The suit filed by the Attorney General of 6 States asking the Supreme Court to declare as null and void the results of the Presidential Election is, with respect, a gross abuse of court process and a dangerous usage of legal means to escalate tension in Nigeria. I will explain. First, the Supreme Court lacks the jurisdiction to entertain the suit as a court of first instance. Section 232 of the 1999 Constitution provides that the Supreme Court shall exercise original jurisdiction only in disputes between the Federation and a State or between States.

1.The recent appointment of Usman Alkali Baba as the Acting Inspector of Police (IGP) is illegal, unconstitutional and an arbitrary political move that could escalate tension in the country. 2.First, the President lacks the power to unilaterally appoint the (Acting) IGP. By virtue of Section 215 and 217 of the 1999 Constitution of the Federal Republic of Nigeria, the appointment of an IGP shall be made by the President on the advice of Nigeria Police Council.

The defection of Ebonyi Governor, David Umahi from PDP to APC might just earn him a ticket to being impeached. The reason is quite simple: it may amount a contravention of our law on defection and change of political parties. The preamble of the 1999 Constitution says it was made by “we the people of the Federal Republic of Nigeria”. This has really been subject to serious debates and arguments and has even led some people to doubt the legitimacy of the document. So, who made the Constitution?

Was it made by the people or the military?

Bearing in mind that the constitution in a democracy must be autochthonous, it is important that the questions are answered for our collective development.
