Grand jury matter update: On Monday, @rcfp filed a reply in support of its motion to unseal the proceedings at the DC Circuit. documentcloud.org/documents/5727…
Today, there was just a flurry of activity, under seal, from the government (confirmed via dist ct filings to be the special counsel's office):
- a new lawyer made an appearance
- the gov't responded to @rcfp
- the gov't filed a motion of unknown purpose
Asked about today's filings, @rcfp lawyer @BoutrousTed tells me, "We don’t know anything other than what's on the docket regarding today's filings." He said they "strongly object" to the sealed filings and are asking for service.
Peter Carr, spokesperson for the special counsel's office, said only, "We don’t have any comment beyond the court docket."
In English: The foreign country-owned company fighting a Mueller grand jury subpoena does not object to @rcfp's motion to unseal the DC Circuit filings. The special counsel's office today responded to the request, but it's sealed, so we don't know what Mueller's team said.
Update: Per @rcfp lawyer @BoutrousTed, the government "agrees that redacted versions of the briefs and the oral argument transcript in the D.C. Circuit should be unsealed and released to the public."

I have asked the special counsel's office for confirmation.
The special counsel’s office declined to comment further.

ACTING AG WHITAKER: "I remain willing to appear to testify tomorrow, provided that the Chairman assures me that the Committee will not issue a subpoena today or tomorrow, and that the Committee will engage in good faith negotiations before taking such a step down the road."
Here was Nadler this morning, explaining why the committee authorized a subpoena, if needed, for Acting AG Whitaker.

In the 5th Circuit today, Judge James Ho wrote a concurring opinion to his own majority opinion in order to opine (unnecessarily to the ruling) on why he thinks LGBT people should not be protected by existing federal sex discrimination bans. documentcloud.org/documents/5729…
Ho, a Trump appointee to the 5th Circuit, has been on the appeals court bench for just over 13 months. In the majority opinion, which resolves the case on other grounds, Ho wrote about a 5th Circuit opinion from 1979, which he insists is still good precedent in the circuit.
Judge Patrick Higginbotham, a Reagan appointee to the 5th Circuit, wrote separately to note — albeit without ~quite~ saying it — how ridiculous that is.

Another filing from Mueller's office at the DC Circuit in the mystery grand jury case. It's sealed, so we have no clue what it's about. (Here's Tuesday's thread: )
Tonight, @rcfp filed a reply responding to the government's response (which we have not seen) to RCFP's motion to unseal the DC Circuit proceedings of the mystery grand jury case involving the foreign country-owned company.
Notably, in tonight's filing, @rcfp argues the name of the corporation/country should be made public: "Where, as here, a grand jury witness subjected to contempt proceedings does not object to the disclosure of its identity to the public, that information should not be sealed."

3/ The two major clues we got from this document are that the company has an office in the United States, and that the company does considerable business in the United States. I have been wavering back and forth between VTB and the Qatari Investment Authority (QIA)

All eyes are on Kavanaugh this morning, but I'm a few blocks away at the federal courthouse, where Paul Manafort's lawyers and prosecutors are back for a pretrial conference (you'll recall jury selection is set to begin 9/17, and opening statements are scheduled to start 9/24)
The latest hearing in Paul Manafort's DC case just wrapped up. We got a series of rulings from the judge on what will and will not be allowed in his upcoming trial — some are similar to the EDVA case, and some are different:
- No evidence allowed about the fact that the Russian collusion probe is ongoing; judge said this means the lawyers will need to be careful about how they ask Rick Gates about his cooperation (if he testifies, that is — the govt said that wasn't for sure yet)
