#SupremeCourt commences hearing of the petition by #BJP MLA Madan Dilawar against six BSP MLAs, who had merged with #Congress in #Rajasthan.
A transfer petition filed by the 6 MLAs is also being heard together.
At the outset, rebel BSP MLAs say they want to withdraw their plea.
Harish Salve appears for Dilawar and says the single judge bench order of the HC require a stay since the effect of that would be to recognise their merger.
SC Mishra, for BSP, also say the six MLAs cannot be allowed to continue & exercise their rights.

SC: "Why should we interdict the High Court hearing for now. It is listed there today. Let HC hear and pass some order. If they don't decide then we will see."
Rajeev Dhavan & Kapil Sibal contend SC doesn't need to keep it pending.
Dhavan: They (BSP) can't control their own party and they complain it here.
Sibal: BJP was very happy when it happened in Nagaland, Goa but now they have all the problems.
SC lists this on Aug 13, awaiting HC order.
The court also allowed the six rebel BSP MLAs to withdraw their transfer petition. These MLAs have said they will argue before the high court.
