SORRY STATE OF AFAIRS IN INDIAN JUDICIARY..
🧵
Yesterday, at 8 PM, a special bench of, our Supreme Court held a sitting to hear a matter, suo motu..

1/16 Image
The cause of action was this..👇
One judge J. Gangopadhyay of, Calcutta High Court had given an interview to a local TV channel about a case concerning Abhishek Banerjee before his bench..
J. Gangopadhyay directed the Secretary General of the Supreme Court to submit report+

2/16 ImageImageImageImage
+and some documents pertaining to the SC's order of reassigning matter pertaining to Primary Teachers' Recruitment Scam, which were heard by his bench..
The main reason behind this order of reassignment from SC seems to be J. Gangopadhyay's interview to a local TV channel..

3/16
The Supreme Court in its' suo motu action, stayed the order of J. Gangopadhyay, primarily on the ground of judicial discipline.

4/16 ImageImageImage
If giving interview to a TV channel and talk about a case, which he was hearing in his court and, which was not finally adjudicated was judicial indiscipline, then a precedent had been set by the #CJI J. Chandrachud himself..
In #IndiaTodayConclave on 18th March' 2023+

5/16
+ he made some comments on a matter related to appointment of Advocate Saurabh Kirpal as a Judge in Delhi HC..The #Collegium led by J. Chandrachud had reiterated recommendation to appoint him as a judge of Delhi High Court, in January' 2023..Union Govt is processing this+

6/16
+reiteration from the SC #Collegium..Yes, that reiteration can be read on the website of the Supreme Court but, the question is, was it appropriate to discuss this in a TV channel interview?

Where was the judicial discipline, which normally one expects from the #CJI?

7/16 ImageImageImageImage
Now coming to a request J. Gangopadhyay made to Chief Justice of Calcutta HC & the Chief Justice of India in last April..In this written request, he had alleged that a lawyer had approached him to speak on behalf of an influential politician involved in cases heard by him+

8/16 ImageImageImageImage
What action did the Chief Justice of Calcutta High Court and for that matter the Chief Justice of India have taken, in this allegation made by J. Gangopadhyay in writing?

Indian public has a right to know, whether any action was taken by the Chief Justice of India?

9/16
There have been 3 instances out of which, in 2 instances the judges of the Supreme Court of India had abdicated their responsibilities without assiging any reasons..J. Anirudha Bose and J. Indira Banerjee recused themselves from hearing cases related to Bengal.

10/16 ImageImageImage
Did the Chief Justice of India seek explanation from J. Aniruddha Bose and J. Indira Banerjee, as to the reasons for recusing themselves from cases assigned to them?

Justice Indira Banerjee displayed professional misconduct in another important case too..

11/16
She has retired last September & enjoying pension/perks from tax payers money inspite of not doing her judicial duty.
Then #CJI never censured her for her Professional misconduct..Then or present CJI has not sought explanation from J. Bose, for recusing himself from case.

12/16
In her election related case, Mamata Banerjee who had lost against BJP's Suvendu Adhikari, from #Nandigram, had filed a petition in Calcutta High Court..Mamata Banerjee mounted pressure on J. Kausik Chanda in Calcutta High Court to recuse himself from hearing the case..

13/16 ImageImageImageImage
It can be seen from the above instances, both the Chief Justice of Calcutta High Court and the #CJI had turned a blind eye to judicial indiscipline and abdicated their duty of protecting constitution for, which they had taken an oath at the time of assuming their offices.

14/16
Finally, how can one Constitutional authority talk to another Constitutional authority in such intimidating tone & langauge? This is a tapori language used by goons in the underworld..
AG addressed J. Kaul as 'our lordship' & in response J. Kaul addressed him as 'Attorney'

15/16 ImageImageImageImage
AG -Attorney General of India..He is the highest law officer of the country...A Constitutional authority..He has to be addressed respectfully.

The following👇 are all other examples of Judicial INDISCIPLINE..No action has been taken by the #CJI on any of these statements.

On Monday, 29th March' 2023, a Supreme Court bench, comprising of J. Joseph and J. Nagarathna, was hearing a Contempt petition in a matter related to #HateSpeech .
Going through the proceedings, one could clearly see, J. Joseph's hate and prejudices against the Hindu community..
Well, this was not the 1st case where J. Joseph's bias and prejudices against the Hindu community were on full display..And, this won't be the last case..This will continue till he retires..His bias against the Modi govt is well established..
🧵 on
I) J. Joesph's hate and prejudices against Hindu community, during the proceedings of this Contempt petition against #HateSpeech .

II) J. Joesph's antecedents, controversy surrounding his elevation to the Supreme Court, support by Left liberal cartel & Congress.

On Wednesday, I perused the proceedings in the Supreme Court, as regards Shiv Sena's matter..

I must say, I was shocked to observe #CJI J. Chandrachud's aggressive questioning against then Governor of Maharashtra..

1/22
He appeared to be more angrier on the Governor than Uddhav Thackrey himself, for fall of #MVA govt.

To me, it appeared as if, his sympathy rests with Uddhav Thackrey.

Through this thread wherein, I will post screen shots of court's proceedings and analysis.

2/22
*Background of the crisis*

From around 22nd June, Shiv Sainiks started destroying, properties of rebel MLAs as well as the independent MLAs who withdrew support to Uddhav Thackrey government..The instigation for this violence was made by Sanjay Raut, trouble shooter of UT.

I am a passionate student of law..Therefore, I take keen interest in court proceedings especially, proceedings in the Supreme Court of India..
In recent times, a few judicial proceedings/orders/judgments have shocked me to the core..
I have studied many of this judicial proceedings/orders/judgments, deeply..What I found was that CJI J. Chandrachud and J. Joseph have dealt with the celebrity lawyers vis-a-vis, not well known lawyers differently..
I am now going to post a series of threads on a few judicial proceedings/orders/judgments of recent times.

About 10 days back, I read this news..My initial reaction was that of shock and disbelief..I thought how can men, who committed horrible crime against Bilkis Banu, be set free?

In my personal opinion, rapists and murderers must never leave the prison..

1/20 Image
I was wondering how could Gujarat govt release these prisoners? Therefore, I decided to find out the reasons, which led to early release of these 11 prisoners.

While going through this excerpts, I decided to get hold of the SC judgment which triggered this release..

2/20 ImageImageImageImage
I found the Supreme Court judgment, which ordered the Gujarat Govt to consider the application of remission by one of the petitioners who had completed more than 15 years jail..SC order specifically asked Gujarat govt to consider remission on the basis of its 1992 circular.

These observations are an attack on sovereignty, integrity, democracy, Constitution and indeoendent judiciary of India.
Without going through the legal processes followed by the Supreme Court of India and the Government, you are making irresponsible comments..This doesnt suit you
@FredDavieUSCIRF @USCIRF please go through the Supreme Court of India , which upheld the plea of one off the Petitioner who had already served 15 years, 4 months of his, Life Imprisonment term..Read well reasoned judgment..

Different strokes for Different LAWYERS in the Supreme Court of India..
👇
A thread on different standards adopted by Supreme Court judges in petitions involving severe implications for the petitioners.

1/8
Yesterday, rockstar J. Chandrachud, literally pleaded before Vrinda Grover, 4 times..Even though matter was not listed on board, he finally yielded to Vrinda Grover and passed an order staying coercive action against Mohd. Zubair..J. Chandrachud showed remarkable urgency..

2/8
However, the same SC judges including J. Chandrachud did not show such urgency in a petition filed by a Muslim woman, Benazeer Heena and; in the process destroyed her marriage irrevocably..SC refused URGENT hearing inspite of looming danger of divorce on the petitioner.
