The Enron scandal was one of the 1st developments to bring the use of off-balance-sheet entities to the public's attention. The practice of off-balance sheet financing's come under increasing scrutiny after a # of scandals revealed misuse of the practice." investopedia.com/terms/o/off-ba…
Because Apple hides its off-books numbers in notes, instead of the tables, its hard to pin it all down - but here's what I was able to gather last night.
Combining just the off-books manufacturing, leases, and purchase obligations... Apple's squirreling away $108 Billion a year.
Off-balance sheeting is apparently supposed to be for items that are not a direct asset or obligation
Apple didn't start their off-balance sheet practice until around 2012, after Ron Sugar joined & took over the Finance & Audit Committee
I'm taking a compliance course & there's a big section on Enron
Apple also uses those SVEs/SPEs, mostly for their real estate projects: data centers, manufacturing plants, biogas sales, etc
How do I check if Apple's reporting their SPEs many fines on the parent's balance sheet?
Like, in Dec 2016, 2 of Apple's hazardous waste facilities were fined $450k by the Cal gov
Apple had SPEs for the plants
How do I check if they noted the fine on the parent company's filings? Could they just throw it vaguely under "Accrued expenses"? sec.gov/Archives/edgar…
I think those Apple SPEs may be under this 'off-balance sheet' section
It expressly includes:
- equipment & facilities
- payments for supplier arrangements, internet & telecomm, & IP licenses
- capital assets including product tooling and manufacturing process equipment
- more
🧵 Recently, I've dramatically changed my perspective on the entire concept of 'whistleblowing' (much more on that later), & perhaps the biggest take away for me personally, is a new clinical view on how to track the efficacy of a person's attempt to blow the whistle.
Thread ⬇️
Efficacy can be evaluated based on whether the person's disclosures led to the termination of the misconduct in a reasonable time
This can be see in:
1) an investigation into the subject of the disclosures
&/or
2) the exposed institution changing their policies or procedures
There's much fanfare these days about 'whistleblowers' & I realized that as I was thrown into the midst of that chaos, I lost sight of the exit criteria for my project. I struggled to track the efficacy of my work.
When I stepped back, I was incredibly proud of what I achieved.
🧵 "#Apple protects the privacy of its users? Not that of its employees-guinea pigs. @ashleygjovik can testify: she was fired for speaking out. With confidential documents to back it up, she reveals an appallingly toxic corporate culture."
@oliviertesquet@Telerama "At the beginning of her story, which begins like a remake of Erin Brockovich, the toxicity is actually quite literal: in early 2020, she becomes seriously ill & discovers that her life at Apple is built on California soil laden with carcinogenic solvents"
@oliviertesquet@Telerama "She notifies her hierarchy, asks for tests. Insistent. Persistent. She is asked to keep quiet. On an internal Slack channel, she gathers the anger, finds a purpose: 'I became a revolutionary when I understood that they didn't care that we could die'."
