Tunisia’s draft constitution is out. As expected, it provides for an unbridled presidential system, with an omnipotent President, a powerless Parliament and a toothless judiciary

iort.gov.tn/WD120AWP/WD120… President can dissolve Parliament and appoint and dismiss the President and the members of the Cabinet. No checks are provided on his powers:

1. The draft does not provide for the legislative, executive & judiciary as equal branches of the state. They are mere functions

1. Decree 11 on the Temporary High Judicial Council (THJC) is out. This is how it effectively ends any semblance of judicial independence in Tunisia: 2. Decree 11 is purportedly based on the 2014 Constitution. The decree does not refer to any specific article of the Constitution, simply because there’s no article that authorizes the President to interfere in the functioning of the HJC. #Tunisia
