DPP, Noordin Haji, wants 6 foreigners who were convicted last Friday for trafficking in Ksh 1.3 billion of heroin sentenced to life imprisonment and pay a fine equivalent of 3 times the market value of the drug. #HakiNaUsawa #StopTOC 
DPP through SADPP, Alexander Muteti, urged the Mombasa Chief Magistrate, Hon. Martha Mutuku, to impose such a sentence as a deterrence to both citizens and foreigners from engaging in such a trade.
The convicts include: Mohamed Saleh, Yakoob Ibrahim, Saleem Muhammad, Bhatti Abdulghafour, Baksh Moula and Pak Abdolghaffer. They trafficked 377.2 kgs of heroin worth Ksh 1.3 billion and 33,200 liters of heroin, worth Sh189 million.
Assisted by Senior Prosecution Counsel, Peris Bosibori, Mr. Muteti asked the court to take judicial notice of the youth hooked into drug menace. He further urged court not to have mercy on the elderly foreigners and ensure they pay the price of their crime.
The court heard that the accused persons deliberately engaged in the criminal conduct, endangering the country’s future generations.
Court ruled that the evidence and exhibits provided placed the foreigners at the center of the crime and found that the drugs were carefully concealed inside their ship which took detectives days to discover it.
Court further stated that the demolition of MV Amin Darya was irrelevant to the trial as it occurred after adequate documentation of the crime scene, drug seizure and testing.
Court also ruled that the collection and preservation of the evidence was done according to the law. Sentencing will be on 10th March, 2023.
