#TinaPetersTrial: It's on like Donkey Kong! Yesterday we heard Opening Arguments, and today evidence and testimony will begin. "Will be wild!". One thing about Tina delaying the Trial 3 times plus her failed appellate efforts is that prosecutors had a long, long time to prepare.

#TinaPetersTrial: Tina Peters said Hayes told her he was a government informant. BUT gov't says he was not. Defendant said she relied on this (false) information. Judge: Misleading, confusing, doesn't support a conclusion.

#TinaPetersTrial: If she was trying to protect Hayes' identity, it doesn't change her actions & makes no sense. No mention of this false information about Conan Hayes alleged "government informant" status will be allowed.

#TinaPetersTrial: Peters' attorney Offer of Proof: After Peters requested help from county assistance IT, she had concerns about Dominion in Antrim County (!). Brings up yesterday's prosecution opening about no public viewing of the "trusted build" because of COVID, threats, etc.

He says Peters couldn't make a backup but needed someone else. She makes the choice 5/13 to have the "Mercenary" Conan Hayes do the work. Represented to her that it was within her power, like a drug sting, to not compromise other investigations he was doing. "Her state of mind."

#TinaPetersTrial: Peters' attorney trying to say that because Tina believed Conan Hayes "had to be kept confidential" because he was a Fed, that's why she did all these crimes. To conceal his identity. He said he has testimony Conan Hayes WAS a Fed. So she didn't have mens rea.🔥

#TinaPetersTrial: #TinaPeters is back in the courtroom. Unsurprisingly, her attorney from yesterday is not speaking today, it's (Mr. Hartman?). One juror knows Ms. Bishop from the past (didn't know until seeing the photo). Lawyers will ask if that will affect her judgment.

Judge Barrett reiterates NO MENTION of Conan Hayes alleged gov't relationship can be discussed. Peters saying Hayes said he was a Fed, lawyers have witnesses & that's why she did this, protecting his identity. Judge not buying - confusing & fails on fact and law. #TinaPetersTrial

#TinaPetersTrial: Noon EDT: Brief recess while Judge Barrett goes into chambers to review a filing made this morning. Then we'll have the first witness! 🎉

#TinaPetersTrial: 12:12pm EDT: And we're back! The People of the State of Colorado v. Tina Marie Peters, District Court Judge Matthew David Barrett presiding. Prosecution will introduce their first witness.

#TinaPeters lawyer Mr. Hartman, to the irritation of the judge, wants to rebut the written filings. Judge said briefings are enough. Hartman is reading from the election manual. Judge is not happy & admonishes him because he's wrong. He keeps going...

Prosecutor is trying to object, judge lets Hartman continue. Judge says he's wrong, curtly: "Thank you for making your record please sit down" 🧨 Judge blows him away because Colorado 15621(3) overrides what Hartman read Another terrible start for defense. #TinaPetersTrial

#TinaPetersTrial: Judge is clarifying: Case is about #TinaPeters statutory duty and that's where she failed and is allegedly criminally liable. She DID NOT follow commands. He DENIES the Defense's Motion. Irritated defense wasted time. Bringing in the Jury.

#TinaPetersTrial: First Prosecution witness takes the stand: Chief Investigator for the District Attorney's office in Mesa County, CO, James Cannon. Reviewing his credentials. He leads a team of five.

#TinaPetersTrial: Cannon works with Election Clerks... Defense admonishes Peters, "please turn your phone off" (it was beeping, oy). Cannon worked with Peters' staff with respect to investigating ballots that had issues.

#TinaPetersTrial: Cannon: We get maybe ONE voter fraud ballot per year. (Makes Peters look foolish)
Defense: Objection
Judge: Overruled.
Prosecutor: 8/9/21, what happened?
Cannon: Breach - Video of May software upgrade, was filmed, clipped & posted online along with passwords.

#TinaPetersTrial: Cannon opened a criminal investigation over breach since passwords on a computer screen & video with voices altered were online. Mesa uses a specific camera system with retention, in Aug, knowing 90 days since May upgrade, hoped it was there... VIDEO WAS GONE.

#TinaPetersTrial: Video did not exist, looked for other video, their retention was lower & gone. Alias "Code Monkey Z"'s name associated with the material leaked online. Cannon approached Dominion to assist in a search warrant to enter the Peters' office, he wrote an affidavit.

#TinaPetersTrial: 8/10/21: Search warrant was approved, 2 officers went to the Mesa County Elections Office. SoS team was there (admin inspection & designee, passwords etc). Belinda Knisley was present but in another area.

#TinaPetersTrial: Mr. Shapiro of the prosecution is showing an exhibit, video showing some of the walkthru at the election office. They enter the tabulation room (sorts ballots), customer svc area, where voting machines & servers are... Cannon was given keycard access via SoS.

Cannon: Facility manager Federico Vargas is the "keyholder" of all the swipes with their logs by door. Vargas provided a log for the week around 5/21.
Prosecution is introducing multiple pieces of evidence.

Defense waives foundation, stipulates, and all exhibits are admitted and published. First is phone list of election office employees (they'll all be photos from his video). Paper entry & exit log (hand written). 2 ways to confirm: paper log or keycard. #TinaPetersTrial

Cannon's interest was in May 25-26 2021 around the "trusted build" and who went in during that time. Danny Casias (sp) does the software upgrade for the state, he was there. 3 Dominion employees also signed in. These were authorized people for the confidential "trusted build".

Cannon is showing more photos from the election office: PCs, servers, office equipment. Defense stipulates and approves and exhibits continue to be allowed to be admitted & published. #TinaPetersTrial

Cannon's next exhibit: Tina Peters desk. #TinaPeters looks on as her desk is shown in the courtroom.

Handwritten notes were found on Tina Peters' desk with the names "Crazy Monkey Z" (missaying Code), Mike Lindell, Shawn, Gateway Pundit & passwords! 🔥 Also an election order was on her desk. #TinaPetersTrial

Prosecutor: Did you know about Gateway Pundit?
Cannon: It was a conspiracy website, they had some of the confidential materials.
(Appears we'll be hearing a lot more about GP's role in the crimes and conspiracy.)

Mesa County Investigator James Cannon used Belinda Knisley's phone to call #TinaPeters, with his phone recording. Here's Belinda. They also admit the recording audio of the Peters call, along with a transcript. 😨

As you can see, the video feed isn't capturing the exhibits on the screen very well - will ask the pool network to ask the court about reducing the light level.

#TinaPetersTrial: Now playing the recorded call with Peters... Peters is alarmed there's a search warrant. Peters: From who? Cannon: Somebody was alleging videoing the trusted build & a list of passwords was taken & on the internet. Peters: Isn't that usual?

Cannon: Not if somebody stole then & put them on the internet. Someone in that room was recording how you navigate through the menus, put that on the internet, and a screenshot that the SoS is telling me of the passwords. Why would they take a pic if they already had them?

#TinaPetersTrial: Peters: The SoS has been trying to get me out of that office for a long time so... Cannon: Um, well it could be a criminal act taking pictures in your office of your machines, right? Peters: They can't access those machines unless remotely.

They can not access my machines unless physically there with 2 passwords. Cannon: We think this occurred during last software update, the video & passwords were congruent during that time, leading one to believe that someone there for that update took a picture of that laptop.

#TinaPetersTrial: Tina Peters: That sounds preposterous... but is it criminal? Cannon: Yes. It's illegal to affect cyber security. Peters: I don't like how it happened, they could have called me, we're getting threats over the SoS press release. Cannon: All my material is sealed.

Peters: Allrighty, I was going to be out of town, what do I do? Cannon: County folks. Peters: Camera on and off 30 days. I don't trust them, if they're trying to frame me... Cannon: Here's the deal: I'm not an expert, as a peace officer I can bring in a civilian expert.

#TinaPetersTrial: Cannon: Since somebody had those passwords, somebody could change bios passwords and lock you out. Peters: It's not an election, this didn't need to happen now. Belinda, record everything while I'm gone. Belinda: I can't record because an active investigation.

#TinaPetersTrial Cannon: I have a list of people in the room 5/25 Peters: I'm boarding a flight... this is really upsetting me, I'll get back to you. I want one of my staff there, I don't trust... Belinda: They've been there. #TinaPetersTrial

Prosecutor: Did you know where Tina Peters was flying off to?
Cannon: Yes. South Dakota.
(DUN DUN DUNNNNNNN! South Dakota was the location of one of Mike Lindell's Cyber Symposiums.)

Now moving to Gerald Wood. Cannon executed a search warrant at his home, Wood wasn't home. On 8/12, Cannon learned not only video & passwords, but DISCS HAD BEEN COPIED! Next day, another search warrant executed at the election office. Election worker called, sounded panicked.

Mesa County Election worker was initially scared for her safety, Stephanie Wenholz (NOT involved in the conspiracy) didn't want it recorded. They got a witness to hear the interview. Wenholz was front office manager. Winholz reported to Bantz.

Cannon: Once I learned the hard drives had been copied, I returned to Elections Office and changed passwords so nobody could access.
Could not interview Sandra Brown, she was in the room, on logs... she said she'd cooperate but then ghosted.

Cannon: Heard the name Conan Hayes, and that the copies were mailed to Hayes in Florida. He wasn't a resident of FL, he was CA. 8/31 I reached finance office & found a shipping label with expense to Hayes. Kelly Bryant was connected with that package.

Cannon is explaining the org charts for the Mesa County Election Office, Colorado Secretary of State, and personnel from Dominion Voting Systems. Prosecutor is confirming many of these people are testifying.

Prosecution leaves a cliffhanger: What did you do next? Cannon: More search warrants and affidavits.
Prosecutor is finished for now, will recall. Now defense. Attorneys approach. Judge said they'll stop promptly at noon local time (2pm EDT), 20 minutes from now.

#TinaPetersTrial: Defense, again, stumbles out of the gate. Multiple objections, The defense is questioning witness about what was in the opening statements. Judge: The scope of testimony is ONLY what was brought up on direct. Gosh again.

Defense: Do you have a stake in the outcome?
Cannon: I seek the truth.
Defense is trying to imply that Cannon didn't like Tina Peters, asking about what interactions he had. Cannon was there for auto fraud, other crimes.

Defense: You said on 8/9 you had a call. In the call, you discussed a press release. Which first? (Confusing!)
Cannon: Heard about the press release, had the election Order, not sure.
Defense won't let it go. Cannon: I was aware the Order was public, not sure about press release.

Cannon: #TinaPeters' "excuse" for closing election office 8/10 was threats. I didn't believe.
Defense: Did you seek out Belinda Knisley? Cannon: I found her.
Defense asks a confusing question about chain of custody of the Election Management System. Cannon doesn't know details.

Defense: Do you remember hearing in a hearing that the making of a video is not illegal?
Objection! Judge: The charges are what they are. Legality of it is irrelevant. Overruled.

#TinaPetersTrial: MULTIPLE sustained objections to Defense's cross ex. It's noon, he wants a couple more minutes. Defense is asking complex, technical questions to determine if specific things are crimes. Ex: Do you know the rules on cameras?

Cannon: They have to be on x days before an election. Defense: How long must they be retained? Cannon: I don't know.

Defense Counsel makes his record: Stipulation made making & releasing of video & images not illegal, but prosecutor implied they were. I need instruction or stipulation on these points. Judge: What evidence? It's just points. Intrinsic to this crime, not 404b.
