#ClimateLitigation developments in Australia: Uncle Pabai & Paul, First Nations leaders from the Torres Strait, are taking the Australian Govt to court for its climate failures. They're asking for a court order requiring the Govt to increase its climate mitigation efforts 🧵 
1/ This legal action, supported by @GrataFund, is a historic tort law case against the Australian Government, targeting its failure to protect Indigenous communities - who live on low lying islands in the Torres Strait - from climate harm.
2/ The case has been brought by Uncle Pabai Pabai and Uncle Paul Kabai who will argue that the Australian Government has a ‘duty of care’ to protect their island homes.
3/ They are seeking an order from the court that will require the Government to do its part to prevent the harm by reducing GHG emissions, in line with the best available science.
4/ As of right now, with a 43% reduction target by 2030, Australia is on track for a temperature rise of more than 2 °C. However, experts say that reduction should be closer to 74% by 2030. An order from the court would require drastic and immediate action.
5/ The islands that Uncle Paul and Uncle Pabai live on, situated around 4 kms south of PNG in Australian territory, are about only 1.5 metres above sea level. People living in the Torres Strait are confronted by the impacts of climate change on a daily basis.
6/ As Indigenous people, the Uncles and their communities have deep connections to the islands.
Uncle Pabai and Uncle Paul noted that if they are forced to be Australia's first climate refugees, they will lose their motherland, their identity, and culture: in sum, who they are.
