Several months ago, I opined on what I thought was an obvious point of law: since government can't violate a citizen's First Amendment rights, it also can't do it via a private sector agent. Today, a federal appeals court said just that:

THREAD: 1/ A reminder to colleagues in government #SocialMedia (via #GSMCON and other groups): the First Amendment still applies in a pandemic crisis. This means that you cannot delete/block/hide a comment on your agency FB page just because you believe it to be misinformation. 2/ This is true even if you posted a policy saying you can. BETTER APPROACH: Provide the correct information (with links to authoritative sources) in the same comment stream. Ask credible third parties to do the same.
