Joe Biden is opening up a Special Enrollment Period for the ACA marketplaces. Here's a🧵on why this a BFD! 1/ whitehouse.gov/briefing-room/… 2/ Trump took many steps to sabotage the ACA and its marketplaces. He severely restricted the Open Enrollment period to just 6 weeks and then cut the outreach and advertising budget by 90%. Awareness of dates, deadlines, and options is already low, so this was a big problem.

🧵1/ In less than a month and just one week after the election, the SCOTUS will take up the health care repeal lawsuit. Senate Republicans are doing everything they can to dismiss, downplay, or run away from the consequences of this GOP lawsuit. So let's have some real talk. 2/ The legal theory underpinning the health care repeal lawsuit is completely bogus and it *should* have been laughed out of court. Even conservative legal scholars agree on this. But that's not what happened because the GOP has stacked the federal courts with right-wing judges.

The most important thing to know about what Chad Wolf is doing is that every single one of his official acts is invalid because he was unlawfully installed as Acting Secretary of DHS. Let me explain. 1/ Kirstjen Nielsen seriously messed up and amended the wrong section of the DHS succession order, as was her pregorative, when she quit and installed McAleenan, who in turn amended it again to install Wolf out of order. 1/ THREAD: We are expecting key filings today from the Trump administration, as well as Texas and its coalition of hater states, calling on the Supreme Court to obliterate the Affordable Care Act in its entirety. Here is what that means. 2/ If Trump gets his way and "terminates" the entire ACA, a new @amprog report out yesterday found that 23 MILLION people will lose their coverage. This is up from 20 million before the pandemic b/c people have shifted from employer coverage to ACA plans or expanded Medicaid.

1/ THREAD Trump confirms once again that he is all-in on demanding that the Supreme Court "terminate" the ACA in its entirety - in the middle of a deadly pandemic. Let's review exactly what that would mean. 2/ Public Health and Prevention Fund: GONE.

Requirement that insures cover preventive services LIKE VACCINES at no cost: GONE.

Protections for 133+ million people with pre-existing conditions: GONE.

1/ Trump tried to hide the ball until after the election, but he won’t get his wish now that #SCOTUS has taken the case. Marketplace tax credits and coverage for ~10 million people: GONE.

1/ Bloomberg has a must-read story out today on short-term, limited duration junk insurance plans that the Trump administration is promoting as an alternative to comprehensive ACA plans. The story highlights how bad these plans are for consumers. bloomberg.com/news/features/… 2/ First, they are called junk plans for a reason. While ACA plans are required to cover Essential Health Benefits, junk plans Deny access to basic benefits, such as prescription drugs, maternity care, and mental health and substance use disorder treatment.

1/ AG Barr has an op-ed in the WSJ today about nationwide injunctions with some *extremely* revisionist history, to put it kindly, about Trump and #DACA. Let's take a stroll down memory lane. wsj.com/articles/end-n… 2/ Barr claims that the nationwide injunction entered by a federal court in CA on January 9, 2018 "proved catastrophic" to efforts to find "a political compromise" on #DACA. The injunction (and similar orders from courts in DC and NY) required DHS to continue processing renewals.
