1/3 HUGE update on our case!

We won BIG as the judge allowed ALL of our claims on copyright infringement to proceed and we historically move on The Lanham Act (trade dress) claims! We can now proceed onto discovery!

The implications on this order is huge on so many fronts! Image 2/3 Not only do we proceed on our copyright claims, this order also means companies who utilize SD models for and/or LAION like datasets could now be liable for copyright infringement violations, amongst other violations.

The whole thing is worth a read. I love these parts!

1/6 Everything that makes the internet feel wonderful and open, where creatives shared their work freely, these wonderful works are now being stolen and extracted by tech execs in a rush to train genAI models that mimic those wonderful creators.

It’s all a distraction from Ai companies and ai advocates to divert focus on the real issue: that this tech is exploitative and it relies on ill-gotten data, of artists and the public, to train for profit models without our knowledge, or consent. Essentially theft 2/ They’ll squirm and try to divert in any way possible. So you’ll hear cries on why it’s actually ok for Ai media to be exploitative because “it’s Art!”. 1/ Deeply embarrassing response to artists protesting for their rights from @ArtStationHQ.

This language is so contradictory. No artists got to decide or choose how THEIR work was used, when AI companies scraped their work from sites like Art Station (cont.) 2/ No artists got to decide or choose when AI users use their full names to generate imagery based on their work. (also sly move there Art Station, lumping AI users with your artist userbase...)

1/ I am immensely disappointed with @Adobe on this decision and I hope decision makers there reconsider.

Adobe will allow contributors who submit AI generated content to get royalties (profit) while imposing unenforceable guidelines to what kind of AI is submitted. 2/ Furthermore the person they use as advertisement is the same individual who tried (and got denied) to copyright an Ai comic. This comic used Zendaya a lot as a prompt.

1/ This protection is in place because taking works that aren’t in public domain to profit from, economically affects the artists, big and small, who innovated in the first place.

There ONLY barriers to ethical creations is just time+knowledge. Stealing artworks is not the way 2/ btw Metropolis owns! Even Sargent is public domain which bruh. There’s top tier stuff in there.

I wanted to share my favorite painting I did for #MarvelStudios #loki . This was long before the fantastic Owen Wilson was cast. This unused story moment depicts Loki in Pompeii doing whatever he wants, since he's in an apocalyptic event. And so he decides to murder a slaver. Image This key was a so fun to do. This is dehumanizing language, intent on reducing human artists to mere "tools". It is a deeply offensive tactic, but there is purpose behind these words. Let's discuss- 2/ Your labor, your craft, your dedication, and your human experience has to be reduced to that of a tool. He needs your artistic existence and your contributions erased in order to make *his* tool more palatable, to ease the potential existential threat this is to human artists.
