A brief analysis of the concept of a special #tribunal for the crime of aggression (STCA).
 Taking into account that the crime of aggression is subject to the jurisdiction of the International Criminal Court (ICC), and in order to bring 🇷🇺 to justice within the framework of the👇

👆ICC, according to the ICC Statute and the Kampala Amendments, the referral of the case to the ICC by the UN Security Council (UNCS) is required. Since the current configuration of the UNSC does not allow for this, Ukraine has started looking for a way out of this situation.👇

👆 to investigate war crimes is, in fact, extra-legal. It contradicts the ICC Statute, which qualifies the fact of creating such courts as an independent war crime, creates a conflict between the UN normative documents, and creates a dangerous precedent for the adoption of 👇

👆decisions by some member states that directly violate the fundamental documents of the organization. Moreover, this is recognized by the authors of the concept themselves.
