I happened to be only reporter (far as I can tell) at detention hearing for @GeorgeMasonU student Abdullah Hassan, accused of plotting attack on Israeli consulate in NY. Magistrate judge ultimately ordered him detained pending trial. Thread 🧵 Hassan came in wearing the standard dark green Alexandria Detention Center jumpsuit. Says "Alexandria Inmate" on the back. He's strikingly skinny and young.

For 2nd day in a row, GOP lawmakers hit Garland for proposing only 4 new DEA agents as Fentanyl deaths surge. But AG says real no. is 131, counting agents OK'd this year but not yet hired. Garland: 'The budget math and the actual math doesn’t always add up.' A few thoughts on #SCOTUS this morning....1st oral arguments of 2023...The conservatives were vocal this morning and by conservatives I mean Justices Kagan and Sotomayor....(I published this look at Kagan during the holiday break politico.com/news/2022/12/3… ) The 1st case argued was both arcane and obscure. It's actually largely under seal. It's about whether attorney-client communications are privileged when there were mixed-purposes for the exchanges.

So, here's the main thing I was left wondering after today: If the evidence shows Reffitt was planning to 'overtake our government,' we have a law for that: sedition. So, why were the Proud Boys and Oath Keepers' charged with that and not Reffitt? Was it just timing? He was set for trial in February when DOJ brought 1st seditious conspiracy cases in Jan. 2022. Adding sedition might've caused his trial to be delayed. Maybe prosecutors worried they'd lose the sedition count in a case where jurors had many other options & deft seemed scattered?
