The strategy was amazingly effective, and it's still being played effectively. He's not in handcuffs and the media continues to bury the lede. Maybe there's a lesson here for the industry?

The MSM needs to take accountability for its role in contributing to the legitimization and high status of this insolvent ponzi. Without the media's backing and the endless puff pieces, victims would not have been so trusting with their savings. Even now, they downplay the story. At the same time they were pumping the FTX scam, they were writing defamatory gossip pieces about industry stalwarts, driving their audiences away from safe, reliable and proven venues. It's too generous to call these people clowns. They betray their duty.

1/ This industry is made up of so many smart, passionate, open-minded, welcoming people, with genuine humanitarian interest at heart.

I know we're going to get past this. True believers will not be deterred. But, this is a massive setback. I'm really trying to control my rage. 2/ Our good, trusting nature makes us easy targets for con artists. Some even tell us straight up that they're here for profits, not crypto, and we praise them for their honesty.

Yet we're surprised when they turn out to be who they said they are. We need to raise our standards.

First and foremost, I care about clients being made whole. Investors knew what they were getting in to. The deal is sure to draw significant scrutiny. There are a lot of allegations flying around and M&A might pressure a govt move, or look like a convenient 2-for-1 opportunity. I hope that consumers come to demand regular Proof of Reserves audits. @krakenfx continues to increase the frequency and scope of our audits. It's not 100% foolproof but the more often you have to prove it, the harder it is to to hide a problem.

1/ We recently attempted to summarize what the @krakenfx culture has been over the past 11 years, and what we hope it continues to be.

We had a few heated debates and it turns out we have about 20 people out of 3200 who are totally not on board. 👇🧵

2/ 60% have been with the company for < 6 months. So, no biggie, except 20 unhappy people can sap the productivity out of another 400 with little effort.

It basically works like a SYN flood DoS. People want to be helpful but it's draining and resentment is often misplaced.

I didn't realize it was even legal to send a 12-yo for irreversible body mod surgery.

Back in my day, we had a thing called phases, trends. People saw stuff on TV and wanted to be it / do it. Some even thought drugs were cool but their parents damn sure weren't encouraging. WTF? If you are an adult and you want to become Lizard Man, go for it. I have no problem with body modification & plastic surgery, if you are fully aware of the consequences and capable of consent. The less reversible, the more we have a duty to be sure about the person's psychology.

1/6 I understand the rationale for this request but, despite my deep respect for the Ukrainian people, @krakenfx cannot freeze the accounts of our Russian clients without a legal requirement to do so.

Russians should be aware that such a requirement could be imminent. #NYKNYC 2/6 That requirement could come from your own government, as we have seen in Canada, in response to protests, bank runs and attempts to flee the country.

It could come from foreign states, like the US, as a weapon to turn the Russian populace against its government's policies.

1/11 We are trapped by our language and limited by our point of reference.

The problem with noun-oriented languages is that labels are indefinite. "You are a man." Period. Forever.

A verb-oriented language might say "You are manning." Right now. Maybe not later. 2/ I can be a runner and I can also be not running right now. Can I be a man and not be manning right now?

Well, how do you define "being a man"? It varies across time and people. Do I prove my identity by drinking beer and fixing cars or is it wearing powdered wigs & tights?

1/ Problem with going ahead now is fines/penalties can be astronomical. Will a judge understand the complex issues and side against the government? Will SEC retaliate? Refusal to discuss merits is just more leverage to force a settlement/shutdown. 2/ “We won’t tell you why we think your product is illegal but we will tell you that there is no path to making it legal. Disagree? Go ahead and see what happens.” SEC is not the only regulator playing this game. It’s getting to be more common tactic because it works.
