Civilians can be tried under Army Act & Official Secrets Act, here’s how:
1. It is within authority of any Armed Forces personnel to effectuate the arrest of any individual who has violated the Official Secrets Act of 1923.

2. The Official Secrets Act of 1923 holds jurisdiction over all citizens of Pakistan as well as those who are employed by government. Under the Official Secrets Act, both private citizens and government employees are held to the same standard in case of violation.

3. Violation of the Official Secrets Act, 1923 is punishable by imprisonment from three years to death.

4. Proceedings pertaining to alleged commission of offences under Official Secrets Act of 1923, with regard to Section 2D(ii) of the Army Act of 1952, are exclusively within the jurisdiction of the army and civilian courts are not authorised to conduct trials in this regard.

5. In 1966, under the rule of military leader Ayub Khan, an amendment was made to the act whereby civilians accused of inciting mutiny within the rank and file through written and verbal material, could be tried under the act.

6. Moreover, in 2021, Peshawar High Court rendered a decision wherein it was declared that the civilian in question shall be subjected to court martial on account of having committed a breach of the official secrets act.
