1. Here’s what you need to know before you demand a President or a Presidential candidate to amend a law(s) upon assumption of power.
2. Although he’s part of the Legislature, his role in the law making process is attenuated. The President assents to Bills passed by Parliament before they become law (enacts Bills into law-Acts).
3. The President only legislates under exceptional circumstances ie thru e Presidential Powers (Temporary Measures) Act. The regulations made in terms of e PPTMA are temporary ie valid for 6 months, shouldn’t be ultra vires e parent Act & the situation in respect of which they’re
4… promulgated should be dealt with as a matter of urgency.
5. So if a President is a legal purist, he won’t amend or seek to amend any law through the PPTMA as has been the case in Zim. He’ll make a proposal to his MPs should his party have a super majority in Parly. That’s why it’s imperative for parties to not only focus
6. On Presidential elections but also on parliamentary elections as well. Without a two thirds majority in Parly, the President would be harmstrung insofar as legislating is concerned.
7. Instead of entreating Presidential candidates to amend certain laws, our focus should be on voting for able parliamentarians from the Presidential candidate’s party that we think will effect the amendments we so desire.
