The holding of Elections, under the 1995 Constitution stems from the "sovereignty of the people" ,under Article 1(4) that the the will & consent of the people on who to govern them and how shall be expressed through REGULAR, FREE & FAIR Elections.
Of emphasis under the said Article are the "Regular, free and fair elections. Regular elections means that elections shall be held periodically, thus holding of election under the Constitution is certain on as and when they shall be held.
Should the #period when a #GeneralElection is held be certain?
Yes the period should be certain under the Const... Art. 67 thus the Electoral Commission is supposed to ensure that Elections are held at #fixedtimes & notified to the public in advance
Art. 77(3) provides the #Life/Term of #ParliamentOfUganda shall be #FiveYears (5) years from the date of it's first sitting after a #generalelection. This therefore means after 5 yrs a new Parliament (members) shall be elected at a #generalelection.
Election of members of Parliament. Art.88 (1) A general election of #MPs shall be held within 30 days before the end of the term of Parliament. This means elections of #MPs shall happen within 30days before the 5th yr of the term of Parliament ends.
Art. 105 (1) An elected President shall hold office for a term of five years.
This means every after 5 years the position of President shall be contested for due to expiration of the 5 yrs Presidential term .
