In another CCMA case it has been found that refusal to grant an employee access to the workplace for refusing to be vaccinated or submit a weekly #COVID19 test amounts to a fair suspension.
In Kok vs Ndaka Security and Services the employee was instructed to only return to work once he has been vaccinated or he should submit a weekly Covid19 test.

The CCMA has issued an award in terms of which the dismissal of an employee who refused to comply with its employer's mandatory vaccination policy has been found to be substantively fair. #COVID19
In TM v Gold Rush Group, a matter heard by the CCMA, the employee referred an unfair dismissal dispute to the CCMA after she was dismissed for refusing to get vaccinated in compliance with the employer's mandatory vaccination policy.
