Was going through Balancing of Rights in #AadhaarVerdict. The court examines right to Privacy v/s Right to Food.
This is absolute nonesense. May be the over emphasis on privacy by petitioners caused this. #Aadhaar is not an enabler (1/n)
#Aadhaar it is a tool for #exclusion . Its not something that guarantees right to food or anything. @UIDAI says they are excluding the ghosts, duplicates & imposters. (However, in practice, thousands of poor and marginalized are denied rations and monthly pensions.)

In concept or design, #Aadhaar 's purpose is not TO GIVE somebody something. Its sole purpose is exclusion.
So there arises no question of #Aadhaar enabling somebody to access food.

But making #Aadhaar mandatory can deny them food.
Exclusion can be at the time of 1. Enrolment 2. Deduplication 3. Authentication
And we have evidence to prove that exclusion is happening.

Scrapping #Aadhaar would not have affected anybody as they can continue to avail benefits using Ration Cards, MNREGA Cards, Bank Accounts etc.

So the framing of the question was basically flawed. May be those who questioned the project in SC too did not realise issue. For crores of most vulnerable people question was never of privacy v/s food, for #Aadhaar has no role in guaranteeing them food.

It is a question of life and death to them. Over emphasize on privacy, allowed the court to pit privacy against right to food. While the real issue was RIGHT TO LIVE (right to food) v/s #Aadhaar .

Since, #Aadhaar involves mandatory collection of biometric and demographic data, and its centralised storage, it essentially involves the question of #Privacy . Especially in country where there are no Data protection frameworks.
