🧵 Yesterday, the Polish Senate has unanimously adopted the Law on the Supreme Court with amendments. PiS senators voted together with the opposition which has the majority in the upper house. ⬇️ The Senate approved the bill with 14 opposition amendments. "We did everything to make this law constitutional, and if it can be constitutional, it should be adopted" – said one senator. ⬇️

Action announced by the Prime Minister Morawiecki to "finally settle the question of the relationship between EU law and the Polish Constitution" has just been published by the sham Constitutional Tribunal.

[THREAD] Members of the ruling camp and their responses to today's judgment of the Court of Justice in case A.B. and Others (C-824/18). ⬇️ Deputy MoJ Kaleta: The fact that CJEU acts against the Treaties and by violating PL sovereignty (by requiring to set aside the Constitution) does not mean the EU has suddenly acquired new powers not specified in the Treaties. Obvious "ultra vires" ruling.

Poland's action seeking the annulment of the rule of law conditionality is ready, learned @DGPrawna. The complaint was prepared by the MoJ and has just been presented to EU affairs minister for approval. It has to be lodged with CJEU before the deadline of 15 March.⬇️ In essence, Poland will maintain that the regulation aims to substitute Article 7 procedure(s) – a mechanism that is more difficult to be successfully applied – for a more easier tool based on EU secondary law, what violates the principle of the rule of law. ⬇️

Poland's Deputy Justice Minister @sjkaleta on #BVerfG: "Member states are the masters of the EU Treaties, this is what the German Federal Constitutional Court said today. Germans defend their sovereignty. The EU says only as much as we, the members states, allow it." /2 Member states won't allow the ECB to act as it did. This is why the German court ruled that the principle of proportionality has been breached [by the ECB]. This is of tremendous importance to the dispute about the rule of law in Poland.
