Happy Labor Day! New York is a union town, and this Labor Day it’s especially important that we take a moment to appreciate everything unions have done in our nation’s history to fight inequality, expand the middle class, and produce a stronger economy.

(1/) It is also an opportunity to recommit to finally passing the PRO Act into law. The PRO Act will:

1) Make it easier for employees to form a union

SHORT THREAD: It appears that @ManhattanDA and Mark Pomerantz had a good faith disagreement about the strength of the evidence of a low-level felony against Trump — the type of disagreement that line prosecutors and their superiors have all the time.

There is a BIG difference between *knowing* somebody committed crimes and *proving* those crimes in court. The problem with this case has always been the evidence of Trump’s knowledge — it is not enough to say “of course he knew.” And Michael Cohen is a tarnished witness.

🧵After reading this story a couple of times, and from my decade as a prosecutor (including alongside @ManhattanDA), my deep knowledge of Trump/the TO from investigating both in Congress, and my understanding of Cohen from interviewing and deposing him, I have a few thoughts:

1/ 1) @ManhattanDA is correct to be very concerned about Cohen as his key witness. A good defense attorney will skewer him on cross, neutering his testimony and poisoning the rest of the case. He could be a fine complementary witness but he cannot be the central witness.

As I discussed with @maddow tonight, a few observations from today’s Trump Org hearing:

1) As I’ve been saying all along, it still does not appear that Weisselberg will cooperate, nor do I think Trump or any of his children will be charged. W seems eager to fight the charges. 2) Of note, the prosecutor referred to Weisselberg as the “boss” of the financial records at issue. Obviously we know Trump is the boss, but that is an indication that W is at the top of THIS scheme. This, without W’s cooperation, I don’t think Trump or his kids will be charged.

My friend ⁦@AWeissmann_⁩ provides excellent perspective on the Trump indictment. But I think there are some unique variables that separate this case from the organized crime or federal fraud cases he references. (Of course, only time will tell.) justsecurity.org/77369/how-to-r… First, Weisselberg already received immunity from the SDNY, and whispers were that he was unhelpful even if truthful. That may be one reason why the SDNY gave the investigation to the DA. But the prospect of him being cooperative in the grand jury seems unlikely to me.

A short explanation of my analysis of the Trump Org indictment:

1) the allegations laid out in the indictment are powerful, persuasive and backed up by a lot of evidence. The scheme was premeditated and blatant cheating over a long period of time. The indictment is impressive. 2) Weisselberg and the other unidentified employees referenced in the Indictment should be charged with these crimes. But this is not a typical case against a corp, even tho the heightened bar required to charge corporations is met. The consequences for the Org could be dire.

Some quick thoughts on the McGahn settlement:

1) McGahn testifying behind closed doors doesn’t move the needle much, because it will merely provide us with another transcript that we can read, similar to the Mueller Report.

2) Since Trump is no longer in office, McGahn’s testimony is mostly (if not only) relevant to a potential criminal prosecution for obstruction of justice. So there isn’t much to be gained by having him testify, particularly behind closed doors.

Lots to unpack about the Giuliani search warrants, which I will do with @NicolleDWallace at 4pm. But a couple of notes that aren't getting much attention: 1) I would bet a lot of $$ that the SDNY already obtained Giuliani's emails pursuant to search warrants, which helped provide probable cause to get these search warrants. They would have sent preservation requests to service providers so he could not erase his emails.

Short thread on impeachment witnesses:

First, let’s remember that this case had unusual and powerful evidence in the public record. If you are prosecuting a bank robbery and you have the surveillance camera footage, you don’t need witnesses to tell you what happened.

Second, the only areas where witnesses could help was confirming what the circumstantial evidence already showed about Trump’s knowledge and intent, both before and after the riot. Mgrs did great job of using his own tweets to show his knowledge but witnesses could confirm.

My quick take on the bribery-for-pardon judicial order:

1) There was a separate ongoing investigation that involved (likely multiple) search warrants that yielded 50 electronic devices seized. That’s a lot of devices, so I’m guessing it was an office that was searched.

2) upon reviewing these devices, agents identified separate crimes from those under investigation, incl a bribery-for-pardon scheme. They sought permission from the judge to search the devices for further evidence of that scheme. (SW’s are limited to specific offenses.)

Thread on “Russian disinformation.”

Recently @DNI_Ratcliffe asserted that Hunter Biden’s laptop is not part of a Russian disinformation campaign. But Radcliffe misses the point. It is part of Russia’s efforts to interfere in the election.

Let me explain.

This is what we know as fact:

1) Russia interfered in the 2016 election to help Trump.

2) Russia never stopped trying to undermine our democracy and to support Trump.

3) Russia is trying to interfere in the 2020 election to support Trump. Radcliffe’s own agency said so.

Latest ODNI election interference provides some more important detail about election interference but seems to (intentionally) conflate public statements from foreign countries (China/Iran) with covert malign influence efforts (Russia). They are not the same. 1/ After sucking up to Xi earlier this year, Trump has seemingly decided that making China the bad guy will give him an opening to blame China for his election loss. Let’s unpack this.

1) why should we believe Barr (or his lackeys) when we know that Barr lied to the public that Berman “stepped down”?

2) Berman was Trump’s pick for the job. Yet Berman has not been compliant with the Trump/Barr political playbook. 3) US Attorneys chosen by the President are NEVER fired 5 months before a presidential election. It’s laughable to assert that it was simply to make room for someone who was never a prosecutor or even a litigator.

4) Since impeachment, Trump has been on a disloyalty purge.

FINAL UPDATE (thread): My #COVID19 test came back positive.

I want to thank everyone for the outpouring of support. It means a lot to my family and me.

I am almost back to 100%. I’m lucky enough not to fall in the vulnerable category and, for me, it was just like the flu. 1/ My difficulty in getting a test despite the exact symptoms and a neg flu test underscores how shockingly unprepared this administration is to deal with this pandemic. In fact, I was told that NYC hospitals STILL would not test my wife — with similar symptoms — unless admitted. 2/

Let’s be very clear: unless you have pneumonia and traveled to one of 5 high-risk countries recently, you can NOT get a #COVID19 test in New York City. If you, like me, have a fever and a headache (but tested negative for the flu), you are unable to rule out #COVID19. Shameful. This is not New York City’s fault. There simply are insufficient tests so they are being rationed.

(And I’m fine. Just want to rule it out for my family, including three little kids.)
