A cohabitation agreement is a written contract used by an unmarried couple who are in a long-term relationship to set out their legal obligations and protect their rights.

Things the scribe should write on the lobola letter/agreement:
Date and time the families met

Address where families met

Names of each representative and which partner (prospective spouse) they represent & their ID numbers

How much lobola is expected

Return date (usually followed by exchange of gifts and a celebration of sorts)

Expectation of gifts for return date - what gifts are expected for the bride’s parents or groom’s uncle etc

Guys, please prioritize this if you are about to start lobola negotiations: draft your ante nuptial contracts BEFORE the negotiations take place. I cannot stress this enough. If you do not have the contract and the families finalize the negotiations then you are going to be married in community of property. Please avoid celebrating lobola negotiations and then waiting until your “wedding celebration” to sign/register the marriage.
