NEW LAWSUIT: We’re suing the Department of Homeland Security for records related to deaths in ICE and CBP custody.

This lawsuit is the latest in our ongoing investigation of conditions in migrant detention centers.

This lawsuit concerns 7 different #FOIA requests. DHS has not produced records in the legally mandated amount of time, so we’re suing to compel the release of these records.
Here’s the information we’re seeking:

1/ After someone dies in DHS custody, officials fill out a Detainee Death Review report. We’ve asked ICE for the portions of those reports that analyze security and compliance.

2/ We also asked the U.S. Customs and Border Protection for the Healthcare and Security Compliance Analysis reports for 6 people who died in custody.

3/ We asked DHS & ICE for event timelines provided to the Office of Civil Rights and Civil Liberties as part of the reporting process for the deaths of 26 detainees held in ICE custody — and for any complaints issued in response.

4/ Finally, we requested copies of mortality and postmortem reviews completed by the ICE Health Service Corps and contractors regarding detainees who died in ICE custody.

President Trump issued an executive order the first week of his presidency, instructing CBP to expand the detention of migrants apprehended while crossing the border. This set the stage for increasingly dangerous and unhealthy conditions in detention centers.
Now, the spread of Covid-19 has only worsened conditions for migrants who are detained by DHS.

NEW: We obtained documents that show extensive evidence of Stephen Miller and Gene Hamilton (former counselor to Jeff Sessions) using DOJ’s press shop to push anti-immigrant propaganda.

For example, in March 2018, Miller praised Hamilton for a new weekly round-up of “Opioid, Immigration, and Violent Crime” press releases published by DOJ’s Office of Public Affairs.

“Excellent,” wrote Miller.
On April 17, 2018, Miller thanked Hamilton for a press release on the denaturalization of a child sex abuser.

President Trump issued an order to exclude undocumented immigrants from counting towards dividing up Congressional seats.

In 2019, the Supreme Court ruled that the census could not ask someone’s citizenship status.

We’re investigating political interference in the census.
We sued for the emails of former DOJ official John Gore, who had provided the official letter to the Census Bureau with the administration’s stated legal reason for adding the question.

Along with @NAACP_LDF, we sued for records of DOJ’s involvement in the citizenship question. In May, a federal district court ruled that DOJ had failed to adequately search for these records.
