So how did they get a patent for a cancer drug that they have never published on, unless they purposefully withheld that finding from the public who fund them?

An assumption here could be that Smythe has been working under public funding, discovered a useful cancer drug, and withheld it from the public so that he could sell it under patent.
I'd like to know if that's an incorrect assumption
