I am inside the courtroom for #BarryMorphew preliminary hearing ruling that will begin at 1:30 p.m. His family and attorneys have been seated. His daughters are sitting on the second row and his sisters/mom are on the third row. The judge has not entered yet. @FOX21News There is more Security today than the previous 4-day preliminary hearing. It is taking people a lot longer to get into the Chaffee County Courthouse. There are about 8 seats available for the public.

BACK IN COURT: #LeteciaStauch is on Webex and is waiving her right for a preliminary hearing for her escape case. The judge will come back on Sept. 23 at 9 a.m. to make a ruling. @FOX21News Judge Gregory Weirner said he has a ton of notes and wants to get it right. So he wants time to put it together. There are a lot of charges. There was much of the evidence that he hadn't heard before.

Agent Cohen said there was no evidence that #GannonStauch mom Landen Hiott was involved in the disappearance of Gannon. She was also out of state. #GannonStauch sister Laina was also not involved in the disappearance of Gannon, according to FBI Agent Cohen.

Exhibit 38: Photo of the masterbedroom the southeast corner of the home. A gun was recovered from this bedroom according to Sgt. Hubbell. It was found on top of the dresser. He said this is the room #LeteciaStauch stayed in. The gun is next to a teddy bear and a photo of #GannonStauch. The DNA taken off the trigger guard and backstrap matched #LeteciaStauch as well as two other men.

Corner of the carpet in Gannon's room was exposed to see if there was a saturation. A stain went through the carpet, through the foam and onto the cement. DNA was swabbed and matched #GannonStauch. His bed was removed that covered the stain. The carpet was stiff to the touch like it had been cleaned up. We are seeing a photo of #GannonStauch bedroom with the bed removed. There are pieces of tap covering the wall to show blood splatter marks, according to Sgt. Hubbell. There is also a stain on the mattress.

BACK IN COURT: #LeteciaStauch continuation of proof evident presumption great hearing. FIFTH WITNESS: Sgt. Rosario Hubbell with @EPCSheriff He has worked with EPSO for 14 years. He works with the Major Crime Unit and overviews the case as it unfolds. Sgt. Hubbell became involved in the case on Jan. 28 when Fountain PD asked if they needed assistance. He confirms this missing person report evolved into a homicide investigation. #LeteciaStauch phone had photos of #GannonStauch in bed. Exhibit 29-39

FOURTH WITNESS: Lt. John Sarkisian with @EPCSheriff was leading many of the searches for #GannonStauch from Jan. 31 - late Feb. Drones, 4-wheelers, horses, prodding poles, K-9's, any tools available they were using. At one point, Parks and Wildlife came out to use sonar. Some days 20-30 searchers other days over a hundred, according to Lt. Sarkisian. They had to use prodding poles because the snow was soo thick in the area north of Palmer Lake to search for #GannonStauch.

THIRD WITNESS: Sgt. Patrick Younkin with @EPCSheriff was one of the first LE to respond to the call for service in regards to a runaway on Jan. 27 at 6:55 p.m. He searched the home for #GannonStauch He first talked with #LeteciaStauch in the garage and then the first level of the home. We are now watching the body warn camera of Sgt. Younkin.

BACK FROM BREAK: Investigator Clark said that there was a warrant on the rental Nissan Altima. Also, #LeteciaStauch appeared on camera in an interview with @Spencer_WNews on Friday, January 31, 2020. The GPS tracker on #LeteciaStauch Aunt's rental shows the car went back to the area in Douglas County after an interview with the local TV station. The car was visible when Stauch was on camera.

Both the prosecutors and the defense attorneys have walked into the courtroom in El Paso County. Day 1 of #LeteciaStauch preliminary hearing begins soon. The family of #GannonStauch also just walked into the courtroom. #LeteciaStauch is appearing through Webex. The public was just let into the courtroom. @FOX21News

According to Grusing, #BarryMorphew said all he had left in his life was hunting. Barry had hunted since he was 7-years-old. "If I have to live this life without her, at least I can hunt." Agent Grusing said #BarryMorphew mentioned multiple times during the investigation that "This is in God's hand. He allowed this whole thing to happen."

Talk about Divorce: Agent Grusing said #BarryMorphew would tell #SuzanneMoprhew "I'm not discussing this, cause it is never going to happen." The state said, "It never did." Agent Grusing asked #BarryMorphew about him ever being physical with #Suzanne because one of the 50 grievances was just wrestled free. Barry said he never grabbed her or constricted her with his arms. She would brush up against her.

#BarryMorphew asked Agent Grusing if he could have immunity if he gave them his life up? Agent Grusing asked #BarryMorphew about the tranquilizer... when it was last fired? Nielsen is wanting on the record that the state should be asking questions and Agent Grusing should be answering, not the other way around.

Former FBI Agent Johnny Grusing is called back to the stand. Exhibit 96,97: Photos of the "chipmunk gun" The barrel is 7.5 inches long. #BarryMorphew handed the gun to Agent Grusing through the window of his vehicle.

NEW WITNESS: CBI Agent Kevin Coback. Field agent in Pueblo for 7 years. D.A. Linda Stanley is now asking him questions about #BarryMorphew employee Morgan Gentile. #BarryMorphew was supposed to pick Morgan Gentile up on Sunday night at 5:30 p.m. but didn't and called her around 11 a.m. to ask her to bring another worker to Broomfield.

Now they are discussing the marks on #BarryMorphew marks on his hands and arm. Eytan wants to know the measurements and Rohrich doesn't know because he said he didn't measure the three markings (fingernail injuries he had testified to). Eytan said when people disappear they don't always use their identification so if #SuzanneMorphew disappeared she wouldn't use her ID. When referring to Suzanne leaving her purse in the car.

Back on the record: Undersheriff Andy Rohrich is on the stand. #BarryMorphew took off his suit jacket and rolled up his sleeves. He tucked in his shirt when the judge entered the courtroom. Eytan is asking him about the sleeping bag found near #SuzanneMorphew bike. It wasn't tested for DNA. Undersheriff Rohrich suggested it could have flown out a bed of a truck.

Eytan is now cross-examining Undersheriff Andy Rohrich. She is asking if #BarryMorphew followed the deputy task when he entered the home. He agreed he followed the directions to go into the home and find a place where she is wearing something and points out Suzanne's clothing. Attorney Eytan is reminding the undersheriff that #BarryMorphew when he was first contacted by deputies that he was very emotional.

EXHIBIT 85-87: Photos of #BarryMorphew hands and arm with injuries. According to Undersheriff Rohrick, Upper left arm looks like there are fingernail injuries. 3 abrasions or cuts scabbing over. Outside of his hands were injuries in various stages of healing. Exhibit 88-92: Surveillance photos from Highway 50 at a Shell Gas Station, Salida Auto Sales, and home near DSI.

The state is asking the undersheriff about hunting. Asking if he knows when elk shed their antlers. Undersheriff Rohrich said they typically shed their antlers before March and that Bulls and Cows aren't typically together in May. #BarryMorphew preliminary hearing. Undersheriff Rohrich is now talking about tranquilizer darts and guns. He has used them for four years. Explaining how you use them putting the solution in the dart and then put it in the gun. He used them for vicious dogs when he was animal control officers.
