I have uploaded Judge Sullivan's brief in the Flynn mandamus matter. It makes it clear that (i) Flynn is a liar, (ii) Flynn had adequate counsel and, in fact, waived the right offered to him by the Court to have alternative counsel appointed for him,
(iii) the District Court has the discretion to deny the requested dismissal of the charges that Flynn has, twice, plead guilty to, and (iv) the reason that Judge Sullivan has filed a response in the mandamus action is because the appellate court requested him to do so.
Moreover, in such a case, the brief makes clear that he has the right to respond via counsel.
