NEW: A legal battle is playing out in Alabama over the execution of Alan Eugene Miller.

It begins in 2018, when the state gave death row prisoners a short window in which they could choose to die by a never-before-tried method: oxygen deprivation. nytimes.com/2022/09/23/us/… Alan Eugene Miller, who was convicted of murdering three men in a workplace rampage, said he opted for that new method because he had become afraid of needles after a bad experience getting blood drawn in prison.

But Alabama said it never got his form. nytimes.com/2022/09/23/us/…

Introducing his interview with Kyle Rittenhouse — the first since he was acquitted — @TuckerCarlson says it's "hard to ignore the yawning class divide" between Rittenhouse, 18, who worked as a janitor and cook in high school, and "his many critics in the media." After Kyle Rittenhouse, then 17, fatally shot two people and wounded a third during destructive demonstrations in August 2020, he says his mom "wanted to go into hiding."

But, he says, "I said no, the right thing to do would be to turn myself in — I didn't do anything wrong."

Good evening from the Brooklyn Center Police Department in Minnesota, where I'm reporting on the third night of protests following an officer's killing of #DaunteWright.

A few hundred people are here and about 100 local police and National Guard troops are lined up out front. Police in Brooklyn Center, Minn., have just ordered people to leave in 10 mins, more than an hour before the 10pm curfew.

Both sides have been aggressive. Officers firing chemical spray, flashbangs and paintballs. People throwing water bottles and other things.

Roughly 100 people rallying in the middle of a street in downtown Minneapolis right now, waving flags and signs to NWA's "F**k tha Police."

The protest follows the 10th day of the trial of Derek Chauvin, the former officer charged with murdering George Floyd. A speaker describes the trauma that the trial has had on young people who witnessed George Floyd's death.

"The little girl said Derek had his knee on his neck," he says, referring to Judeah Reynolds, 10, who saw the arrest and testified last week.

• Police actions were the main causes of Floyd's death
• Floyd's drug use and severe heart disease contributed, but were not direct causes

NEW: Judge says he will NOT raise bail for Kyle Rittenhouse, the 18yo. accused of killing two people in Kenosha, who is currently out on $2 million bail.

Prosecutors had requested a $200K increase because Mr. Rittenhouse did not have his current address listed with the court. The judge repeatedly criticized prosecutors for asking for the increase. He ordered that Mr. Rittenhouse share his address with the court clerk and a sheriff, but NOT with prosecutors.

"We don't know where an accused murderer's at," Kenosha DA told judge. "I'm not OK with that."

I'm now in downtown Portland, where protesters were holding a calm rally at the Justice Center until the police ordered them out of the street over a loudspeaker.

More people poured into the street instead. Then the protesters burned an American flag, drawing more people -- and media -- into the street. #Portland
