⚖️ Here are some of the folks who may testify in #TinaPetersTrial. Only people in yellow were part of the alleged #TinaPeters conspiracy. Sandy Brown & Belinda Knisley, as part of their plea deals, will be testifying. We don't know when.
⚖️ 8:50am Local/10:50am EDT 8/2/24 Day 3 LIVE FEED for the #TinaPetersTrial started! NO AUDIO YET. Audio is only during the Trial. #LukeCrew, thanks for joining me & for your great comments & article links, I'll post them in the thread when possible. Here we go!
⚖️ 9am Local/11:00am EDT: We're LIVE! Audio is on and the prosecution begins right away with BRANDI BANTZ, Elections Director of Mesa County. She's discussing her background. #TinaPetersTrial
Brandi Bantz works with the Clerk, they're a mid-sized county, but included with the big 10 counties. They don't have big 10 staff so everybody helps out for elections to run smoothly. She identifies Tina Peters. They begin talking about security, network specifically.
#TinaPetersTrial Bantz: Network security has YubiKeys (like 2-factor authentication) to log in to PCs. Election security stronger than her previous jobs. Sensitive info in secure areas with keycard/paper log. Admittance only with clearance by SoS, video. yubico.com/industries/pol…
Bantz is talking about the security of Mesa County's election equipment. Posters were up: No phones, recording equipment, etc. for security. Hard to see the exhibits on screen; sent a message to @KREX5_Fox4 to see if they can improve that with the court.
#TinaPetersTrial: Brandi Bantz reiterates Mesa County has paper ballots that are retained beyond the 25-month retention guidelines. Election deniers never seem to realize that most US voting jurisdictions use paper ballots -- the paper is fed into tabulators that count them.
The prosecutor asks Bantz if she was aware the "trusted build" was coming in 2021. They look at an email by Jessi Romero (8/1 witness) about access restrictions, incl background checks. Bantz testifies Tina Peters wanted people "with more experience" there. 🙄 #TinaPetersTrial
Tina Peters kept pushing for other people, Bantz contacted Dominion & SoS & answer was consistent: NO. She was in the 8/23/21 meeting where "theories" discussed made her "uncomfortable". Tina invited people to "trusted build" after we knew it wasn't allowed. #TinaPetersTrial
Maurice Emmer (attorney), didn't know him or Doug Frank. Sherrona friend of Tina's. Presentation about "voter fraud that took place & he can prove it", inflation of voter registration. Bantz detailed Mesa's accuracy processes (Dept of Health, Natl Change of Address, etc.).
Tina Peters invited outsiders to the "trusted build". Doug Frank said not him but he had a "team". Then Tina dismissed Bantz from the room. Bantz thought it was because she follows the law & it wasn't allowed. #TinaPetersTrial mesacounty.us/departments-an…
Belinda Knisley sent an email that it was MANDATORY for Mesa election workers to attend a lecture by Doug Frank offsite. Bantz was "very uncomfortable" being there, it's a nonpartisan office. Later, she wasn't at "trusted build", she was out of town as planned. #TinaPetersTrial
Bantz was looking for video camera security footage and was informed by Andrew in IT they had been instructed to turn them off by Belinda.
Later, when she learned there was an investigation, she called Tina who said "I know, I'll handle it" & hung up on her.
When Tina rolled into the office, she said forward everything to her and sent everyone home because of "threats".
Direct finished. Defense (Mr. Case?) begins crosses ex.
#TinaPetersTrial: Tina's attorney begins reviewing Brandi Bantz' alarm & actions -- sending 8 emails to the police, testifying to grand jury...
Did you dislike taking directions from Clerk Peters?
B: I wouldn't say that.
You didn't agree with her views?
B: What views?
#TinaPeters' attorney: Her views about elections
B: No, I'm interested in processes about elections.
What about Clearballot?
Objection. Relevance. Sustained.
Asks about Sherrona Bishop. Prosecution asks for bench conference.
#TinaPetersTrial
#TinaPetersTrial: While waiting - More on Dr. Douglas Frank, hardcore election denier on Lindell's payroll. Mike Lindell, America's Biggest Mark™, falls hook line & sinker for every grifter & charlatan incl Frank, Dennis Montgomery, Patrick Colbeck et al. latimes.com/politics/story…
Tina's lawyer: Do you know the difference between a Statute & Rule. Yes. The difference between a law, rule & email? Yes. What was Romero's email? (Gives Bantz the WRONG exhibit number.)
You emailed Romero about guests at "trusted build"...
B: I did not.
You asked Dominion?
B: Yes, our Project Success manager David.
You asked David if you could bring members of the public in. David handles tech issues, right?
B: One of them.
You didn't hear back?
B: He said it wasn't his area.
Then Romero sent an email public wasn't allowed at the "trusted build".
Peters wanted people who "knew computers" to be present. True?
B: Yes.
Peters told you she wasn't expert enough to understand the "trusted build" & wanted an expert.
B: Yes.
You said the equipment is not connected to the internet, not an expert?
B: Not an expert, but not connected.
Are experts you rely on from Sos?
Objection. SUSTAINED.
Tina's lawyers keep looking for laws or statutes that prohibited outside people from attending the "trusted build". Another SUSTAINED Objection.
#TinaPetersTrial
Re cameras 50 days before / 30 days after an election: The "trusted build" 5/25, 4/6 was municipal election?
B: Yes, 4/6 is my birthday! Municipal law is different vs. county law. 5/6 was 30 days after so cameras could be off?
B: I'd have to look at municipal law.
Aware of any rule in effect 5/24 to keep cameras on?
Just policy.
So not a crime?
I don't think so.
Now logic & accuracy testing. Public notice/attendance?
Yes, 7 days before.
Do they need a keycard?
B: Not issued but they have to sign in a paper log. Required by law, a record of everybody entering that room.
Test ballots tabulation for accuracy?
B: Yes.
Some mismarked to see if the tabulator picks that up?
B: Yes.
Tina Peters' lawyer: So it's not forbidden by rule or statute to have the public at the "trusted build"?
B: Correct.
Then risk-limiting audit details, it's a % of ballots. Lawyer incorrectly asks about hand counting (they aren't).
Public can be at audits?
B: Yes
#TinaPetersTrial
Tina Peters' lawyer: It was Tina Peters elected job to "protect" the voting system? Yes.
Didn't Cody ask for an audit... Objection! SUSTAINED.
Is it true that Peters was concerned during trusted build they might delete the QR code?
B: Not aware (not in the whole meeting).
Can the scanners show who's winning and losing?
B: No.
Are you sure?
B: Not to my knowledge.
Did you ask Dominion?
B: No.
Defense counsel asks for a break.
They keep stepping up to the election denier line. Judge Barrett said NO to that but they keep trying. Always shut down.
Thanks to @chrisd9r, background on #TinaPeters' lawyer John Case. #TinaPetersTrial
Just what they need at #TinaPetersTrial: More of this. A few days ago, Silver Spoons' Ricky Schroeder, who apparently owns property in Mesa County, Colorado, accosted GJSentinel journalist Charles Ashby. Then Ricky asked to, "preach his sermon".
I often ask people posting like this—if they believe in God's Will or Divine Intervention and things don’t go their way, doesn’t that mean the result IS God’s Will? They never seem to answer. #TinaPetersTrial
12:45pm EDT: Jury returns and we are BACK for Day 3 of #TinaPetersHearing. Cross ex with Brandi Bantz by #TinaPeters lawyer John Case continues.
Case approaches the witness with an exhibit.
12:45pm EDT: Jury returns and we are BACK for Day 3 of #TinaPetersHearing. Cross ex with Brandi Bantz by #TinaPeters lawyer John Case continues. Case approaches the witness with an exhibit, Dominion contract with Mesa County.
#TinaPetersTrial: John Case is talking with Bantz about the fact that the Dominion contract is not with the SoS (covered yesterday). Lawyers to the bench and that discussion is over.
Here's Brandi Bantz, she seems friendly, knowledgeable, and kind.
Same lines as yesterday about what is a keycard? What if you gave your hotel keycard to a family member...
Objection! Relevance. SUSTAINED.
Asking about what an election watcher is. Then: Election judges are bipartisan. No photos, talking to voters or admins, etc.
John Case goes back to Doug Frank's presentation at the Doubletree.
Did Peters take you out and pay for dinner? ⁉️
Objection! SUSTAINED.
Case: Did anybody ask you to change plans to be at "trusted build"?
Bantz: No
C: Not concerned?
B: No, others were there.
#TinaPetersTrial
Tina Peters wanted the public at the "trusted build" right? ...
Objection: Asked & answered. SUSTAINED.
Cross ex done. Redirect.
Ms, Drake: Do you know any reason why the cameras would be turned off?
Brandi Bantz: No.
No further questions. Excused.
#TinaPetersTrial
Next up: Prosecution examines Lhana Jordan, IT Operations Manager for Mesa County since 2014. She oversees systems, security protocols, elections department. Network connectivity, infrastructure, some software. They don't do anything with election equipment, that's Dominion.
Tina Peters asked Jordan to find election staffers 2 Rs, 2 Ds or Is to be present at the "trusted build".
J: Tina called & wanted to be sure nothing unusual will be happening. But because of threats, they weren't allowed. I don't know affiliation of my staff. Also Memorial Day.
Belinda Knisley sent Jordan an email about the "trusted build", about participating in the build (we didn't, don't have the expertise), watching Doug Frank's embedded video, and attending Frank's presentation (she didn't, she had "no interest in that").
For the 1st time ever, Belinda asked about the cameras being turned off a week before the "trusted build".
Direct finished. Cross ex by John Case:
Case: You asked your boss if it would be OK for cams off? Did you think it might be illegal?
Jordan: I don't know.
Case: It wasn't illegal to turn off the cameras, was it?
J: I don't know.
C: When Peters asked on 4/19 to provide IT employees (there were 19 at that time, 25 now) for "trusted build", she said they didn't want anything "unusual" to happen, right?
J: True.
C: And it's her responsibility right?
J: True.
C: She said she wanted experts, right?
J: True.
C: It would have been legal for IT to be there?
J: From what Peters said.
C: You replied on 4/21 after meeting the county attorney?
J: Yes.
#TinaPetersTrial
I like Lhana Jordan a lot. She's chewing gum and not taking trash from John Case (she's corrected him several times). She's the kind of no-bullsh*t IT professional I hired and worked with.
Jordan told Case they didn't work with Dominion equipment. Case goes down long hypothetical: Couldn't you have asked for training from Dominion since month away? No.
C: Not to "beat it again", he does: Legal to turn camera off?
J: We rely on elected officials to know the laws.
C: If your IT people were there, we wouldn't be here would we?
Objection! SUSTAINED.
Redirect.
Ms. Drake: On hypothetical about learning Dominion machines, why didn't you suggest?
Liana Jordan: We never worked that equipment.
Redirect done. Jurors have Q's.
#TinaPetersTrial
Juror Qs:
Could IT have prepped for "trusted build"? I don't know.
Other vendor software IT doesn't handle? Yes.
Ms. Drake: Who requested cameras off?
J: Belinda & Peters.
Lhana is finished. Next witness: Ms. Moore.
#TinaPetersTrial
#TinaPetersTrial: Prosecutor Shapiro now questions Brenda Moore, now Chief People Officer at CMU (top 10 employer). Previously HR for Mesa County. Back to May-June 2021, any vacancies in Clerk's office under Admin Asst?
M: Yes, 1.
Discussing job. This is identity theft area.
5/13 Moore received voicemail from Belinda to create badge. 5/14 followed up, said it would be Gerald Wood. What did you know about Wood?
M: He'd be working on IT equip.
S: Unusual requests?
M: Badge clone access of Sandra Brown's (she was 1 of few allowed on election equipment).
Unusual to make badge for non-county employee, but maybe since outside vendor.
S: Did you have a way to know who was an employee? Was Wood ever?
M: Yes. Never. He was never paid by county gov't. Unusual, no onboarding process (usually hours of paperwork).
Shapiro is finished. Cross ex from Ms. Jones, who was Tina Peters' attorney for opening statements.
J: Ever meet or talk to Wood? M: No.
J: Even though not an employee, still issued a badge. M: Yes.
J: Ever meet or talk to Conan Hayes? M: No.
Cross ex done. Redirect. Did you know Conan James Hayes? No.
Jury Qs: All hires need to go through HR? Yes.
Elected officials must go through HR.
