If IAS officers are required to learn the language of the state where they are posted, why isn't judiciary?

It's a travesty that Bihar High Court does not allow Hindi in Patna because milords can't stoop to learn it. Can these lords ever provide justice to the common people?
Does the Court exist for the convenience of the judges or for the convenience of the people? Time of lords is over.

They either learn the language or get interpreters for themselves at State expense. Not force people to speak in the lord's language.

The untouchability due to #EnglishApartheid affects the common man today more.

State systematically denies access to higher education, courts and so many opportunities using this. It is legal apartheid, but no FCRA-NGOs will protest. Guess why not?

And it persists due to this kind of attitude.

Why? It's a democracy, not colonial rule. The state exists to serve the people, not vice versa.

This is the kind of #EnglishSlavery some Indians carry.

1. Apparently Japan, Korea, China, Poland, Germany, Italy etc are not urbanized. Because "urban"=English.

2. Nor do any of these have law courts, because justice=English.

How to educate these?

You know why?

Because the British India Act of 1935, passed by British Parliament with no Indian representative, said so. We just copied most of it into our "new constitution."

Why do we say India became independent? It isn't.

This is where article 348(1) of the Constitution comes from, which mandates English in High Courts.

From a law passed in British parliament in 1935 to govern India. Independence?

And you think the making the language English doesn't deter cases to be filed. Or doesn't have a cost?

Calculate the translation cost for a court vs making every citizen fluent in English. Which one is more expensive?

English supremacy is preserved by absurd arguments like this.

Does a judge get posted to 27 states?

They just need to learn the state language they are posted to. And if they can’t do that, state should arrange interpreters for them, not force a billion people into English.

In colonial intellectual discourse in the absence of "rule of law" there is "jungle raj." What's the worldview behind this?

In Christianity, man's natural state is of a sinner. Nature is to be subjugated. Nature consists of "base passions" that are evil.

"God" gave commandments to fix man. In the natural state, man is a beast.

This is the worldview of Abrahamism. Their "god" is separate from nature, which is beastly.

"God's commandments" then get secularized to "rule of law" to keep the "jungle" (aka the natural state) away.
From the Eastern/Indic view, nature is not beastly.

The "jungle" is actually in a state of ecological harmony. Abrahamic modernity litters it with plastic garbage. That we want rule of law to fix.

Law is textual bureaucracy and regulation. It is riddled with loopholes.

They used the dead body of a girl and made her name as an international "cause" to target Dogras of Jammu in a fake case.

They paraded fake people as her parents on media. #Mufti sent a prior convicted police guy from Kashmir into Jammu to fake it—they don't want the truth out.
The fake case had already fallen apart when the boy accused by the police was miles away in a different city, recorded by ATM camera.

The "evidence" against the others was equally a sham. The judge is currently under a corruption investigation.

As @madhukishwar points out, the case is so absurd, a D-grade Bollywood script writer could do better.

They named the victim, illegally, so they could make this a "Hindu"-"Muslim' thing and do to the Dogras of Jammu what they did to Hindus in Kashmir.

Most Indian degrees BA/MA are worthless. They teach nothing, one learns nothing. What useful things has a BA in Political Science or an MA in Sociology learnt that will help them in their life? If anything it can create more deracination and dumbness.

Absolutely, the biggest axis of discrimination in India is English discrimination.

It is official structural discrimination that is enforced by the colonial state from top down.

It translates into societal discrimination where people are judged on spoken English "accent."
While you will find thousands of books and research papers on "caste discrimination" guess how many of these Indian academics study English-based discrimination which is the biggest axis of discrimination in India today?

I could hardly find any while writing my book. Guess why?
In 2020, one paper. 😏 Nearly 2 decades after my original article.
