident at the back of the chamber.

Parliament is suspended.
The colleague affected was I'll and is feeling better now and we are now continuing.

Jeremy Balfour asks the presiding officer to suspend the business.

The presiding officer declines.

George Adam states that the colleague affected wants us to continue.
John Mason asks for speeches to be made shorter.
Scottish Tories be like.

@D_Libris @JeremyRBalfour Kenneth Gibson speaks to John Masons bill about women prisons and claims there was a study that suggests trans women keep their natural criminal habits far after transition

He claims men are claiming to be women to be transferred to an estate to do easier time or to target women
"If a fox identified as a chicken would you put it in a hen house? Of course not."

- Kenneth Gibson
Mercedes Villalba intervenes to say that Kenneth Gibson is bordering on hate speech.

🚨Mega Thread🚨

For the past year the organising group between Scottish Feminist Network and other gender critical groups has been compromised. These screenshots from this are from these organising groups.

TW transphobia, anti choice rhetoric, Club Q shooting jokes and more.
Smaller gender critical activists details have been anonymised, however people in organising roles and leadership positions have not been censored.
Scottish Feminist Network & For Women Scotland are due to be holding a demo outside of Holyrood on the 21st of Dec to oppose the GRA reforms. But before then lets have a look at these groups and their members actually stand for.

🚨To all non-Scottish trans people & trans allies in the UK🚨

The Scottish Parliament votes on the Gender Recognition Reform Bill in less than 5 days. How can you help? Let me be blunt.

You need to email the Scottish Labour party.

scotland@labour.org.uk

Let me explain.
The bill itself is a bill coming from a cooperation agreement between the SNP and Greens. I'm relatively relaxed about the Lib Dems.

Gender Critical activists have most but not all of the Scottish Conservatives votes, the MSPs who rebelled previously and some surprises probably.
Recently Gender Critical Activists have been targeting Scottish Labour more than any other party. They do this knowing that their votes can dilute the bill or stop it entirely.

And this is where you come in, especially if you are a member of the Labour party or supporter.

So turns out For Women Scotland got asked some incredibly honest questions by Open Democracy journalists. How did For Women Scotland respond?

Well strap in for a thread about a totally normal response from a totally normal campaign group. 1. Can you tell me a bit about your three directors? What's
So let's start off on the first question what are the directors feminist experience?

Normally any activist would be proud to describe what they've done for the cause but For Women Scotland want to talk about broomsticks instead. Thank you for your hugely revealing question set about our s
Okay let's go onto the second and third question what about finances?

Well apparently now is a good time to make jokes about drug gangs, sweatshops and Putin apparently. Obviously funding comes from a mixed group of drug barons, s

Gender Critical activists can't seem to let a day go by without trying to shame me. Disappointed to see @Jo_Liptrott write about me in Graham Linehans blog.

My crime? Smirking when a witness said erotic cross dressers will apply for a GRC & for having a history of doing sex work
Not that you wouldn't expect such high quality feminism from Glinners website.

How do I know it's from @Jo_Liptrott? Because she forgot to switch to her alt.
I'm not ashamed of my history in doing sex work and my activism to call for new legislation to give sex workers increased workers rights and safety.

I did sex work when estranged from my family to afford healthcare, get through uni and afford food and a place to live.
