The First Amendment Profile picture
I am the First Amendment. I love to tweet about myself. Take advantage of me but please don't violate me. (Parody, obvs.)

I do not protect fraud or speech integral to criminal conduct. As I’ve said many times before, I protect many lies and speech does not lose protection based on falsity alone.

I see that I sparked some heated debates in my replies and quote tweets yesterday. The bad takes seem to fall into 5 categories and, lucky me, I found them all in a single tweet. So here we go… 1. Old Case Law / I’m Outdated:

Despite becoming the first and greatest amendment in 1791, I basically did nothing for the first 100+ years, and it wasn’t until the 1940s–1960s that I reached the level of strength that I have today.

The Supreme Court considers hate speech protected speech. It has confronted hate speech many times and repeatedly held that it was protected speech. Screenshot of tweet that says: “The Supreme Court doesn't Read up on precedent

Just because one member of Congress got it right doesn’t mean my work is over. It means it’s time for the replies…

There is no hate speech exception to me. Some Supreme Court decisions involving hate speech:

While I am not absolute, I protect against the government requiring Twitter to remove protected speech. That includes disinformation and misinformation. Government coercion of a private party to censor speech can violate me, which I explained more here:

I protect a lot of harmful speech.

A short thread Image One example of this is Snyder v. Phelps, where the Westboro Baptist Church picketed the funeral of a marine and displayed offensive speech. Image

I protect your right to speak anonymously. “An author's decision to remain anonymous, like other decisions concerning omissions or additions to the content of a publication, is an aspect of the freedom of speech protected by the First Amendment.” McIntyre v. Ohio Elections Comm'n.

Twitter has historically defended its users’ First Amendment rights when the government or others seek to unmask anonymous speakers. Look at how hard it’s been for Devin Nunes to unmask @DevinCow and @NunesAlt, for example.

My mentions are full of hot takes on this case so let’s clear a few things up.

A short thread:

1/8 First, I apply to civil lawsuits and I limit the ability to successfully sue someone for their speech.

No, we shouldn’t. I protect your right to speak anonymously. The government requiring proof of identity on social media would violate me. As the Supreme Court has said, anonymity is a shield from the tyranny of the majority.

I protect speech advocating for overthrowing the government. Advocacy of illegal conduct is unprotected only if it is intended to and likely to incite imminent lawless action. Image And it’s clear the framers wrote me “with treason in mind” since, before writing me, the framers narrowly defined treason elsewhere in the Constitution in a way that does not include mere advocacy: Image

I protect many lies. Although there are a few exceptions that cover narrow categories of lies, speech does not lose protection based on falsity alone. For example, in US v. Alvarez I protected the right to lie about receiving the Medal of Honor.

Happy Fourth of July, and to those not celebrating, I’m here for you too.

Freedom means you are free not to engage in shows of patriotism. You’re free to salute the flag. You’re free to burn the flag in protest.

There is no general “causes harm” exception to me. I protect a lot of speech that causes harm. From SCOTUS:

I protect disinformation. There is no general exception to me for false statements. From US v. Alvarez:

I protect you from the government, not from Spotify. That means I protect Joe Rogan’s podcast, the criticism of his podcast, the calls to cancel him and/or Spotify—from government action.

Nothing happened. I protect you from the government, not from Twitter. And I protect Twitter from being forced to carry the speech of US politicians. For example:

For those able and inclined to support First Amendment rights on #GivingTuesday, here are some organizations dedicated to First Amendment rights who would, I’m sure, appreciate any help you can give. A few points before I start the list, each of these organizations has a different focus, a different mission, a different political view, a different idea of what liberty looks like. I’ll leave it up to you to decide which are best or most deserving.
