PRIMARY CONCERN
In order to declare as state of disaster the National Centre “must determine whether the event should be regarded as a disaster in terms of this Act”.
As such the disaster must comply with the definition of ‘disaster’ provided for in the Act.

My fellow South Africans,
As South Africans we have the privilege to live in a constitutional democracy.
We live in a society where we have fundamental human rights guaranteed by our Constitution.
Article 2 of our Constitution states that:
“This Constitution is the supreme law of the Republic; law or conduct inconsistent with it is invalid, and the obligations imposed by it must be fulfilled.”
Several allegations have been made that the Covid regulations are #irrational and therefore #illegal.
Please join me as we investigate your media statement from yesterday regarding level 3 regulations.

On 15 March 2020 a National State of Disaster was declared.
The declaration is invalid as it does not meet the criteria for a 'disaster' as set out by the DMA.
This declaration must be set aside and regulations consequently issued must be declared invalid.
The declaration stated:
"Considering the magnitude and severity of the COVID -19 outbreak which has been declared a global pandemic by the World Health Organisation (WHO) and classified as a national disaster by the Head of the National Disaster Management Centre,"
